Mr. Martinez stated that he has met with the Manager
of the Airport, RiCY-Severi;-,.;n, and Mr. Seversat had
agreed that if a stateaent ~;as m!lde regaroinq the

Mr. Martinez stated the a{Plicant would include a
staten!nt such as in the informatioo he gave to the
Ccanissioners txnight Sid apartment dwellers would be
given a siailar notifioatioo.
There were slides showing the characteristics of the
a re.:i and the ridge line. Mr. Martine1: discusseo the
cirrulatioo for the prql08ed project. He showed the
open space in the qiper area and stated the existing
land use 1$ mec:Um density Sid they are oot proposing
any change to that. Approxi.JMtely 30 percent of the
site IIOUld be the area they are talking atoot rec:iarding
higher density. 'Ibey believe this would be CD!patible
with the neighbors, particularly with the industrial
park.
Mr. Martinez asked fee rebuttal time and Chairman

Mr. Ride Severaa,, Palanar Airport Manager, addressed
the Ccnnisaion, stath g he had met with the a{Plicant
today and he is willil'¥J to put the property omers and
occupants al notice that they are in an .s-r.-ea of low--
flying aircraft. He stated this project is al the
border of the ail.-port referral area to the south, and
aMed the traffic al the runways will be increasing.

airport, including nelicxpers at 700 ft. above the
ground. 'ffle noise levels are estimated oo averages, and

Bill Hofman indicated that en this particular site given
its closeness to the airport it would have been better to
see a develqnent prq:x:,sal before amending the general
f>~an. 'ltlere was a discussioo about the fact that rental
units would be better than oonoominiums, with the tenants
being able to m:,ve nuch easier if they were tothered by
noise.
camdssia,er Raltx>tis suggested the applicant rould
incll.-de the cpen space and increase the density beyood
the existing range to medium high density (10-20
du's/acre). Also, a ronditia, rould be put en that the
open space rould not be calculated into the density.
Camdssiaier Farrow su+:.ed he had no oojection to the
prcp:>Elal, and apartments are needed, l:xlt was ~--emed
about the cpen space being used to increase the density.
Chairman Schlehuber stated the density problem as far as
the open space was concerned oould be handled by µitting
a o::indition in, and Camdssioner Farrow stated he would
support that rondition.
cannissia,er Marcus stated she was roncerned about a
higher density in an-area where roise was a problem, and
agreed with staff's reo::mnendatiai for a denial.
Camdssioner Farrow stated with the higher density they
would be eJIPOBing nDre pec.ple t.o the noise, and he
referred to the letter reamnending the density rot be
increased.

agree to rental units for ten years withoot oonverting
to cxnbnini1.111:1 and the ~licant stated he would be
willing to accept that ronditia,.

could not recall the City making this type of a

owners, 233 against this project, and two letters in

and eaae letters suggested alternative uses, such a

Mr. Bentham's ooncl.usiat was that he was not certain

He again stated their density was ooapatible with the
original 1188ter plan and asked for ~roval of the
applicant's requests.

asked whether IJnY of the 233 wished to change their
opiniat and there was no response.
Mr. Olarles Vitello, 819 caminito Del Mar, addressed the
camnissiat in appoeitiat to the proposed project,
stating the traffic inpact woold be tremendous as well
as the parking inpact. He asked that the entire
applicatiat be turned cbom.
Mr. ~rt Holmes, 810 Caminita Rosa, addressed the
cannissiat in appoeitia, to this project. He stated
this proposed project would encroach at the lifestyle of.
the residt!nts of. Alta Mira, by creating traffic problem;
and UMuthodzed use of. their O'.lltllDl areas, pdvate
areas and facilities. 'Ibis would then necessitate
policing. The Alta Mira residents were asked to staoo,
and again this was aln:>st the entire audience.
Mr. Oat caresio, 6719 Hyacinth, representing the
oamunity, addressed the cannissiat stating he felt that
a low intensity cr.mnercial area was needed there, with
small shq,s.
Mr. Ken Perkins, 6406 camino Del Parque, addressed the
Cannissiat stating he lived across the street fran the
prq,oeed project and did not d>ject to residential in
that area. Be felt the main issue was to be certain the
density and housing was similar to what exists row.
Again, the audience stood in 11g1.eenent with Mr. Perkins'
statement.
Mr. Henthorn stated the basic issue is ooe of design.
The applicant requested the Q overlay to insure the
project doesn't have a detrimental effect at the
surroonding l::llildings. An additiatal 15 ft. of l::llffering
between the P1:CJPeI ty line and the first area of the
project q:,en to existing prq>erty was added and there is
adequate green ~, parking and recreatiatal areas
provided. 'l1lere would be no spiJ.l~r into the Alta
Mira areas.
Since no me else wished to speak a, this item, the

There was a discussiat allOl'lg the Ccmnissimers regarding
the higher density, with a oonsensus of opiniat that

Chairman Schlehuber announced this item would be
presented in six different segments and he reminded
those in the audience wishing to speak oo a certain
section to please address the Camdssioo oo just that
particular section.
Bill Hofman gave the presentatioo oo this item basically
as oontained in the staff report, referring to a <rJP':r' of
a letter frail the Department of Fish and G.ne, which had
been distriruted to the Camdssioners prior to the
meeting. 'ft\is letter gave the position of the Fish and
Gae Depllrtant at each of the prc:f)08als.

Chairman Schlehuber asked staff whether the 100 ft.
setback was required, and Mr. Hofman stated fran the
existinq wetlands t::oundary area there is a 100 ft.
setback and staff has been holdinq to that setback en
other projects.
Chairman Schlehuber q>erled the p.iblic hearing at 9: 10
p.m. and issued the invitatioo to speak.
Mr. Gil Martinez, representing the applicant, addressed
the Camdssioo with a detailed presentatioo, including
slides and details regarding each of the six sectioos
under oonsideratioon.
Mi:. Frank Elfend, also representing the «SR>licant,
addressed the Camdssioo regarding the enhancement of
the six areas Wlder ronsideratioo.
Arca cne was described as the "fingers" area and the
applicant stated it was degraded with trash, off-road
vehicles and the fill fran a previous project. The
applicant plans blo and a half acres of fill in the
pocket areas in return for 17 acres of restored area, a
tidal channel and an island.
Area blo was described by the «SR>licant's representative
as being disturbed, with trash and dunping and off-road
vehicles. 'ltie enhancement for this locatioo is 11. 2
acres, with a rather substantial riparian area.
Area six, ptqX)6ed as a recreatiooal area, has been
affected by the road constructioo and pasture. It is an
isolated wetlaoos area and lacks tidal flow.
Mr. Martinez shcMed the existinq the ptqJOSed general
plans sld shcMed the areas of (t)en space and
developnent. Be stated the ronstructioo would stay at
the bo':tan of the slope and oot oostruct the view of the
hanes at the tcp. 1'le ct>jective of the project would be
to stay cmpatible with the neighbors and the existing
constructioo. 'fflere would be generous setbacks, tall
grassee, with nounde and rustic fences, with a country
feeling and cluster-type develqment.
The recreaticnal/ocm,ercial site was discussed as a
vital piece of property. 1'le road to be wilt would be
elevated with overviews to the greenbelt and lagoon.
The dewlqaent area would have a transitioo area. 'ltie
aligraent of Cannoo Road would be kept flexible until
there we a meter plan.
In cxinclusioo, it was stated the density is below what
is happening in that area and the percentages of open
space are high. 'fflere would be views created that are
not there ro,, and the M-ea will be enhanced.

Mn. SUNn Spreuer, 4906 Via Arequipa, spoke in
0Al()Sitioo to the project, inquiring about the width of
the road to ~ installed and the tidal channel area.
Mr. Martines stated a fence would be installed to keep

Mrs. Susan H. Andrews, 1825 Bienvenida Circle, spoke in
oppositioo to the developnent, rot ooly area ooe, but
also two and three. She stated it toc« seven years to

stated she wnted the wetlands left in a natural state
with a buffer lla'le, Mrs. Andrews cbjected to the higher

residences. She concluded, stating Parle Drive has been
designated as a soenic drive.

good trade-off. With the extensioo of the flood
channel, the silt would nDVe into the lagoon.

out in the Agua Hediooda Plan and defeated. 'Jllis is
getting into the riparian area and sensitive habitat
area and receives the same protection as the other
wetlands. He stated if Kelly Drive were kept cot of the
area of the wetlands, Fish and Game 1«lllld w!.thdraw its
objectioo. In the next area, if the road is put through
the wetland areas and the flood dlannel put through
there, again the silt will nDVe cbwn into the lagoon.
Mr. LalJA)e stated the issue of agriculture and the

strean beds should be •intained. Also, that area is
part of the natural flood plain, and Fish and Game

Mr. Charles Daugherty, 4860 Parle Drive, spolce in
opposition to the project, stating he lives across fran
area ooe. He~ area ooe being developed. Re
stated that <llring rain stotffl3, the water oomes in very
close to the road in that area and the land would have
to be raised quite a lot. He wants the prq,erty kept as
it is at the present time.
Mr. Pete Avila, 4926 Lana Laguna Drive, spolce in
opposition to the project, stating it would be difficult
to believe area ooe would be nore beautiful to look at
if it were rondaniniums and you had to strain to get a
view of the area. He also asked who would maintain the
channel.
Mr. Elfin answered the maintenance in that area is
sanething the applicant looked at closely. '111ere would
be a ncnitoring period and design restrictions would be
looked at to reduce the naintenance. Eventually, the
arel! ~ld q>erate within its own processes. He stated
the applicant is still working with Fish and Game and
the Coastal Camdssion.
Mr. Avila asked the denial of the entire project and
stated he would like the area left in single family
residences and mne the area cpen space, so this type of
project can't be ruilt.

RM-H.
Mr. Richard Andrews, 1825 Bienvenida Circle, Dkessed
the Camdssion in qiposition to this project,
reoannending that the 100 ft. undisturbed buffer around
the wetlands be dlered to, and not the 50 ft. the
applicant mentioned.
Mr. Lauppe stated the 100 ft. is required.
Mr. Andrews stated he thought cpen space was appropriate
in that area.
Mr. Joe Tosto, 4904 Via Arequipa, spoke in ~ition to
this project, asking how fa back fran Parle Drive the
oondcminiimE would be. 'l11e applicant stated there is no
site plan as yet, but they plan to renove the hill and
have a 25 ft. setback with bernE and landscaping,
parking area with carpa:-ts, all lower than the road so

basically they would face the lagoon. Mr. 'lusto

elevation aloog Parlt Drive just after the nound along
the sweeping curve. Staff answered about 15 to 27 feet,
and Mr. Christian stated that at high tide oothing oould
be hidden along there, due to the height of the water.
Mr. Christian asked whether there IIDlld be problens with
the cranes and other birds ence the hill was ren-oved.
Mr. LatJR)e stated the ooise IIDlld cx,me farther inland,
but there should be no i.npact en the birds thenselves.

aoo staff stated it was. Mr. Pereira asked how high-
density housing would be axipatible with single family
halles to the left and right of this area. He stated
this was a sensitive area and they 11D.1ld be preventing a
view of the lagoon. In caiclusion, he asked for
disapproval of the project.

change fran the existing zero to four uni ts per acre en
the hemes there to the ten to twenty being asked by the
aR)licant IIDlld be an increase in density.

wildlife wuld rot be preserved in this area with the

A question was asked about the drainage channel to be
installed, stating how a,uld the wetlands be preserved
if the water were channeled out of that area. It was
detel'llined this was area four, and the llR)licant 's
tepreeentative showed an aerial view of this area with
the creek and riparian area. It was stated the l:ridge
would re-channel the water and it IIO.lld be a natural
syat.a. Mr. Lauppe disagreed, stating if the water
fanned out in that area, it wuld drq> silt 900ner. By
putting the channel and the l:ridge, this 11D.1ld cause
eroeicn and the atrea will wander. This is the 100-
year flood plain in this area and again the flood flow
would eend the silt <Dffl into the laqoon.

Mr. Marlt Masoo, 4930 Lana Laguna Drive, space in
oppositiat to the project, stating the RM-H area was
behind his hane and there was rot enough roan to have
ten to twenty units to the acre, as far as parking,
recreatiooal facilities, etc. He in:mired how far they
were going into the wetlands a, area three, as there is
a dirt road there and rot nuch roan to b.Jild. He was
concerned about the drainage, parking and rot going into
the wetlands.
Mr. Masoo inquired how far fran the road the l!A)licant
intended to ruild and Mr. Martinez shCMed a slide with
the road in questiat and stated the road would follow
generally the area of the dirt road which is there. He
indicated there would oot be too nuch gradil'lCl, Mr.
Masoo stated the water goes up to the road at times and
there is rot nuch land there for ruilding. He guessed
there would be l!A)roximately 150 feet. Staff
referred to a rmp and stated it was 170 feet.
Mr. Pete Avila, 4926 Lana Laguna Drive, addressed the
Cannissiat again, stating the Kelly R::>ad re-alignment
would go into the wetlands.
Bill Hofman stated that along areas three and four the
road would go into the wetlands.
Mrs. Ruth McKay, 4994 Via Anorta, cddressed the
Cannissim, askinq whether Kelly would be extended along
the bade of Via Anorta, as there are hiqh banks there.
If they allow for housing there, she asked what would
hl!A)en to the banks at the bade of the prq:,erty. Staff
stated it dflpended a, the setbade. 'nle road encroaches
into the wetlands area and there would be grading of the
hillside at the narrow portioo. 'nley are prq,oeinq to
extend out into the wetlands to increase the area, but
leave the zoning at ten to twenty uni ts.
Mr. Avila QUeStiooed whether there is enough space
between the water and the bottan of the bank. He asked
the height of the dwellings and Chairman Schlehuber
answered there is a l'l'l!lXinum of 35 ft. in the City.
In answer to a questioo as to whether Kelly extensioo
had been reoognized by the City and staff replied at the

Mrs. Patricia Arrague, 4914 Lana Laguna, spoke in
ORX)Sition to the project, stating the peq,le enjoy the
wildlife and have rights to be oonsidered. She stated
there was oo trash and the area was oot deteriorating.
She asked the c.annission to vote in opposition to this.
Mrs. carolyn Robinson, 4864 Park Drive, spoke in
awosition to all six areas, asking how many families
would be nDVing into the area. Mr. Martinez stated it
would be cmpleted in p'lases and would oot happen
overnight. Staff stated the a{t)licant had requested
1,600 dwelling units and it could be as many as 2,800.
Mrs. ltlbinson asked how many children that would involve
as the schools are crowded rnw and the recreational
areas OYercrowded, and where would they pit the
children.
Mr. Michael Smith answered that would be awroximately
1,700 students.
Mrs. ltlbinson stated it was seven or: eight years before
the school was ruilt, and where would all those
additiooal children go to school, and would the
applicant build the school and recreational facilities.
Mr. Allan Kelly, P. o. Box 1065, the owner of the laoo,
addressed the c.annission in favor of the project. He
stated it was diffirult to speak as he was bitter. He
has paid taxes for years oo this land and can oo longer
make any mney oo agrirulture. He stated he has to sell
the land to pay the taxes and felt that OYer the years
lands have been taken fran him without due process.
Mr. 'ltl6to addressed the c.annission again, stating that he
respected Mr. Kelly's situation, rut with this
devel~nt another ten acres of land would be lost to
developnent.
Mr. Martinez stated in rebuttal: 'lttey are oot asking to
change the general plan rut are asking for area ooe to
expand the RM-fh area bolo, chanqe 00 to RM-H: area three,
no dlange, area four, increase RirM to RM-H: area five,
Rirlt and RL to RM1 area six, l"4 to 00 and 00 to RC. At
this point, it was ascertained that the applicant was

Mr. Blfend aunaarized the biological issues by stating
the wetlands have been filled in and they are proposing
to create and enhance the habitat.

Attorney stated it oould be, but the existing plan took
seven years of negotiations and it would have to be
done by mnendment to the Agua Hedionda Coastal Plan-and
