1. SNt>AC REPORT -AIRPORT
The Planning C~ission was provided with copies or a
dOCUtaent entitled, "Draft C0111prehensive Land Use Plan,
McClellan-Paloaar Airport, San Diego, California".
Charles Cr!-, Assistant Planning Director, announced that
raeabers or the SMl>AC starr were in the audience and would
be taaking a presentation on the Land Use Plan.
Jack Koerper, San Diego Association or Covern111ents
(SAl«>AC), highlighted the contents or the Draft
C011Prehenslve Land Use Plan. He pointed out that the
SAtl>AC Board or Directors, c:ctlng as the Airport Land Use
C011aission, will be reviewing and approving the
distribution or this Plan. The Plan will be sent out for
a two-110nth review period, at which tinie SANOAC will be
asking the City or Carlsbad and the County or San Diego to
review the plan and adopt it. He stated that this
presentation tonight was to 9lve the Cowalsslon an idea or
what the Plan contains and thereby expedite the review
process. He offered to C0111e back during the review period
to answer further questions that the C~isslon 111c1y have
regarding the contents or the Plan, once the City starr
has C0111Pleted an analysis or the Plan.
Mr. Koerper continued hJ _hllghtlng the provisions or the
Plan, which ls an update or the 1974 Plan adopted by the
Airport Land Use C~ssion. He stated that it was based
on the new operations for the McClellan-Pal011c1r Airport.
The noise contours that were prepared for the Plan are at
the }26,000 operation level. This ls the capacity of the
airport in tenas or the runway capacity; it does not
indicate the capacity of the airport In tenns or parking
space and on-the-ground facilities that are required to
support the }26,000 operations. This ls the worst case
noise contour for the airport. or the }26,000 operations,
it ls anticipated that 51 will be jet actlvlty, and 51
will be helicopter activity. The noise contours were
provid d by the County of San Diego. He pointed out and
described the different noise contours displayed on a wall
tUp.
Mr. Koerper described the "flight Activity Zone and Clear
Zon • ache11es proposed for the airport. He pointed out
that this is a variation or the "Accidental Potential
Zones" included in the existing Plan. The intent ls to
recognize that froa t111e to t111e there will be severe
craahea/accidenta or airplane parts falling orr, and this
should t.lken into account by the City or Carlsbad when
it looks at developaent proposals around the airport. The
only ohaf1941 in the "flight Activity Zone" froa the
exlatint Plan••• to .,ve this zone 700 feet to the south,
reaulti"9 froa the fact that there will not a second
runway oonatructed at the airport.

11th the aid of a wall map, Mr. Koeper pointed out the new
airport influence area for the airport. This takes into
account the new noise contours and the flight activity
zones. He stated that the only chanqe within the area has
been to extend it to the West to acconnodate the 60 CNEL
(C«-.inlty Noise Equivalent Level). He added that when
this presentation was made to the Palomar Airport Advisory
C01M1ittee, a suggestion was made on the possibility of
extending this area to the Southeast. SANOAG staff will
be evaluating that suggestion.
Mr. Koerper advised that they have not found any
nonconforming uses within the airport influence area to
date. There ls only one Sllldll zoning designation on El
Ca111lno Real which 11\a)' have to be changed at the
appropriate ti111e. He further added that it would be an
advantage to the airport to adhere to the height limits
set up by FM ln the flight activity zones.
Mr. Koerper concluded by listing the five reco11111endatlons
in the Plan which should be reviewed by the Planning
Coi.lsslon: ( 1) Incompatible uses within the airport area
should be prohibited; (2) The City should adopt the Plan
and app l y It to the pertinent proposals for the General
Plan; (J) The City should adopt an ordinance requiring
that the existing noise insulation standards which applies
to 111Ulti-fa111ily residences also apply to single-family
detached residences; (4) Direct the appropriate County
depart111ent (the airport operator) to record the location
of aircraft accidents within five miles of the airport
property boundaries. At the present time, there ls not a
good accident history report for Palomar Airport. With
the County department recording the location of airport
accidents, this will help substantiate the need for the
flight activity zones; and (5) The Land Use Plan should be
reviewed every five years.
Chair111an Schlehuber Inquired regarding a particular
project off of Pal0111ar Airport Road and how It will be
affected. Mr. Grl-stated that the Carlsbad Land
Investor Project ls partly in the 60 CNEL zone and partly
ln the 65 CHEL zone. Hr. Koerper pointed out that the
lines which are shown on the wall map are for the purpose
of penaitting a developer to develop the property on one
side of the line with one type of use and the property on
the other side of the line with another type of use.
At the request of Chainaan Schlehuber, Mr. Koerper stated
that he would 11ake arranget11ents with staff to give a
deaonstration on sound -a presentation he had previously
done for another group. Hr. Koerper further responded to
a question by C~lssioner Hall stating that the flight
activity lines drawn on the map follow the C0111110n flight
tracks for the airport ln terlll!I of width. These lines
were defined by the 1974 Plan, and there has been no
deviation froa that.

NEW PUBl.IC HEARINGS
3. PCD-90/CUP-293 -JIM FINNEY PONTIAC -Request of a
Planning co-Isslon determination for the
construction and operation of an automobile
dealership and a Conditional Use Pen11it for two
freestanding signs on the same lot at 5445 Paseo Del
Norte in Carlsbad Car Country.
Gary Wayne, Senior Planner, gave the presentation on this
ltee as contained in the staff report, with the aid of a
transparency showing the location of the site. He gave
the background of the proposed project, and stated that
the project 111eets all of the criteria of the specific plan
for Car Country as amended, with respect to architecture,
landscaping and signage. In addition, the project meets
all of the City standards as well as the revised parking
standards. The project ls consistent with the local
coastal progrc1111. Starr ls reco11111endlng approval.
Chalnaan Schlehuber declared the public hearing opened at
6:40 p.ffl. and issued the invitation to speak.
Hr. Creg Rule, 9605 Scranton Road, Suite 202, San Diego,
representing Ji• Finney, addressed the Coaaission and
urged the Ca.alssion to approve this project.
There being no other person in the audience desiring to
address the Ca.aission, Chair11an Schlehuber declared the
public hearing closed at 6:40 p.M.
Ca.alssioner Marcus noted that the second story of the
proposed building will have a sign on it, and stated that
she thought that signs were generally not allowed, if
visible froa the freeway.
Charles Cri-, .\sslstant Planning Director, stated that
Cotalssloner Marcus was correct. In the past, however,
there has been quite a bit or flexlblllty used ln the car
dealership area. Traditionally, they are not of a
freeway-oriented use, but they ~re prl111c1rlly located ~long
the freeways, and there has been soae flexibility in the
past about all011lng those signs to occur.
Mr. Crl-at.ated that generally a condition ls placed on a
site developaent plan that a C0111prehenslve sign plan has
to be approved by the Planning Director. Coaalssioner
Mcfadden added that there are a nutllber or signs racing the
fr ay, .,.d lt would seea rather inconsistent to not go
along with lt now.

C~issioner McFadden inquired regarding the oil trap.
She stated that she saw none existing. Since they are
putting in no service bays and will be using the existing
ones, she requested assurance that that would be taken
care of for the entire site. Mr. Wayne stated that the
Engineering Department has anticipated this proble~, and
Condition No. 28 would require the developer to provide
grease and oil traps for all surface drainage. The words
"frOIII the entire site" can be added to the condition.
In response to further ~uestions, Mr. Wickham stated that
this particular project ls within 500 feet of a park and
would not require a recreation facility. Further, the new
parking requirements have been met for the entire site and
exceeded by one extra space.
A discussion ensued on the wordlnq of Condition No. 28 to
Resolution No. 2566 to require a grease trap for all the
surface drainage frOIII the entire site. Mr. Wayne
answered various questions to clarify how this is done.
The Planning Connission approved the Negative Declaration
and adopted the following Resolutions approving PCD-9O/
CUP-293 based on the findings and subject to the conditions
contained therein, to include the additional wording to
Condition No. 28 to Resolution No. 2566:

Charles Cri•, Assistant Planning Director, gave the
lnltlal background of this itet11 wlth the aid of a
tranaparency aap. He pointed out that the City Council
and the Planning C~lsslon have approved the tentative
Map and planned unit developaent of the first phase of the
Master Plan. The itetllS before the C~ission are Phases
II and III or the Master Plan.
Mr. Crl• pointed out on a wall 111ap the specific
deaignatlona of the General Plan for the site. He
reviewed how the project related to the growth aanaget1ent
progr•. He stated that Phase I, which was approved late

Chris De Cerbo, Assistant Planner, gave the presentation
on this item as contained in the staff report.
Phase II
Hr. De Cerbo, with the aid of a wall map, gave a brief
overview of each of the six planning ar.eas for Phase II.
He listed the proposed developments that will be
constructed in these areas, and concluded by stating that
Phase II c0111plles with all t.he specific guidelines and
develop11ent standards of the Batlqultos Lagoon Educational
Park Master Plan. The only exception ls a school
audltorlUIII building. The structure ls proposed to Include
a 55-foot high fly loft for purposes of creating a
proscenlu• stage. The Master Plan restricts all structure
heights to a 111axi111Um of 35 feet within that plannlna area.
An amend111ent will be required to be submitted for this
height variance request. Staff has Included a condition
to specify that this portion of the structure ls not
approved at this tl111e, and a forthcoming Master Plan
a111endillent will have to be processed. The Phase as
proposed ls at Its taaxlmum structural footage in
residential den,ity allowed by the Master Plan. However,
staff feels that the project with its quality of
architecture, and recreational open space amenities
Justifies this Intensity.
Phase Ill
Hr. De Cerbo stated that Phase III ls COAll)osed of five
planning areas. He gave an overview and breakdown of each
of these planning arP.as as contained in the staff report.
Phase III also COIIIJ)lles with all the specific guidelines
and develoJ)IIICnt standards of the Batiqultos Lagoon
Educational Park Master Plan. The only exception ls the
hotel/conference cent~r where an atrium ls proposed at a
height of 55 feet. Structural heights are restricted to
35 feet (aad1MJ111i by the Master Plan, and a Master Plan
a111endlllent will ultiaately be required. Staff has Included
the condition that the height ls not approved with this
application. This phase ls at Its 111axl~m square footage,
and staff ls rec~nding approval based upon the
enhanceaents provided, the architecture, open space
aaenlties, etc.
In response to questions fr0111 Coanlssioners Schlehuber and
Mcfadden, Mr. De Cerbo stated that the fi:st phase ,._.st
precede the retaaining phases. Further, '.:here is a
condition stating that the additional uses within Planning
Area "A" of Phase II cannot go prior to the law school and
educational uses being constructed In the same area. He
confinaed that the 7l0 parking spaces of Phase I will be
supplied ln Phase 11, and pointed to a deck parking lot
included ln Phase II on the 111ap. The applicant will
further address the parking Issue.
At the ~uest of Coaaissloner Harcus, Clyde Wlckha•,
Associate Civil Engineer, pointed out the traffic
circulation of the entire site, and where traffic signals
will be Installed if warranted.

Jon Briggs, representing Sammis Properties, 2650 Camino
Del Rio Horth, San Diego, gave the background of Phase I
which was unanl1110usly approved by the Planning Commlsslon,
the City Council, and the Coastal Commission. Further, an
award of 111erlt was presented to them by the Pacific Coast
Builders Co~ference on this project.
In response to Co-lssloner McFadden's inquiry regarding
the ~a rklng, Hr. Briggs pointed out the area in Phase II
that includes the parking required for Phase I. He stated
that the parking was a great concern to them and related
the efforts 111ade to make sure there would be adequate
parking. He described a safety valve built into this
project. Two buildings will not be built in the second
phase until there ls a parking study COIIIJ>leted to the
satisfaction of the Planning Director that indicates that
the parking ls adequate. The two buildings are to be
selected by the Planning Director. Hr. De Cerbo pointed
out this ls addressed by Condition Ho. 25 of Resolution
Ho. 2556.
Slides were shown of the site consisting of an aerie!
view, the site plan, a list of the proposed develo,-nts,
etc. Hr. Brlqgs pointed out that Hr. Harty Bouman
reviewed various traffic studies which indicates that
Poinsettia Street will continue to operate at an A-level
of service. (This street will be impacted by Phase I).
Further, they have agreed to do some liaprovements of the
intersection of I-5 and La Costa Avenue through
chanellzatlon and signalization. (Phases II and III will
l111pact la Costa Avenue and Carlsbad Boulevard). However,
the study indicates that the project will not cause these
intersections to fall below an acceptable level of
service.
Hr. Briggs continued his presentation, pointing out that
it ls a Mixed-use project which will be significant ln the
traffic circulation area as large numbers of students and
staff will live onslte. Blow ups of the projects were
shown depleting various features of the buildings on the
project. He stated that they hope, if the lagoon
restoration process goes ahead, to 111ake the water feature
salt water with water pu111ped froa the lagoon. A
photograph of a aodel built to scale of t he project was
also shown.
Hr. Briggs concluded by stating their agree1111ent with the
conditions recoaended by staff. They also request an
additional standards variance for the enriched paving on
llndrose Circle. The enriched paving will help identify
entries to 111ajor area, and slow down traffic .
In response to various questions by C~issloner Mcfadden,
M'r. Briggs listed the schools and the institutions which
will occupy Planning Area "A". He stated that he did not
envision any aanufacturlng on the site at all. He stated
th•t they see theaselves as eo11ing into the lnforinatlon
•ge, Md these are people that are going to be working
prlaarily with their lllinds.

Regarding the bicycle parking spaces, Hr. Briggs stated
that an exhlblt was prepared ln answer to thls question
whlch wlll be reviewed ln detail wlth staff. There are
provlslons for bicycle parking throughout the slte, and
pointed out the various locations on the public access
plan showing the blke and pedestrian paths. He stated
that there are storage c.1blnets or garages provided ln the
residences whlch would accoaaodate thelr bicycles.
In further response to questions, Hr. Briggs stated that
all of the three phases wlll not be built out. At this
tiae, they are proceeding wlth an assessnient district,
whlch has been approved by the City Council. They hope to
sell bonds ln August which will put in all of the infra-
structure. Construction of the Phase I lnfrastrJcture
will coa11ence upon recordatlon of the first phase final
•ap. They will then proceed l11111edlately wlth the law
school building, an office bulldlng which will house
prlaarlly the architectural school, and the residential
housing. The processing for Phases II and III will
probably begin ln Septetllber or October upon receipt of the
bulldlng pen11lts, at whlch ti111e the development of the
student housing in Phase II, and the conwerclal village ln
Phase III will begln. He stated that they expect the
bulldout to occur ln a three to five year period.
C~lssloner Holnies inquired regarding the auditorium
building and how lt wlll be used. Hr. Briggs stated that
the fly loft would be SS feet high designed to acc°"90date
lectures, concerts, recitals, and dra111atic perfonnances.
The opening of the stage is approxi.ately 20 feet. The
height for scenery ls an additional 28 feet plus 7 more
feet for the structural support.
C~issloner Schra• pointed to the setbacks fr011 the
slngle-f•lly ho.es on top of the bluffs, and inquired
what would be done to keep people fr011 going within the
setback area -fr011 the end of the property line to the
end of the bluff itself. Hr. Briggs stated that the
landscapi ng would take c.1re of that -thorny bushes, etc.
C~ssioner Mcfadden inquired whether in the
nelghborhood-c«-erclal area the ~rcial and
residential units were lnten11lxed on the s.-e floor. Hr.
De Cerbo stat ed t hat there ls a half-story difference
between the nearest c«-ercial floor fr011 the upper story
residential. Hr. Br iggs stated that there w111 be no
direct access fr011 t he residential apart111ent units to the
c«-rclal units . They will not share the sa111e floor.
Hr. Crl-added that t his aatter l s specifically addressed
in the new conditions staff is rec011111ending.
Dale Schreiber, 1-S7 Crest Drlve , Enclnltas, addressed the
C~aalon and read a letter into the record (a copy was
subaltted) inquiring about t he Ci ty property which will be
leased to 5-ls Properties and expressing his opposltlon
to the leasing of this property and suggesting that the
City oonaider hiring a property unager t o adlllinlster all
ot the City-owned properties.
Hr. Cri-explained that the posslblllty of a land swap
with the City tor an area along Carlsbad Boulevard ls
being consider, however, this ls not a flnallzed action.

Mr. Briggs reappeared and emphasized that they do have
strong support of the nelgh~oring residents to the North,
Lakeshore Gardens, and also Batlqultos Lagoon Foundation
supports the project.

C011111lssloner Schra111111 inquired regarding the Windrose
Circle -lt has the width to allow parking along one side.
She stated that she underst ood that no parking was allowed
there. Mr . Wickhclffl stated that the width does allow the
parking, but that it ls pretty much for handicapped
Individuals.
Commissioner McBane Inquired regarding the street
standards for Carlsbad Boulevard, and whether the
standards allow for meandering sidewalks. Mr. Wickham
stated that typically meandering sidewalks have been
encouraged; In this case, he would see no reason for not
al lowing it.
Commissioner McFadden Inquired regarding the underground
parking and the number of cars In one place with only one
exit and entry s ide by side. Mr. De Cerbo stated that he
checked wlth the Building Department and was assured that
the Uniform Building Code requires that stairwell access
be provided with underground parking for rrultl-famlly
residential as we ll as co11111ercial and Industrial areas.
Commissioner McFadden inquired what the water source would
be f or the wat er feature and who will be paylng tu pump lt
to all the places. Mr . Grimm stated that It ls Included
In one of the new conditions; tt places the responsiblllty
on the Homeowners Assoclatlon .
Co-hsioner Mcfadden inquired regardl11y Condition No.
31, page 8, the Local Coastal Plan Compliance. Mr. Grimm
stated that in one of the new conditions, there ls a
proposal to eliminate t he words "Permit No . 6-AS-482" from
Condition Nos. 30 and 31 and thereby only require
C0111Pllance with the Local Coastal Program.
C011111hsi oner Marcus Inquired regarding the City ar.reage.
Mr. Wlckhdlll estimated It to be around )1 acres; however,
the actual land swap concept has not come before a public
hearing yet. Mr . Wickham stated that he believed It to be
a purchase. Unit No . l of tht project has a cufl(1ltlon
that tr the ldnd swdp concept ls not dpproved, then Unit
Ho. ) ls null dnd void.

Commissioner Holmes expressed his concern with the
recreation area wlthln 30 feet of mobile homes, especially
with the noise problem. Chairman Schlehuber questioned
the possibility of that concern being addressed by sound
barriers or walls. Mr. Gri"'" stated that staff has
prepared wording for a possible condition on this to
require the applicant to put in a six-foot acoustical wall
on the north side of the recreation area and further to
11.mlt the hours of operation. In addition, the Master
Plan requires a forest through that area ln terms of
landscaping. One other factor taken into consideration ls
the fact that there ls a six-foot hlqh wall that separates
the mobile home oroperty from the Sammis prorerty which
~Ill help to reduce noise.
In response to a concern raised by Commissioner Mcfadden
regarding the construction of improvements as It relates
to the build-out in the different phases, Hr. Wickham
stated that the Improvements would be required to be
designed and bonded before the final maps can be approved
for either phases. Once those bonds are submitted, they
will have a 12-month expiration date on them. They can
start construction of everything while the bonds are in

Chairman Schlehuber expressed his concern that as the
project ls being built, that it ends up being solely a
housing project. Mr. Grimm stated that staff took this
Into consideration. Essentially, the worst that the City
can end up with ls a hous ing project. In this event,
there ls the possibility of a rP-sidentlal project with an
office develop111ent in the center. The impacts uf that
would be relatively light because it would probabl)
actually reduce the overall traffic.
The Plarning Co11111lsslon adopted the following resolutions
recoa1endlng approval of CT 85-37/PUD-95/SOP 85-15/CT 85-
38/PU0-96/SOP 85-19, based on the findings and subject tu
the conditions contained therein, to further Include the
additional conditions contained In a memorandum dated June

his recollection that he was the lone "no" voter.
Ca.aissioner McFadden clarified that she did vote "no" on
the rescission of the action. (The minutes were reviewed
and found to be correct as presented.)
Coaissioner Marcus requesting the expansion the following
par~graph on page 5 of the May 28, 1986 ~inutes:

the applicant agreed to SOMe restrictions on the
l andscaping. Hr. Hentschke stated that the only way that

the CCIR. However, the City cannot enforce those

Planning Conalsslon
ChairMan Schlehuber stated that on July d at 7 p.m. the
Planning Co-lsslon has agreed to meet with the Arts
COMllllss lon. However, the Planning Co111nlsslon will meet at
6100 p.m. on that date, since there are agenda items
scheduled.
Becau,e certain Co11111lssioners will not be able to make the
July 9th 111eeting, Chair111c1n Schlehuber inquired on the
possibility or having the 11eetlng scheduled for another
day.
Following discussion, the Planning Commission
rescheduled the 111eeting of July 9, 1986 to July 30, 1986.
