PLACE OF MEET I NG : City Council Chambers CALL TO ORDER The meetin~ was cal 'ed to order by Chairman Farrow at 7:02 P.H. ROLL CALL Present -Farrow, Rombotis, Rawlins, Jose, Marcus, and Schlehuber. Absent -Friestedt. Staff Members present were: Bill Hofman, Associate Planner Richard Allen, City Engineer Ex-Officio Members present were : Michael Holzmiller, Land Use Planning Manager Daniel Hentschke, Assistant City Attorney PLEDGE OF ALLEGIANCE was led by Chairman Farrow. PLANNING COMMISSIO?l PROCEDURES : Chairman Farrow explained Planning Commission procedures in its capacity as an advisory Commission to the City Council, and identified those matters dele~ated to the Planning Commission for a final decision . Chairman Farrow further explained the procedure observed by the Commission during public hearin~ items. NEW PUBLIC HEARINGS 1. ZC-259, TRAYER . Zone change from R-1 to RD-H located on the north side of La~una Drive between Jefferson Street and Davis Avenue . With the aid of a tranaparency showing the location of the property, Bill Hofman gave the staff report, eaaentially as contained in the written report. Chairman Farrow opened the public hearing at 7:05 P.H., and extended the invitation to apeAk. The Comieaion recognized Mr. Charle• Trayer, the applicant. Mr. Trayer indicated he is in concurrence vith the ataff recoDDendation, and expressed willingneas to reapond to any queationa. Co-iaaioner Joae inquired vith regard to the potential converaion to condoainium.a in the future, and suggested that the applicant conaider developing in accordance with the PUD Ordinance if financially posaible. Mr. Trayer reaponded that at this time there are no specific plan• for the property, and added that the intent ie to zone it to the existing Haater Plan use. She alao expreaaed concern regarding the impact that the project vill have on her property, aa it will border her 1/3 acre by over 130 feet to the veat. (D r '1 MINUTES July 14, 1982 Page 2 Since no one else wished to speak on the matter, Chairman Farrow closed the public hearing at 7:12 P.H. Bill Hofman indicated that Staff considered the possibility of a Q-overlay on the property which could set up buffers through the site development process. However, it requires a site development plan for the entire piece of property , and there are five different property owners. Coaaission discussion related to the feasibility of a Q-overlay. Michael Holzmiller responded that if a (-overla) is not applied to the property, the plan would still come back to the Comission for review to approve the density of Lhe project. He indicated, hovevPr, that the 0-overlay would put the property owner on notice that there is some concern regarding compatibility with surroundin~ properties. The Commission :-,,p:oved the Negative Declaration issued by the Planning Director, and adopted the f o llowing Resolution, recommending City Council approval of ZC-259 based on the findings and subject to the conditions contained therein; with a modification to RD-M-Q, and the addition of a finding that addresses the situation with the adjacent property owner: 2. RESO¾UTION NO. 1987, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM R-1 TO RD-M LOCATED ON THE NORTH SIDE OF I..AGUP.A DRIVE, BETWEEN JEFFERSON STREET AND DAVIS AVENUE . CT 82-8/PUD-41, TREETOPS UNLIMITED -VILLAGE G. Request for a l09 lot/108 unit tentative tract map and planed unit development in Vi llage G of the Calavera Hills Master Plan located to the west of the easterly terminus of 1amarack Avenue in the P-C zone. Bill Hofman gave a staff report on the matter, with the aid of a transparency shoving t ~e location of the property. He continued, with thP aid of a wall exhibit, to briefly outline the major features of the project. Chainnan Farrow opened the public hearing at 7:18 P.H., and extended t he invitation to speak. The Commission recognized Mr . John Schumaker, representing Pacific Scene, 3900 Harney Street, San Diego . Mr Schuaaker expressed agreement with the staff reco-ndation and conditions of approval . He referenced Condition 20 of the Resolution , and indicated that same requires that the 2-acre recreational vehicle storage area required by the Master Plan be developed prior to occupancy of the units in the project . He continued that the applicant concurs with sane; however, they do not own the property on which the storage area will be built, and requested that they be allowed to use the existing teaporary storage area used by CT 76-12, until such time as t he area is developed. In response to Co-is1ion query, Mr. Schu-ker indicated that t he ex i sting storage area is of adequate size to handle both projects. Bill Hofman responded that Staff's concern is that the temporary RV parking lot would not be adequate if another development is built. Coaiiseioner Rombotis suggested that the wording be modified to read, "or a facility satisfactory to the Planning Director, prior to occupancy." The Commission and Staff concurred. With regard to Plan JOOC, Commissioner Jose suggested that the windows in the left unit be moved to the left side to allow for more privacy and noise attenuation for those persons living in the next unit. Hr. Schumaker indicated that the architect would be directed to make the change . Since no one else wished to speak on the matter, Chairman Farrow closed the public hearing at 7:28 P .H. The Cotilllission approved the Negative Declaration issued by the Planning Director , and adopted the following Resolution, reco111111ending approval of CT 82-8/PUD-41 to the City Council, based on the findings and subject to the conditions contained therein; with the modification Condition 20 as outlined: of 3. RESOLUfION NO. 1983, RECOMMENDING APPROVAL OF A i09 LOT/108 UNIT TENTATIVE TRACT MAP AND PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED TO THE NORTHWEST OF THE EASTERLY TERMINUS OF TAMARACK AVE. SDP 82-l/V-339, PALOMAR VENTURES . Request for approval of a site development plan and a variance for the construction of two office-industrial buildings at the northweet corner of Palomar Airport Road and Avenida Encinas in the P--M-Q zone. With the aid of a tranaparency showing the location of the property, Bill Hofman gave the staff report , as contained in the written report. Chairman Farrow opened the public ~earing at 7:34 P .H., an extended the invitation to speak. Since no one wished to speak on the matter, the public hearing waa closed. An &111endment to the Zoning Ordincnce to modify regulations regarding signing for freeway service facilities. Michael Holzmiller gave a staff report and some background on the -tter. He indicated that Staff is reco-ending the wording be changed in the freeway service facility definition to read as follows: (6) "Freeway service facility means a lot or parcel located at the apex of a freeway interchange quadrant which contains one or more of the following uses, a restaurant, a aotel, or an automobile service station. When two or more adjoining lots or parcels are joined in ownership, share coaaon access by means of recorded easement or have an approved co-on parking-facilities plan, they ly be considered a freeway service facility or purposes of this chapter. In no event; however, shall any lot or parcel or portion thereof located more than 660 feet from the apex of a freeway interchanae quadrant be considered part of a freeway service facility." Chairman Farrow opened the public hearing at 7:40 P.H., and extended the invitation to speak. Since no one wished to speak on the matter, the public hearing was closed. The co-ission approved the Negative Declaration issued by the Planning Director, and adopted the following Resolution, reco11111ending approval of ZCA-143 to the City Council based on the findings contained therein; with the aodification to Section 21.41.030(6) regarding the freeway service facility definition as outlined: RESOLUTION NO. 1986, RECOMMENDING APPROVAL OF A ZONE CODE AM!NDMDT, AMENDING TITLE 21 OF THE CARLSBAD KJNICIPAL CODE BY THE AMENDMENT OF SECTIONS 21.41.030(6) AND 21.41.070(3) TO ~DIFY REQUiaEMENTS REGARDING FU!WAY SERVICE FACILITIES. DISCUSSION ITEMS 5. PCD-36, CITY OF CARLSBAD. Request for a 20' high fence at Levante Park. Michael Hols■iller gave e brief staff report on the -tter. In response to Ca.aiaaion query, Mr . Holzmiller indicated that the surrounding neighbor• are in agreement vith the propoaed fence. Uses Allowed 1n the PM Zone. Michael Hnlzmiller indicated that Staff is reco11m1end:ng the addition of a note to provide further clarification to the intent of the list, to only allow office uses which are not retail in nature, do not cater to the general public, and do not generate walk-in or drive-by traffic with associated exterior si~ns. The Commission concurred with Staff regarding the list of Office and Professional Uses Permitted in the P-M Zone, and directed Staff to prepare an Administrative Policy im~lementing said list; with the addition of the note to the bottom of the list, as outlined by Staff. 7. CT 8O-46/PUD-27, SWAB. Michael Holzmiller indicated this was an informational only item, and no action was taken.
