Planning Co-iasion for a final decision. Chairman Farrow
further explained the procedure observed by the co-isaion
during public hearing iteaa.

1. ZC-253 -DAON CORPORATION. A preannexat1onal zone
change fro• A-70-8 and R-S-3 (County) to R-1-7500
(City) on property generally located on the east
aide of Melrose Avenue (future) approximately 600
feet north of La Costa Meadows Drive.
Wi th the aid of a tranaparency shoving the location of the
property, Bill Hot.an gave a staff report on the matter.
Chairman Farcvv opened the public hearing at 7:06 P.M.,
and extended the invitation to speak.
The Coaaiaaion recognized Mr. Ji• Goff, repreaenting the
Daoo Corporation. Kr. Goff urged adoption of the zone
chaqe, and expreaaed vil iinzne11 to respond to any
queations.
Since no one else wished to ■peak on the matter, Chairman
Parrow cloaed the public hearing at 7:07 P.H .

Tt.e c-iuion recognized Mr. Don .\gat"p, 2956 Rooaevelt,
Carlabad, Planning Conaultante for the applicant. Mr.
Aaatep referenced Condition• 34 and 35, and indicated
that they deal pri-rily with the limitation• that the
City ia iapoaing on the developer. He added that the
propoaed condition, include a traffic etudy to addreae
traffic impact• for thie develoi:-ent and eurrounding
neighborhood•, and the developer'• nbligation to pay a
pro-rated 1hare of any potential i11111rovement1.
Mr. Agatep continued to expre11 hi1 opinion that it i1
unju1t for the developer to have tr pay for a traffic
ltudy for 1oaething that i1 not defined . He added that a
previoualy done !IR 1ubaitted to the City by Occidental in
Nov-ber, 1981 1howed there will not be a traffic problem
until all buildout in the vic:nity of Poin1ettia Lane i,
accoapliahed, and at leaat SO% of the buildout of
c~rcial faciitiea are accompli1hed, which may be 10 to
15 year, do~~ the road. He added that there vu a traffic
atudy included :n that !IR, and the applicant feel, that
if the City i1 goin~ to conduct the study, it should be
with their own fund,.
With regard to the improvement obligation at Poinoettia
Lane and the freeway, Mr. Agatep indicated that again, it
ia unknown what the ,cope of the project ie. He added
that the City'• public facilitiee policy require, 2% of
the a11e11ed valuation of any given project to be
contributed to e fu,,d to build publi<: improvements in the
City, and in their opinion i1 sufficient to cover that
potential eventuality.
Mr. Agatep concluded by requeeting that the Planning
c-i11ion approve the project with a reco-endation to
~h• City Council that they approve the application of 10111e
of the public facilitie, fund, generated from this area to
the conatruction of the bridge.
With regard to the publi~ f ecilities fee, Richard Allen
explained that City Council policy require• that they be
uaed for public facilitiea which are not covere~ by other
taua and are City-wide in nature. He added that bridge•
are no~ covered under the public facilitiea fee.
Mr. Allen continued that the purpoae of the traffic 1tudy
i1 not only to determine the amount of traffic, but what
~dL-,te areal would be contributing traffic to the
bridae, He indicated that in orJer to a11i1t the
developer, Staff will attempt to _,otain aa 1m1ch data as
po11ible prior to the City Council hearing, and infonn the
denloper with regard to the total coeta and timing of the
atudy to alleviate the vaguenes1 of the conditions.
C«-iuion diacuui.on rel.:ted to Conditions 34 and JS
with regard to the traffic 1tudy and the bridge,
C«-i11ioner Roabotia indicated that there are traffic
1tudie1 for the area, an EIR, and for those area• without
an IIR there i1 the General Plan.
In re1pon1e to Ca.ai.11ion query, Mr. Agatep indicated that
it w uld be 1ati1factory to the applicant if the project
were conditioned with approxi-te co1t1 and pro-rata
prior to the Council hearing.

With regard to the public facilities policy, Mr . Agatep
indicated that paragraph 2 specifically atatea, "The City
viahee to establish a policy to allow for development to
proceed in an orderly manner." He added that it goe1 on
to addreae "City Provided Facilitie1," and 1pecifiee,
"including but not limited to parka, major 1treet1,
traH ~c 1ignah, 1torm drains, and bridge,." He added
that the bridge i1 not a localized 1ervice and ~rovidea a
connection ea1t to ve1t from I-5 to Melrose Avenue, and
vill be the only connection the City vill have in the
future, exclu1ive of Palo-r Airport Road, that provide•
for eaat/ve1t traffic movement, and acce11 to the beach.
Richard Allen re1ponded that he vaa advi1ed by the
A11i1tant City Manager for Developmental Services that
thi1 bridge va1 not inc i.uded in the public facility fee
program, and that it ie the p~licy of the City Council
that it not be included a1 they are for City-vide
project■. He added that it would be a Council policy
decieion to include this project.
The Comnission recognized Dr. Charles Kramer, 6798 Paaeo
del Norte, Carl1bad. Dr. Kramer expreesed concern
regarding the single acces1 in and out of the project, and
~t•a affect on hie property with regard to traffic.
With the aid of a w~ll exhibit, Bill Hofman indicated
there are two acce11ee in and out of the project.
The Co-iseion recognized Hr. Jack Kubota, Consulting
Engineer representing the Costa Real Municipal Water
D1~t~ict, P. 0. Box 1095, Carlsbad. Hr . Kubota referenced
a le~ter from his office dated June 22, 1982 distribute~
to the C~a1ion prior to the meeting. He indicated that
Coeta Real i1 the water agency that currently provides the
water 1ervice for the entire neighborhood where this
development i1 located, and believes it i8 in the beat
interest of the area that thi1 development proceed on the
ba1i1 of the original development.
Mr. lubota concluded by expressing willingness to respond
to any que1tion1.

The CCMBission adopted the following Resolution,
reco-nding approval of CT 81-30/CP-174, to the City
Council based on the findings and subject to the
conditions contained therein; with the following

The Ca-iaaion requested, by minute motion, policy
direction from the City Council vith regard to the issues
of the traffic study, brid~e, and water service.
CONTINUED DISCUSSION ITEM
5. PCI>-35 1 MOLA. Request for a Planning Comniasion
Determination to allow an amendment to the sign
program for the West Bluff Plaza on the eaR t side of
El Camino Real in the C-1-Q Zone.
With the aid of a transparency showing the location of
the property, Bill Hofman gave the staff report,
essentially as contained in the written report.
Mr. Jaiea O'Neal, O'Neal, Ready & Yeomans, 707 Mission
Avenue, Oceanside, Attorney representing San Dieg~ito
National Bank, addressed the Coaaiasion. Mr. O'Meal gave
a brief hiatory of the bank, and indicated that they will
not have t he advantage of fronting right onto El Camino
Real as the ether banks in the Plaza. He indicated that
the bank will take up three bays of the building, which
would allow three individual signs, and expressed the
opinion that they are not requesting more signage than
they are entitled to.
Mr. O'Neal concluded that the applicant does not intend
to remove any trees to provide for the signs. He showed
pictures of other banks in the City outlining their
aignage, and stressed the importance of the monument
sign.
Mr. Peter von Elten, part owner of Mola Development,
addressed the CO!Biaaion. Mr. von Elten presented a
petition aigned by every co-rcial tenant in the Weat
Bluff Plaza to the Cowi,iosion in favor of the four
proposed signs, including t he monument aign. Re
continued to speak in favor of the request, and indicated
that the San Dieguito National Bank would have a positive
iapact on the center.
Mr. O'Neal referenced a letter from Mola Developaent
Corporation dated June 4, 19ij2 in which they indicate it
ia their intention that no other tenants in the Weat
Bluff Plaza will be permitted any aignage on the 110nument

Mr. L-i• Hack, Senior-Vice President and Chief Financial
Officer of La Jolla Bank and Trust Cmapany, La Jolla,
addre11ed the Coaai.aaion. Mr. Rack indicated that the
petition circulated by Mola Developaent vu not signed by
La Jolla Bank and Trust Co., ar,d added that they are
oppoaed to the application and agree with the staff
recoaaendation.
