The meeting was called to order by Chairman Schlehuber at
7 :03 p.m.

he gave a short suumary of the Procedure.
The Coumission granted a continuance until February 9, 1983,
on Item 14 -ZC-269, WSK, since no one wished to speak on
this subject, as requested by applicant.

2. CT 81-17/PUD-46, MANDANA CORPORATION -Request for a
148-lot subdivision located approximately one mile
east of El Camino Real at the western terminus of
Sunny Creek Road in the R-E Zone.
Mike Holzmiller, Land Use Planning Manager, gave the staff
report, using a transparency to show the location of the
site and a wall map to show the planned project.
When this plan was originally submitted, staff thought it
did not meet the intent of the R-E Zone requirements and
so indicated to the applicant, but staff wa~ willing to
consider the proposal. A meeting was arranged with the
applicant and the surrounding property owners and staff
attended the meeting. Although there were several concerns
expressed, the over-all feeling was that the surrounding
property owners did not object to the concept as proposed
by the applicant. At first, staff thought of bringing just
the policy issue to the Planning Canmission, but decided to
bring the plan before the C01111.1issi on to allow them to see
the proposed concept.
Staff did set up a criteria for this project. The proposal
does not meet the criteria set down by staff, as outlined
in the staff report. A copy of the R-E Zone was provided
to the Commission for their review. The main issue is
one of policy, and that should be decided first, as to
whether the concept does comply with the intent of the R-E
Zone.
Coo.missioner Farrow stated he wanted to make some comments
prior to the public testimony . After considering all the
factors involved, he felt this property was correctly zoned
R-E, but this project does not meet the intent of the R-E
Zone, and he questioned whether they had a large enough
piece of property. The City designated this piece of
property as R-E, and it is the only one in the City of
Carlsbad. This project is a good one, but it does not fit
the intent of the R-E Zone, and if the R-E Zone is to be
retained, it would be difficult to accept this project on
this piece of property. .1'.lso, if this ~roject were approve<\
with changes made and on a trade-off basis, it wouldn't be
setting a ~recedent within the City of Carlsbad. He stated
he liked the project--but it doesn't meet R-E Zone intent.
Chairman Schlehuber opened the public hearing at 7:22 p.m.
and issued the invitation to speak.
'Iha Comiasion recognized Mr. Don Agatep, 2956 Roosevelt,
Carlsbad, representing the Mandana Corporation, who stated
he understood the principle. However, he stated he took
exception to the interpretation of the intent of the R-E
Zone. 'Iha R-E Zone intended to allow large-lot developnents
in the City of Carlsbad. This large-lot statement was
us\aed under the auspices of the sewer moratorium--if you
had a septic tank, you had to have bigger lols--to create
a rural subdivision environ111ent when fe&sible. It is his
i~pression the PUD Ordinance allows for innovative designs,
and with the open spaces, the golf course, the ponds, the
applicant had to reduce the lot size to less than one acre.
Mr. Agatep used the graphic to show the sizes of the lots
and their positions in the project.

Mr. Agatep questioned whether the R-E Zone was the proper
Zone for this property at this time. He felt the project
should be returned to staff with an approval and his client
could do some re-design of the project and come up with
something acceptable to staff.
Commissioner Friestedt asked what the active open space
was and the passive space--what percentage--and Mr. Agatep
answered approximately 25 to 30 percent that he classified
as active open space, not counting any passive open space
such as setbacks, slopes, etc.
In answer ~D a question from Commissioner Jose as to whether
the golf course would be available to the public, Mr. hgalep
stated there would l.Je me.'ni,~rships available to the public;
it would be a private club with memberships av:iilable to
the citizens of Carlsbad.
Crnmnissioner Farrow asked Mr. Agatep if they had discussed
u,~ phasing to insure developing the golf course first.
Mr. Agatep stated that it would be started in the first
phase, but might not be completed until a later phase.
Commissioner Friestedt commented that in cases of this kind,
where there is a trade-off and the golf course is a signifi-
cant factor in that trade-off, it certainly should be built
first. Mr. Agatep assured the Commission that if they did
approve the project, by the time the applicant returned
for conditions of approval, a time frame would be set up
for the building of the golf course. It would not be just
a promise for the future.
Chairman Schlehuber asked about the ownership of t:he golf
course and the maintenance and Mr. Agatep answered it would
be in the C.C.&R. 's of the project and the homeowners would
be the owners .
The Commission recognized Mr. Robert Sonneborn, 3985 Stella
Maris, Carlsba~, who spoke in favor of the subdivision,
listing the assets of the plan and expensive type of sub-
division; also he stated he was surprised at the recommen-
dation to deny the project.
Ms. Ione Elsner, 730 Las Palmas, Vista, addressed the
C011111ission as an interested citizen. She stated she had
no interest in the project per se, but wanted the right
kind of growth for Carlsbad. She felt this project would
be an asset to the City and would also want the golf course
built first.
The Commission next recognized Mr. Jim Hagaman, 5320 Sunny
Creek Road, CarJ.11bad, who spoke in opposition to the projec1 .
He stated it did not meet the intent of the R-E Zone and as
a property owner in that area, he fult the Commission and
the property owners should get together to see where they
are going with the entire area.
Mr. Russell Grosse, 5850 sunny Creek Road, carlsbad, was
the next speaker, and he stated he was in favor of the
concept, but felt it did not oonfor111 to the Rural Estate
lone. He alao stated you could build to the exact code
and ■till have it look like tract housing, and he felt
thi■ plan avoided that with the design they presented.
Thia would be a desirable place for executives to live
and Mr. Grosse suggested that with prices as they are on
real eat&te, perhaps Carlabad can no longer afford an R-E
zone. He at&ted he was ■peaking for his neighbor,
Mr, Gribble, who ha■ the same feelings.

Cotmnissioner Friestedt asked how many ,.ots would be lost
in order to comply with the subdivision minimum of one acre
for each lot, and Mr . Agatep answered that it would probably
cause them to lose one or two lots. This did not take into
consideration the slope requirement .
Since no one else wished to speak on this matter, the public
testimony was closed at 8:00 p.m.
Commissioner Marcus stated the project does not meet the
intent of the R-B Zone, and she could not support the
request in its present form.
Chairman Schlehuber asked what kind of road would be put
in and Mike Holzmiller replied there would be two new roads
put in eventually. He used the overhead projector to show
the location of the two roads that would be built. One road
would be built to acc011mOdate the initial units built and
when needed, the second road would be put in.
Cotmnissioner Rombotis inquired whether there were other
properties in the area that would annex to the R-B Zone, or
was this an R-B island. Mike Holzmiller used the wall maps
showing Zoning and Land Use to indicate there is property
to the North that is still in the County that might be
s·1itable for R-E, but there are no plans on this property
at this time.
Commissioner Rombotis stated it do~e not fit the R-E Zone aE
presented and felt the project could not be approved withoul
changing the zoning, or re-submitting the plan.
Commissioner Friestedt stated that i f the applicant were
to reduce the plan by two or three lots and make all lo ts
conform with the size requirement, and with innovative
design as presented, then it would be a viable project.
Coamissioner Farrow re-■tated his feelings that it is not
in harmony with the terrain and wildlife. He would like
a compromise, if possible, but would not want to amend the
R-B Zone.
Commissioner Jose agreed that the project does not meet
with the intent of the R-B Zone and could not be approved
on that basis .

project back to a workshop .snd letting staff and the
applicant work together to c0111e up with an acceptable plan.
Mr. Agatep re~ueated some time to confer with his client
and the Coamis■ion agreed to trail this item for that purpo•~-

Chairman Schlehuber opened the public hearing at 8:35 p.m.
and issued the invitation to speak.
Mr . Rob Wilkinson, 3331 Fosca Street, Carlsbad, addressed
the Comnission. He stated their property was on the 15th
hole of the La Costa golf course with an unobstructed view
across the golf course, using a transparency to show the
location of the property. He didn't feel a precedent would
be set by allowing this request and pointed out they had
volunteered to seek a variance.
Comnissioner Jose asked Mr. Wilkinson what would happen
to the lanJ underneath these decks, inasmuch as the deck•
would be eight feet above ground, and Mr. Wilkinson point ed
out the units would be semi-stacked with part of a patio
underneath the deck. He stated further the decks would
be concrete and there would be no drainage onto the patio
below.
Mr. Wilkinson asked the Comnission to consider giving them
something to work with, even if the Comnission found they
could not grant the request as presented.
Chairman Schlehuber read into the record a letter received

is now no above-grade deck on any rear property line betwee1

courae, and to construct such decks as requested would, in
our opinion, obstruct the present and future clear and
unobatructed view of the golf courae froa our property.

request and initiating a Zone Code Amendment and direct
staff to consider vhat kinds of encroachments should be
allowed along a permanent open space area such as this.
The following Resolution was adopted, without prejudice:
RESOLUTION NO, 2075, DENYING A VARIANCE TO ALLOW TWO
ABOVE-GRADE DECKS TO BE BUILT TO THE RF.AR PROPERTY
LINE OF A l'ROPl!RTY GENERALLY LOCATED AT 7506 JEREZ
COURT.
The C0111Dission directed staff to bring back a list of
appropriate intrusions, such as this circumstance, to
accoamodate a zone change where property abuts open space,
within six weeks.
The Coumiesion again took up Item 12 -CT 82-17/PUD -46-
HANDANA CORPORATION, for further discussion. The Comnission
discussed possible solutions with Mr. Don Agatep, repre-
senting the applicant.
A motion -wae 11Bde to continue to February 23, 1983. This
motion was then withdrawn.
A motion wae then made to deny CT 82-17/PUD-46, based on
the findings in Resolution No. 2071. This motion died for
lack of a second.
The Coumission voted to continue CT 82-17/PUD-46-HANDANA
CORPORATION -request for a 148-lot euhdivision located
approximately one mile east of El Camino Real at the eastert
~erminue of Sunny Creek Road in the R-E Zone, for two weeks.
RECESS:
Chairman Schlehuber called a recess at 8:58 p.m. and the
Coumission reconvened at 9:07 p.m. with all Comnission
Members present, except Coumiseioner Rawlins.
5. CT 82-25/V-344. UKl!GAWA -Request for an eight-lot
tentative tract map with a variance for setback
reductions on the south side of Palomar Airport
Road, east of Laurel Tr~e Lane in the PM-Q Zone.
Mike Holzmiller explained to the Comnission that there was
a reque1t for a continuation in this matter, and normally
that reque1t comes from the applicant and is automatically
granted. However, this request is from another individual
and he will have to present valid reasons to consider a
continuance. Also, the applicant should be allowed to
state whether that continuance would cause him any hardship.
He felt this continuance request should be heard before the
1taf~ pre1entation.
The eo-i1aion recognized the individual asking for the
continuance, Kr. Floyd Sellenger, 1303 Avocado, Newport
leach, who addre1aed the eo-is1ion, stating h.! was aaking
for a 60-day continuance. Thi1 continuance was requeated
to allow tiae for Kr. Sellenger to hire engineer, and atudy
what thi1 new uae of this land might do to the value of

Chainnan Schlehuber r•inded Mr. Sellenger that this
property has been industrial for quite some time and this
is not a request to change the zoning; that the Commission
is simply talking about a plan on an industrial site.
Commissioner Friestedt collll\ented that technically there
could be a number of two-story tilt-up concrete buildings,
or a variety of packing sheds. If Mr. Sellenger did not
want this zoning, he should have appeared before the
Commission at the time the zone change took place.
Chainnan Schlehuber stated the applicant has people present
for the public hearing anc he felt the hearing should
procee,1.
The Commission voted to proceed with the Public Hearing on
CT 82-25/V-344, UJCEGAWA.
Charles Grimm gave the presentation on this subject, using
wall maps, as contained in the staff report.
Chainnan Schlehuber asked if the piece of land left by the
road change would be anything but open space, and Charles
Grimm answered it would be large enough to be used as an
industrial parcel.
Commissioner Friestedt asked if the prope~ty owner next to
this property had been notified that possibly a road change
could be coming through his property and Charles Grirrrn said
his Agent was present tonight and they were aware of the
proposed changes.

and issued the invitation to speak.
Mr. Don Agatep, 2956 Roosevelt Street, Carlsbad, repre-
senting the applicant, addresaed the Commission. The
applicant is requesting a sub.livision of the thirteen acres
into eight lots, one to be open space and seven to be
buildable. They requested the Co11111ission to amend Conditio
12-A to allow left turn ~ccess to Palomar Road on a tempor-
ary basis, until a permanent alignment of Laurel Tree Lane
is established.
CoDlllissioner Farrow aaked Mr. Agatep to address the concern
of the neighbor who asked for a continuance in this matter.
Mr. Agatep stated this property owner was aware of their
progr-and had not attended any hearings other than the
Coastal Colaission, and they do not want to delay the
project st thia time.
Mr. Pete NaclCauf, 4218 Sltylin~ Drive, the General Manager o
the Ukegawa P'aru, addressed the Coaaission. Their plan
five year• ago was to improve the packing capability of
their tomato farm by building an-packing facility on
thia site. Thia waa the reaaon the propeity waa purchased.
However, business has been so poor the last four years, the

Nr. Bob Ladwig , Rick Engineering, representing the
Hunt ington Beach property, addressed the Coamisaion, adding
their support to this project.

Chainnan Schlehuber asked Mr. Ladwig why the road didn't
continue through the Huntington Beach property straight
across the street and Mr . Ladwig exp lained the road then
would not meet the City requi re111ent s of l, 200 feet between
intersections . This wi 11 be a major road with 102 feet of
right-o f-way and intersections every quarter of a mile .
Since no one else wished to speak on this matter, Chairman
Schlehuber closed the puhlic t estimony at 9:37 p.m.
Richard Allen, Principal Civil Engineer, reported the left
turns onto Paloaar Airport Road could be permitted as long
as it was a teaporary situation. If the time came when this
created a hazard, then left turns would not be allowed.

6. GPA-68(A), CITY OF CARLSBAD -Amendaents to the Land
Use Plan and minor amendments to the t ext of the Land
Use Element of the General Plan to bring them into
confonaance with the adopted Agua Hedionda Land Use
Plan.
Presentation was given by Charles Grimll essentially as in
the staff report.
Chairman Schlenubor opened the public hearing at 9:43 p.m.
and issued the invitation to speak.
Mr. Wayn C.llahan, representing Cal Connuni ties, who is
developing th• Kelly properties, 18002 Sky Park Circle,
addressed the c.c-iasion. He stated he would like to see
a decision delayed until~ future ti.me to see where the
CC..tal C~isaion is going.
Na. Ion• Elenor, 7 JO Laa Palau, Vista, was recognized by
th• C:C-iaaion, and stated s he was part owner of two parcels
of land on the Agua Hedionda Lagoon. She stated they had
:,pent so much tiae with the Coaatal C:C-iasion and it had
been accepted and it should be accepted now.

The Agua Hedi~nda Land Use Plan is a Council document. The
Council has approved it and the Coastal Comiission has
~ertified the Council action. It is a City of Carlsbad plan
We could amend the Cor.atal Plan at any time, if we followed
the procedures set by State law.
The Co11111isaion adopted the following Resolution:

Charles Gr i11111 gave the presentation using a map to st.ow the
property, as contained in the staff report.
Chairman Schlehuber opened the public hearing at 9:56 p.m.
and issued the invitation to speak.
Ms. Ethel Watham, 4360 Sunny Hill, Carlsbad, addressed the
Co11111ission, asking how this affected her property. It is
zoned R1M--will it stay that way or will it be changed?
Charles Griom answered her, assuring her the zoning would
stay RIM, zero to four, but, an applicant would not have
to go to the Coastal Colllllission and could just come to the
City of Carlsbad. To change the density, it'would have to
come to the City of Carlsbad and a General Plan Amendment
and zoning change would have to be made. All property
owners would be notified of that type of action.
Mr. Vick Arndt, 4625 Park Drive, Carlsbad, addressed the
Co11111iasion in favor of this parcel being specifically zoned
and controlled by t he City of Carlsbad as R1M density.
Ma. Jerry Alexander, (no address given) asked if one of the
pieces of property circled belonged to them; it looked as
though it did. It was her property and she was assured
it was designated as RMH and would not change.
Chairman Schlehuber informed the audience that this will
not change zones. The City of Carlsbad could issue permits
for deve lopmen instead of the applicants having to go
through the Cosstal Coimiission.
The Assistant City Attorney stated that at this time it is
a two-step procedure to develop property; the Coastal
Commission and the City of Carlsbad. The City of Carlsbad
vould like to issue permita for the entire area, but at this
time the only ones the City can i ssue are for the properties
outlined in blue on the map. The rest of the people will
still have to go through both the Coastal Co11111iaaion and
the City. The City is really trying to regain control of
the Lagoon.
Ma. Joyce J-e•, 3931 Garfield, addressed the Co11111iaaion
from the audience, asking about a piece of property which
wasn't outlined. Staff agreed that it should have been
included with the other properties outlined i n blue .

Since no one else wiahed to speak on the matter, the public
testimony was closed at 10:05 p.m.
The C:0-ission adopted the following Resolution:
RESOLUTION NO, 2076, RBCO!l'IKNDING APPROVAL OF A ZONE
CODE AM!NlllERT, AMENDING TITLE 21, OF THE CAlUSRAD
MUNICIPAL CODE, BY TIIE ADDITION OF CHAPTER 21.80
PROVIDING FOR REVIEW OF OOASTAL DEVELOPMENT PERMIT
APPLICATIONS CDNSISTENT WITH THE CERTIFIED AGUA
HEDIONM LAND USE PLAN OF THE CITY OF CAlUSRAD.
C:0-issioner R.ombotis returned to the Commission at 10:08 p. 11.
APPROVAL OF MINUTES:
The Minutes of the December 8, 1982, Meeting were approved
as presented.
The Minutes of the December 22, 1982, Meeting were approved
as corrected; adding to Coumissioner Jose's conment on
page 3, "due to the proximity of the two exits".
The Minutes of the January 12, 1983, Meeting were carried
over until the next meeting.
TRAVEL Rll}UEST:
Commissioner Marcus asked the Coumission's approval to
attend the Conference at Monterey, CA., March 2, 3 and 4,
1983. Chairman Schlehuber asked anyone wishing to attend
to please let Mike Holzmiller know as so, as possible.
