CALL TO ORDER
Chairperson Montgomery called the meeting to order at 6:00 p.m.
PLEDGE OF ALLEGIANCE
Commissioner Goyarts led the Pledge of Allegiance.

Chairperson Segall asked if there were any corrections or revisions to the minutes of the meeting of December 20, 2017.
MOTION
ACTION: Motion by Commissioner Rodman and duly seconded by Commissioner Black to
approve the minutes of the Regular Meeting of December 20, 2017.
VOTE: 6-0-1
AYES: Chairperson Montgomery, Commissioner Anderson, Commissioner Black, Commissioner Goyarts, Commissioner Rodman and Commissioner Segall

Chairperson Montgomery directed everyone’s attention to the slide on the screen to review the procedures the Commission would be following for that evening’s public hearing.

Chairperson Montgomery opened the public hearing and asked City Planner Don Neu to introduce Agenda
Items 1 and 2.

1. CDP 2017-0033 (DEV2017-0114) – PARENTE REMODEL – Request for approval of a Coastal Development Permit to allow for the addition of 805 square feet of habitable
space, addition of a 352 square foot second floor deck, and a 266 square foot roof deck to an existing single-family residence within the Mello II Segment of the city’s Local
Coastal Program located at 2458 Ocean Street within Local Facilities Management Zone 1. The project site is within the appealable area of the California Coastal Commission.
The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301(e), additions to an
existing structure, of the state CEQA Guidelines. 2. CDP 2017-0051 (DEV2017-0168) – HOLSTEIN RESIDENCE – Request for approval of a Coastal Development Permit to allow for the addition of 534 square feet of habitable
space to an existing single-family residence within the Mello II Segment of the city’s Local Coastal Program located at 4244 Park Drive within Local Facilities Management Zone 1.
The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the
State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15301(e), additions to an existing structure, of the state CEQA Guidelines.
Mr. Neu stated Agenda Items 1 and 2 would normally be heard in a public hearing context; however, the
projects appear to be minor in routine and nature with no outstanding issues and staff is recommending approval. He recommended the public hearing be opened and closed, and that the Planning Commission
proceed with a vote as consent items. If the Planning Commission or any members of the public wish to pull the items, staff would be available to respond to any questions.
Chairperson Montgomery asked if any members of the Planning Commission wished to pull any of the
items listed. Seeing none, he asked if any members of the public wished to speak on the items listed. A member of the public requested to speak on Agenda Item 1. Chairperson Montgomery opened and closed
public testimony on Agenda Item 2. MOTION
ACTION: Motion by Commissioner Rodman and duly seconded by Commissioner Siekmann that the Planning Commission adopt Planning Commission Resolution No. 7284
approving Coastal Development Permit CDP 2017-0051 based upon the findings and subject to the conditions contained therein as amended.
VOTE: 7-0

Commissioner Goyarts, Commissioner Rodman, Commissioner Segall, and Siekmann

Chairperson Montgomery closed the public hearing on Agenda Item 2, asked Mr. Neu to introduce the next item and opened the public hearing on Agenda Item 1.
Mr. Neu introduced Agenda Item 1 and stated Senior Planner Cliff Jones would make the staff presentation.
Mr. Jones made the presentation and stated he would be available to answer questions.
Chairperson Montgomery asked if any of the Commissioners have ex parte communications to disclose for
this item.
Commissioner Anderson disclosed that she drove by the property.

Chairperson Montgomery asked if there were any members of the public who wished to speak on the project and opened public testimony.
Tom Grim, 2445 Garfield Street, shared his concern with the impact on the view from his property and the
negative impact that will have on his property value.
Chairperson Montgomery asked if there were any other members of the public who wished to speak on the project. Seeing none, he closed public testimony.
Chairperson Montgomery asked if the applicant wished to make a presentation. Seeing none, Chairperson
Montgomery asked if staff would like to respond to the issue raised.
Mr. Jones clarified that private views are not protected in the city. He stated that the project is subject to the maximum height limitation of the beach area overlay zone, which is 30 feet, and is in compliance with
the development height limitations.
Commissioner Anderson inquired about occupancy restrictions on the property. Mr. Neu stated that the occupancy limits are referenced in the housing code as to how many persons are permitted.
DISCUSSION
Commissioner Segall understands the neighbor’s concerns however, the city does not have a view
ordinance. He stated that the project meets the standards and he can support the project.

approving Coastal Development Permit CDP 2017-0033 based upon the findings and subject to the conditions contained therein.

3. AMEND 2017-0016/AMEND 2017-0015 (DEV2016-0031) – TOWN HOUSE – Request
for approval of a Tentative Tract Map Amendment and Major Review Permit Amendment to modify a previously-approved four-story mixed use building to replace four (4)
residential condominiums with four (4) additional professional office condominiums and to combine the second and third floors into one floor. The total number of proposed
professional office condominiums would be increased from one (1) to five (5), while the total number of proposed residential condominiums would decrease from seven (7) to
three (3). The 0.22-acre project site is addressed as 2677 State Street in Land Use District 4 of the Village Review (VR) Zone and Local Facilities Management Zone 1. The City
Planner has determined that this project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment,
and is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to section 15332 (In-fill Development Projects) of the
State CEQA guidelines.
Mr. Neu introduced Agenda Item 3 and stated Associate Planner Greg Fisher would make the staff presentation.
Mr. Fisher gave a presentation and stated he would be available to answer any questions.

Chairperson Montgomery asked if any of the Commissioners have ex parte communications to disclose for this item.
Commissioner Goyarts disclosed that he has been out to the property multiple times and viewed it on
Google Earth.
Chairperson Montgomery asked if there were any questions of staff.
Commissioner Anderson asked if the live/work unit is required for commercial use. Mr. Fisher replied no.
Chairperson Montgomery asked if there were any further questions of staff. Seeing none, he asked if the applicant wished to make a presentation.
Ed Leonard, Skyport Studios, Suite 200, 703 16th Street, San Diego, stated that he would be available to
answer questions.
Chairperson Montgomery asked if there were any questions for the applicant.
Commissioner Siekmann asked why the applicant made the change to the project. Mr. Leonard stated that the applicant recognized an opportunity to introduce class A, coastal oriented creative office space to the
village.
Commissioner Goyarts asked if artwork is planned for the project. Mr. Leonard stated it would be a possibility however, nothing is proposed.
Chairperson Montgomery asked if any person in the audience wished to speak on the item. Seeing none,
he opened and closed public testimony on Agenda Item 3. DISCUSSION
Chairperson Montgomery commented that the amendment to the application is better than the original application for its architectural features. He stated that it is great to see a better mixed use project, hoping
that it will encourage other developers in the area to expand.
MOTION
ACTION: Motion by Commissioner Montgomery and duly seconded by Commissioner Goyarts that the Planning Commission adopt Planning Commission Resolution No. 7285
approving Tentative Tract Map Amendment AMEND 2017-0016 and Major Village Review Permit AMEND 2017-0015 based on the findings and subject to the
conditions contained therein.

Chairperson Montgomery closed the public hearing on Agenda Item 3.
COMMISSION COMMENTS Commissioner Segall notified the Commission that the League of California Cities Planning Commissioner’s
Academy Conference will be on the held on the first week of April and the deadline to register is March 1st.
Commissioner Goyarts thanked and welcomed the high school students for getting involved in their community.

Chairperson Montgomery stated that he met with the Mayor and added that he would like the Commission
to apply findings within their comments on the Growth Management Plan. The Mayor wants the public who
voted for the plan to understand how projects are satisfying the Growth Management Plan and that that
they are receiving projects that are being approved under the auspices of the plan. Mr. Neu added that
staff includes information concerning compliance with the Growth Management performance standards in
staff reports and findings and stated that staff can spend more emphasis in presentations, particularly on
projects developing on undeveloped property.
Commissioner Goyarts asked if the availability of dwelling units per quadrant can be shown on a regular
basis and how it can be presented. Mr. Neu replied that the Development Monitoring Report exhibits list
the remaining capacity by quadrant. He stated if the Commission does not receive the notification as part
of the email subscription, staff can provide hard copies.
Commissioner Segall recommended that the Commission have a rundown of available housing units and
stated he would like to receive notification of the Development Monitoring Report.
Chairperson Montgomery commented that he has asked to have the Building Division present on how the
green code is applying conditions that the Commission is not aware of on projects after the approval.
Chairperson Montgomery added that the City Council will adopt and begin ex parte communications
disclosures similar to the Commission. Assistant City Attorney Ron Kemp clarified that ex parte disclosure
is information that the Commissioner received outside the public hearing and that the point is so that the
public knows what information the Commission is basing their decision on.
CITY PLANNER COMMENTS
Mr. Neu stated that the Village and Barrio Master Plan is expected to be posted to the website on Friday
and a copy will be provided to the Commission.
CITY ATTORNEY COMMENTS
None.
