14, 1983, with revisioos to the text and exhibits of
the proposed master plan, stating the applicant and
staff were in agceenent with the wording changes.

p.m. and issued the invitation to speak.
Mr. Scott 'l\Jrpin, Calavera Hills carpany, 110 West C
Street, San Diego, addressed the camtlssion oo behalf
of the afl)licant, giving a history of the project. Mr.
'l\Jrpin used a CDlpOSite transparency to show the
tentative llllllB and a "111111 mp showing master plan
ainenclllent f150P. He stated that oo all tentative nape
sutnitted, Calavera Hills has been below the allowed
density.
Mr. 'l\Jrpin stated the real issue is the master plan
calls for 1.5 dwellir¥;t W'lits per acre in this area and
the general plan calls for zero to foor dwelli ng units
in that area. 'Die mater plan calls for clustering and
Calavera Hille Cmpany feels they have d:>ne that. He
stated the issue was whether a specific design criteria
was to be p.it CJ'I me specific spot, or "10Uld the master

Mr. 'l\Jrpin ooncluded, stating if it ~s to an issue
of design, then the merits of the tentative ffBP should
be disrussed, as he feels it is rot applicable.
The Camrlssioners and Mr. 'l\Jrpin discusi:;ed the lot
sizes of Village X, with Mr. 'l\Jrpin stating they were
approximately 6,000 square feet up to 29,500 square
feet, with cpen space to oontrol the oonstruction of
back lot b.lildings by the residents in crder to oontrol
the envircnnent. Also discussed was the r&mt,er of
units, with staff stating under the old master plan it
would have been i.npoesible to get the same runt>er of
units as it did rot provide for clustering.
Since oo one else wished to speak rn this item, the
public testi.trony was closed at 7:33 p.m.
Ccmnissioner Marrus stated this project was big and
unwieldly and she agreed with staff's reconrnendation
to require a mininun 15,000 square foot lot size for
the reaBalS stated in tile report.
Ccmnissioner Lyttleton stated the applicant's request
did rot seem unreasonable to her.
Comnissioner Ra!t>otis asked whether lots of 5,000
square feet would increase oc decrease the grading and
Bill Hofman stated that it would rot necessarily affect
the grading, but IO.lld EX)SSibly mean fewer units.
Mike Holzmiller, Land Use Planning Manager, stated ~e
exhibit the Camrlssioners were viewing indicated the
density was figured using the area in the cpen space,
and he wanted to be certain the Ccmnissioners
understood this.
caimissioner Ra!t>otis asked what the density would be
uain.J the center of the SOO&E easement, and staff
answered ~imately three units per acre. This cpen
space area is ~imately 15 acres.
Mr. 'l\Jrpin stated the criginal master plan allowed
substandard streets, and the PD program allowed smaller
streets and pdvate streets. He stated the issue was
whether they IIWld develop to the master plan, which
allows cluaterin.J and ct:>es rot exceed density
requinaents, or c:b they go to specific design. If
they go to specific design, perhaps the PD requirement
should be t1!11DY'ed.

applicant stated there would rot be any dlange in the

'nle camnissioners discussed the ~are fcx,tage, parkil'IQ
and traffic proble111:1, and the applicant stated two of
the seven oondalliniuns sold involved large oonference
r<XIM, IMk:ing the density relatively low. Re added he
needed this flexibility to see the remaining units.
After sane discussion, the applicant stated the least
nuimer of units he needed would be sixteen.
A motion was rrade to adopt Resolution No. 2226, changing
the rumer of uni ts to sixteer>
Comnissioner Farrow stated he would vote aqainst this
moti on, as the applicant is only asking for flexibility
in selling the units.
Comnissioners Rawlins and Lyttleton ooncurred with
Comnissioner Farrow.
Motion failed rue to lack of a majority.

Dan Hentschke, Assistant City Attorney, stated Condition
120 relates to the low oc nooerate incane units, and
this is 25 percent of the total nuntier of uni ts: t o be
reserved for individuals within the range set i:,,, State
law. However, they are definitely rot low-cost units.
He stated an Ordinance is being prepared for Council
that wUl inplement the provisions of the State law.
The agreement and criteria will be approved i:,,, Council
prior to this project ~ing through.
In answer to ~ry, the City Attorney stated staff had
determined the !R)r(]priate density for this project to
be eighteen units, and pursuant to State law, 25 percent
is added to that. He added the Comnission rould
determine the tq> density to be at another level.

p.m. and issued the invitation to speak.

Mar006, addressed the Comnission statinq he roncurred
with staff's report.

Mr. c. R. Brown, 2070 Avenue of the Trees, addressed the
Cannission, stating he did rot understand the map shown
on the transparency. The rot ice 11o-as checked as to what
side of Roep Way was shown, and the Assistant City
Attorney stated that he felt the map was clear enough to
be a legal OOClllll!nt, i.nasnuch as the reference roads were
shown. He aMed this would ~ to Council, and the
