In accordance with Section 18 of the Street Design Criteria of the City Standards, the Planning Commission shall have the authority as an administrative act to grant variances to the City Standards provided the following findings can be met: 1. That there are extraordinary or unusual circumstances or conditions applicable to the s·tuat:on of surrounding property necessitating a variance of the Standards. 2. That the granting of such variance will not cause substantial drainage problems. 3. That the granting of such variance wtll not conflict with existing or future traffic and parking demands or pedestrian or bicycle use. 4. That the granting of such variance will not be detrimental to the public welfare or injurious to the property or improve■ents in the vicinity in which the variance is granted. 5. That the granting of such variance will not adverse l y affect the comprehensive general plan. City staff has reviewed the variance requests a"d is making the recommendations that follow in this memorandum. In some instances, staff has reco ■■ended denial of the Developer's variance request and made an alternative recommendation, which 1n our estimation w111 fu11f111 the intent of the in1t1al request without sacrificing safety or env1ron ■enta1 concerns. The variance requests and staff response and reco■eendations are as follows: 1 . Location: Request: Reason: Staff Cannon Road, west of El Camino Real Eliminate sidewalk on northside of Cannon Road and reduce parkway width from 10 feet to 3 feet. Explanation: Location: Request: Reason: Staff Recommendation; Explanation: Alternative: Whereas Findings 1 and 2 can be met in that protecting wetlands' are~ is an unusual circumstance and no drainage prob l ems will result, the City Engineer can not find that the granting of this variance will not conflict with future pedestrian demands. The Developer is proposing the place ent of a recreational facility on the northside of Cannon Road, which will encourage pedestrian use on this side of the road. Reduction of pedestrian access i~to the wetlands from the roadway could be accomplished with appropriate landscape buffers. Proposed Kelly Drive from Park Drive to Via Hinton.
