at 7:01 p.m.

Chairman Schlehuber announced the Planning Conmission
Procedure as printed en the reverse side of the Agenda
and gave a short s.mmary of the Procedure.

this ltem as oontained in the staff report.
Mt . Cllris Olristiansen, 2802 Carlsbad, addressed the
CClllll.isaioo representing the epplicant, stating they were
in agreeaent with the rondi t ions.
Collnissioner Rawlins ~eetioned the drainage rondition

The Conmissioo discussed the intent of the City with
regard to Washingtoo Street. 'Itle dust abatement
conditioo was agreed to, but the Conmissioners felt the
entire problem should be addressed. If the City ooesn't
want Washingtoo, then Chestnut should be made a a.il ~e-
sac. Chairman Schlehuber stated the project should rot
be held ~. but there should be an agreement with the
developer that he would pay his fair share of
inprovements.
The Assistant City 'Attorney stated oo this type of
developnent there would rot be an assessment district,
but a future inprovement agreement.
Conmissiooer Farrow stated the rondition should be
expanded to show the inprovement will be paid in lieu of
curbing, guttering and paving.
The 'Assistant City 'Attorney stated there would be an
agreement entered into before the issuing of the bJilding
permit.
The Planning Conmission c!Et>t'Oved the Negative
Declaration issued l:rj the Land Use Planning Manager and
adopted the following Resolution, adding a future street
inprovement agreement as a new rondition or an expansion
of Conditioos 17 and 24, Washington and/or Chestnut
as required l:rj the City Engineer.

presentatioo, intrcn.10ed Mr. ru Scarpelli, who was to
present an affordable housing project ooncept for the
Planning Conmissioo 's oonsideratioo. Mr. Grimn stated
staff felt this was a good oonoept for first-time
owners.
Mr. F,d Scarpelli, 929 Orchid Way, addressed the
Ccmnissioo, stating this housing plan had been used in
the San Diego area. In crder to apply this ooncept to
Carlsbad, the tandem parking reiuirements would have to
be relaxed and there would have to be legal changes to
allow f'Cr the waiver of the Subdivisioo Map Act. Mr.
Scarpelli was referring to the oowntown area for the
project, and cited an exanple as to t!1e price of the land
and ooet of oonstructioo, arriving at a selling price of
$70,700 per unit. This price was based oo the concept of
seven units oo an average-size lot, reducing the parkir 1
requirements and allowing tandem parking off of an alley.
Mr. Scarpelli asked for direction fra11 the Conmissioo as
tar as presenting this plan.

The Comnission questioned Mr. Scarpelli regarding this
housing concept, and he explained San Diego had waived
the map act, and allowed the odginal map to be used,
saving the oosts of new tentative and final maps.
The Assistant City Attorney stated their office would
have to review this concept before any decision oould be
made regarding any legal dlanges.
It was trought rut d.tring the discussion, that the costs
stated by Mr. Scarpelli seemed to be high. The
Comnissioners felt they should see a sketdl of the
proposed housing and have nore details. A majority of
the Comnission felt that tandem parking oould be allowed
in particular areas of the City.
Marty Orenyak, Director of Building and Planning,
coomented staff felt the ooncept of this plan had scrre
merit and should be studied further.
The Coomission agreed that d::>cuments from the San Diego
project should be presented to staff for review and a
definition of "affordable housing" shoold be established
for Carlsbad.

Chairman Sdllehuber announced an off-agenda item to be
considered by the Comnission regarding the recent
Ordinance ban.1ing RV parking in driveways that are in the
setback.
There was a lengthy discussion by the Coomission as to
the enforceability of the Ordinance and the fairness of
the Ordinance to peq:>le who cannot (:t\ysically conform to
the law.
Staff nert>ers felt the Ordinance had rot been in effect
long enough to give a fair clR)raisal.
A ll'Otion was made to continue this item for 60 days to
allow staff to tring back a report. The notion failed.
The Assistant City Attorney stated the Comnission oould
not lllllke a ~ndation on this item tonight, and
expla~.ned procedure for enforcing the Ordinance as it
exists.
The Planni~ Comnission ~ted to rea:mnend to the City
Council t.hey give the Planning c ·l1111ission directions to
conduct a piblic hearing for nodification of the Ordinance
to allow RV parking in the twenty -foot setback area
when it is oot pussible to p.it the RV anywhere else on-
site.
