'Ille meeting was called to order by Vice-chairman
Schlehuber at 7:07 P.M.

Vice-chairman Schlehuber explained Planning Connission
procedures in its capacity as an advisory Connission to
the City Council, and identified those matters delegated
to the Planning Connission for a final decision. Vice-
chairman Schlehuber further explained the procedure
observed by the Connission during public hearing items.
Richard Allen intrcduced Mr. David Hauser, Associate Civil
Engineer, to the Planning Ccl!lnissioo. He indicated to the
Qmnission that Mr. David Hauser loOUld be attending, fran
this day on, all Planning Ccl!lnission meetings on a regular
basis.
1 • CT 81-50/Pl,D-37, O'GMA -Request for an eight lot
tentative tract map and planned developnent on
property located on the west side of Valley Street
between Ba8SWOOd Street and Oak Street in the R-1-
7500 zone.
With the aid of a transparency showing the location of
the property, Bill Hofman gave a staff report oo the
•tter.
For clarification purposes, Bill Hofman indicated that
staff is re<XlllNIUding th&t Conditions 19, 26, 28 and 30 be

28) "Prior to the reoordation of the final map, the

the ultimate 60 foot right-of-way of James Drive,
adjacent to the subdivision boundary."
30) "Prior to the recordation of the rinal map the sub-

roadway section within a rninirrun 30 foot publicly
dedicated easement for Jooies Drive fran the
subdivision boundary to Basswood Avenue."
Vice-chairman SchlP.huh!r ~ned the public hearing and
extended the invitation to speak.
'lbe Ccmnission recognized Mr. Mike O'Gara, 3229 Valley
Street, Carlsbad, the awlicant, owner and devel~r.
Mr. O'Gara indicated to the Camlission that this was his
present residence. He added that this was a culmination
of about 2 years of "'°1"k and that he had taken into
consideration the surrounding houses and surrounding
· neighborhood itself. He expressed that this project ~ld
achieve sare of the goals the city has, as far as breaking
up of superblocks. He further explained that this project
was in the middle of a split block, and that probably with
all of the superblocks in the city, this is probably cne
of which '-OUld make propert1 more useful toward the city
and nvre available to the services. He continued that
presently, the situation as is, makes parking difficult
and the yards adjacent, being hillside, are diffiuclt to
maintain. In conclusion, Mr. O'Gara stated •hat this
project would help alleviate alot of the problems in the
area for the city.
'nle Camtission recognized David Peterson, 1531 Basswood,
carlsbad. Mr. Peterson, with t.he aid of a transparency,
depicted the location of his property and stated to the
Ccmnission that he had several concerns; his first cx:,ncern
was the fact that every time it r ains water canes down and
to the culvert, goes across and ends up with a lak~on his
property. He felt that according to the plan before him,
he would be getting all of the water. Secondly, Mr.
PeterBa'I was concerned as to whether or not he had to
dedicate 60 feet of t. l.s property and where the road was
defhiitely going to go through. He added that there
should be sane sort of system where he '-OUld be
reillt>ursed.
With regard to the dedication of the property, Mr.
Hentschke, Assistant City Attorney, indicated that this
1188 a matter to be resolved between the property owners at
that time. Mr:. HentschJre added that at this time the city
1188 not inposing this requirement at this preliminary
stage.
~. David Hauser indicated that the Engineering Department
1188 awre of the drainage problem that existed and stated
that the city has a standard condition (Condition No. 16)

Mr. David Hauser continued that one of the things
occurring in this area was the current proµ,sal of an
assessment district. He stated that this w::>uld not be
ooly for the placement of the road, but also for a
drainage system that would handle that entire area.
'lhe Ccmnission recognized Oorthia Barr, Bass~,
car ls bad, c-epresent ing Mr. dl1d Mrs. Fu, 16 30 Bass\<oOOd ,
Carlsbad. She indicated that the Fus' main concern was
why they have to share the cost of the road construction
which would run along the right side of their house.
In resp:,nse to Camlissioo query regarding the cost of re d
construction, Mr. Schlehuber, Vice-Olairman, stated that
the Fus' would not be respcnsible for any costs, accordi g
to the plan presented before them tonight.
'lbe Camlission recognized David Peterson, Ql,,'l'\er of
property oo Valley. Mr. Peterson questioned as to what
other procedures followed before the carmencing of houses
oo that cul-de-sac.
Dis~'\lssion related to potential possibilities of curbs,
gutters, assessme~t district and drainage problems and
staff respcnded to Camlission questions regarding same.
Since no one else wished to address the matter, the
public hearing was closed.
'lbe camli.ssion approved the Negative Declaration issued by
the Land Use Planning Manager, and adopted the following
resolution approving CT 81-50/~37, based on the
findings and subject to the conditions contained therein;
with revised conditions nos. 19, 26, 28 and 30 as outlined
by staff:

ZCA-143 CITY OF CARLSIW) -An amenanent to the
Zoning Brdlnance to mdify regulations regarding
signing for freeway service facilities.
Midlael Holzmiller, Land Use Planning Manager, presented
the staff report. He indicated to the Camlission that
this was the sane ordinance reviewed a couple of nonths
t1q0, with one addition. He indicated that the item was
reviewed by the O'.>uncil and the Council felt that the
maxinull sign area allowed under the ordinance was
excessive. He continued that staff had not reviewed the
sign area regulations of the ordinance at the time the
ociginal staff report was prepared, but has always been
part of the ordinance. St11ff concurs with the O'.>uncil 's
reoomiaendation which would allow 150 sq.ft., for ooe use
and 250 aq.ft., \oitlen tw or 110re W.'!S are identified on a
fr:ee,ey sign.
Vice-chairman Schlehuber q,ened the public hearing, and

3. ZCA-144 CITY OF CARLSBAD -An amendment to the
Zoning ()rdinance wt.ich would permit the use of
oooi)ination zoning (l'll'.)re than one zone) on property
in conjunction with a specific plan.
Olarles Grinm, Principal Planner, g-tve the staff report,
essentially as contained in the written report and
expressed willingness to respond to any questions.
Carmissioner Friestedt expressed concern as to an exanple
where a situation similar to this -.ould apply.
In response, Mr. Grin'ro, explained that along both sides of
Paseo del Norte bett-een Palanar Airport load and Alta
Mira, that this area was presently in a state of trans-
ition and possesses all three of the unique circumstances
as listed in the staff report. He indicated that sane
industrial uses already exist, and tl at recently there has
been a greater demand for ccmnercial (tourist-oriented)
and office uses in the area. Mr. Gri.mn added that because
of this demand, the general plan was recently amended and
now designated this area for Tr.avel Service and office
type uses. Mr. Gri.mn also stated that nultiple zoning of
a:mnercial Tourist (C-T) and Residential Professional (R-
P) would be appropriate to Ul'l)lement the general plan and
to assure ocnpatibility of uses and rrultiple zoning would
require the developnent of a specific plan for the area.
Mr. Grinm continued that there are a few other exaq>les in
the city and as developnent occurs there are going to be
mre and nr::>re problerrs and l'll'.)re and l'll'.)re areas where that
would be necessary. lt:Jwever, Mr. Gri.mn continued that
that is one of the reasons the 3 criteria is put in, so
that it cannot be arbitrarily used anywhere.

CArlsbed High School. MB. Mizera stated to the Carmission
that she attended the meeting on an assignnent for her
history class.
