CALL TO ORDER
The meeting wa1 call~d to order by Chairman Farrow at
7:00 P.H.
ROLL CALL
Preeent -co-issioners Farrow, Rombotis, Rawlins,
Joie, Marcus, Schlehuber, and Friestedt.
Abeent -None.
Staff Members preeent were:

PLANNING COMMISSION PROCEDURES
Chairman Farrow explained Planning Colllllission procedures
in it, capacity as an advieory Co11111ission to the City
Council, and identified those matters delegated to the
Planning co-i11ion for a final decision. Chairman Farrow
further explained the proecedure observed by the
co-i11ion during public hearing items.
OFF-AGENDA ITEM -Bonds Project
Michael Holzmiller referenced the Bonde project, which i1
a request for a pre-zone that was heard a month ago,
located off El Camino Real, where they were having probelU
with LAFCO in approving an appropriate pre-zone by the
City. He reported that the matter was referred to the
City Manager, and the item was continued until tonight'•
meeting; however, there is no new information. Therefore,
Staff i1 requeeting, and the applicant concurs, to table
the utter, and return to the Co11111i11ion when the City
Manager ha• met with LAFCO.
The co-i11ion continued the utter until 1uch tiae a1
the City Manager ·c.eet1 with LAFCO.
NEW PUBLIC HEARINGS
1. v-3411 HORTON -Requeet for a variance of the Zoning
Ordinance to reduce the 1ideyard 1etback fro■ 10' to
31 on property located at the northweet corr.er of
Iele Drive and Hilleide Drive in the R-1 Zone. (4225
Iele Drive.)

Chainnan Farrow opened the public hearing at 7:07 P.H.,
and extended the invitation to speak.
The Co-iasion recognized Hr. Richard Horton, 4225 Isle
Drive, Carlsbad, the applicant. Hr. Horton referenced the
extensive block work he has done around the corner from
the house, and indicated his neighbors have expressed
appreciation for the work he has done. He indicated that
his lot is situated so there is no place he can put a
garage on the property. He added that moat of the houses
in the area have three-car garages, and his only has a
two-car garage. He indicated he. rebuilds antique cars,
and would like to have a place to store them on his
property.
Hr. Horton continued that he plans to have a storage room
above the garage, as he is a building contractor and
needs the storage space for his records. He indicated his
plan is to build a 20' by 20' room, leaving 10' from the
property line of his next door neighbor, with no windows
facing the neighbors' side. He added that he plans to
pave the 10' area.
Hr. Horton indicated that Staff suggested he withdraw his
application, and build a 10' by 30' room, which he does
not feel would be practical. He added that as much or
more of the structure would be visible with a room of that
size as would with hie proposed 20' room. Hr. Horton
concluded that several neighbors in the area have
expressed approval of his project, and he urged approval
of same.
The Colllllission recognized Hr. Ronald Clarke, 4248 Park
Drive, Carlsbad. Hr. Clarke indicated his property abutts
Mr. Horton's, and spoke in opposition to the variance. He
indicated that Mr. Horton's property was on the market for
sale for some time, and expressed concern in that if Mr.
Horton ever sells his home, the new owner could have the
potential of a studio apartment income, if this project is
ap~roved. He expressed the opinion that all the homes
built in Tamarack East were done so with adequate storage
apace for single-family homes, and he expressed concern
regarding the 1afety of such a structure, along with Mr.
Horton'• aw~ing pool.
Mr. Clarke continued to express concern regarding parking
in Mr. Horton's driveway, and indicated that same would
extend acroas the right-of-way and the sidewalk. He
indicated he is alao concerned about traffic making right
hand turna fr011 Iale Drive onto Hillside, as the aite
diatance would be impaired. He indicated that he will
loose hie privacy aa the structure will look into his
-•ter bedroom. He concluded that Mr. Horton haa never
contacted hi■ to diacuaa his plane, and he requested
denial of the variance.
Mr, Horton addreaaed the co-iaaion, and indicated that
the atructure will not be clo1e to the property line, aa
be ia proposing to keep it back 10'. He pointed out that
the aide of the 1tructure that will face Mr. Clarke's
property will not have any w1ndov1. He indicated that he
baa not contacted any of the neighbora, aa he waa told by
the Building Depart■ent it waa not neceaaary, aa they
could addreaa the -tter when it came before the Planning
eoaaiaaion. He concluded by requesting approval of the
variance.

Since no one elae wished to apeak on the matter, Chairman
Farrow closed the public hearing at 7:28 P.H.
Co-iaaion diacuaaion reflected their inability to make
the four -ndatory findings.
In reaponae to co-iaaon query regarding where the
applicant could locate an acceaaory room on the property
to meet City Code, Bill Hofman indicated that he is able
to build an acceaaory room 10' back fro• the property line
on the street side.
The Co-iaaion adopted the following Resolution, DENYING
V-341, baaed on the finding• contained in the ataff
report:

THE STREET SIDEYARD SETBACK FROM 10' TO 3'
GENERALLY LOCATED ON THE NORTHWEST CORNER OF ISLE
DRIVE AND HILLSIDE.
ZCA-134(A)1 CITY OF CARLSBAD -An amendment to the
Zoning Ordinance expanding the authority of the Land
Uae Planning Manager for approving certain
Administrative Variances.
Bill Hofman gave a staff report on the matter, as
contained in the written report.
Chairman Farrow opened the public hearing at 7:38 P.H.,
and extended the invitation to speak. Since no one
wished to apeak on the matter, the public hearing waa
closed.
Coaaiaaion discussion related to the number of
applications of this nature that are actually received.
co-iaaioner Joae reco-nded that a report be provided
to the co-iaaion after a year for informational
purpoaea, indicating the nuaber of application• received.
The co-iaaion adopted the following Resolution,
reco-nding APPROVAL of ZCA-134(A) to the City Council
baaed on the findings contained therein; and di.·ected
Staff to provide a report to the co-ission after a year
for inforaational purpoaea:
RESOLUTION NO. 2020, RECO~NDING APPROVAL OF A ZONE
CODE AMIMDM!NT, AMENDING TITLE 21, BY THE AMENDMENT
OF CHAPTER 21.51, SECTION 21.51.020 TO EXPAND THE
AUTHORITY OF THI LAND USE PLAMNING MAN.AGER FOR
APPROVAL OF CERTAIN VARIANCES.

3. PCD-3?. RICHARDSON BROTHERS -Request to develop a
Mitsubishi autoa>bile dealership on the east aide of
Paaeo del Norte between Cannon Road and Palo-r
Airport Road in the C-2 Zone, located between the
Lincoln Mercury dealership and the Hoehn Motors
dealership.

Hr. Thomas Richardson, Richardson Brothers, 2568 State
Street, Carlsbad, addressed the Co11111ission, and responded
to Conmiaaion questions regarding the proposed design of
the project.
The Co11111iasion adopted the following Resol ution,
APPROVING PCD-37, based on the findings and subject to
the conditions contained therein:
RESOLUTION NO. 2022, RECOMMENDING APPROVAL OF A
REQUEST TO DEVELOP AN AUTOMOBILE DEALERSHIP ON
PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF PASEO
DEL NORTE BETWEEN CANNON ROAD AND PALOMAR AIRPORT
ROAD.
APPROVAL OF MINUTES
Minutes of the Regular Meeting, held September 8, 1982,
were approved as corrected:
Page 7 -first paragraph -changing the last
sentence of the motion to read, "with the add i tion
of a finding to address traffic and sound
attenuation from the railroad."
Page 2 -fifth paragraph -rev1s1ng the end of the
sentence to read, " and there is no need for RV
storage."
Page 2 -sixth paragraph -revising the last
sentence to read, "Hrs. Huff expressed concern
regarding parking, and indicated that if people
cannot park on the street, they may park in the rear
of their lots and would be visible t o her property."
