CALL TO ORDER:
Acting Chairperson Chmiel called the Meeting to order at 1:15 p.m.
ROLL CALL:
Present: Commissioners Chmiel, Van and West.
Absent: Commissioners Whittaker and Zink.
PLEDGE OF ALLEGIANCE was led by Acting Chairperson Chmiel.
MAlTERS FROM THE PUBLIC:
There were no requests to address the Commission.
APPROVAL OF MINUTES:
On motion by Commissioner West, the Minutes of the Regular Meeting held June 1, 1995, were
approved as presented.

CONSENT CALENDAR:
Senior Coordinator's Report
Acting Chairperson Chmiel requested that Sue Spickard give the Senior Coordinator's Report
orally.
Ms. Spickard reported that a basic financial seminar "All About Trusts" was held on Monday, June
5, with 30 seniors learning the basics of trusts and estate planning.
The June trips were a success, with a trip to the Old Globe Theatre to see Michael Lerned in
"Dancing in Lughnasa" and a Senior Safari Trip to Cherry Valley for 43 seniors. They discovered
that five pounds of cherries could be picked in 15 minutes.
"Broadway Medleys", a concert by the Carlsbad Warblers, was attended by more than 60 people.

Dr. Ellis Diamond presented a seminar entitled "New Advances in the Treatment of Alzheimer's",
with approximately 70 attending. Staff was pleased and surprised at the large crowd.
Ms. Spickard stated that it is getting increasingly difficult to find doctors willing to donate their time
for health screenings and seminars. After seeing the large turnout for the previous seminar, staff
is making efforts to create relationships with businesses who can bring medical professionals to
the Senior Center.
Ms. Spickard reported that all available hearing test appointments were filled (15), and these are
offered every other month.
In July, Ms. Spickard reported on a "Safety on the Highways" seminar by Officer Ted Prola of the
California Highway Patrol. This will explain how to stay safe during an emergency on the roads
and will be held Thursday, July 6, at 1O:OO a.m.
Dr. Me1 Meilach, from Carlsbad, will share slides, stories and artifacts from his adventure travel
experience in Papua New Guinea on Monday, July 10, at 1O:OO a.m.
FHP will offer "A Celebration of Movement" on Thursday, July 20, at 1O:OO a.m., with the leader
demonstrating and instructing participants through a form of exercise using large rubberbands
while incorporating music, dances and stretching.
A seminar on Monday, July 31, at 1O:OO a.m., will be entitled "Put Massage in Your Life", with a
history of massage, an overview of the types of massage, and a demonstration on how to
massage hands and feet.
The Senior Safari planned to the San Diego Natural History Museum and Hall of Champions in
Balboa Park was cancelled.
Ms. Spickard stated that the Senior Safari planned for Thursday, July 13, to WIZARD, the hottest
Magic Club and Dinner Theatre in Los Angeles, is filling up fast.
The Carlsbad Senior Center's 7th Annual Ice Cream Social will be held at Magee Park, Sunday,
July 16, with Thrifty Payless donating the ice cream. The price per scoop will still be only 254
cents. The Golden Tones have agreed to provide the music for the afternoon.
Ms. Spickard stated that the discussion group and the book review group both continue to grow
in popularity.
There are two tables set aside in the lounge for chess on Wednesday afternoons, and
conversation Italian classes began in June. Ms. Spickard stated there are 15 students at this time,
and when the July newsletter mentions this class, more students are expected to join.
Ms. Spickard stated that recently she had a request from Prime West, wanting to place a bulletin
board type of stand in the lobby. They have requested this before and have been denied
permission, and Ms. Spickard stated that she has again told them that this type of stand is not
proper for the Senior Center.

ACTION: On motion by Commissioner West, the Senior Commission accepted the following
donations:

BRAILLE INSTITUTE
Scotti Aretakis, from the Braille Institute, gave a presentation to the Commission on the progress
made in the Braille Institute Program here at the Center. She introduced Fortune Zuckerman, with
the Institute; also, two of the students and one of the volunteers.
Ms. Aretakis stated that in four months, they have 12 students, and are working with four more in
the signing up process. Two thirds of the students are from Carlsbad, and of the four new
students signing up, three are from Carlsbad. There are 11 volunteers at this time, and there is
not a big difference in the ages between the volunteers and the students. Ms. Aretaks reported
that they are teaching typing classes, and adaptive cooking (with a microwave oven). The
students and volunteers both share what it is like to live with a vision loss. They are also teaching
sewing.
Ms. Aretaks said the idea is to have these people participate in the activities here at the Center,
and they do give free visual aid consultations. There are 45,000 talking book titles and cassette
players-with no charge. Ms. Aretakis stated she would be happy to answer any questions.
Sue Spickard stated that the Commission had voted to allow the Braille Institute to use the Center
for approximately six months, and that is why they are here today to report on their progress. She
said there had been a hard and fast rule about outside groups using the Center, but this group
is serving a large number of Carlsbad seniors and Carlsbad residents. She added that from a staff
perspective, there have been no problems with the program and it is a truly great service.
ACTION: On motion by Commissioner Van, and amended by Chairperson Chmiel, the
Senior Commission voted to have the Braille Institute continue their program at
the Senior Center on a yearly basis, as of July 1, 1995; to be reviewed again at
the end of that year.

CARLSBAD SENIOR CITIZENS ASSOCIATION AGREEMENT:
Sue Spickard reported that there has been an agreement between the City and the Carlsbad
Senior Citizens Association for years, and this agreement has only slight changes, such as the new
address of the Center and some insurance requirements. The Association has approved the
Agreement and Ms. Spickard asked the Commission to make a recommendation to City Council.

ACTION: On motion by Commissioner Van, the Senior Commission accepted the Carlsbad
Senior Citizens Association Agreement as presented and recommended its
approval by City Council.

PROPOSED SPINAL FITNESS CLASS:
Sue Spickard stated that a spinal fitness class has been proposed, and since this would be a
MiraCosta College class, she would like the Commission to discuss this and make a
recommendation. She asked that the class be scheduled for one semester.
Ms. Spickard said that this class has been developed for seniors with special physical needs, in
order to improve the quality of their lives. She explained the types of exercises to be taught and
explained that people in wheelchairs will be encouraged to attend the class. The class would be
held on Tuesdays and Thursday, from 1 :00 p.m. until 3:OO p.m. MiraCosta has been notified that
the Center is very interested in this class, but since MiraCosta classes have caused some
dissention in the past, Ms. Spickard stated she would like Commission approval. This class would
present an opportunity for some seniors who cannot attend the regular more active classes at the
Center to participate in Center activities. With MiraCosta, there will be a qualified instructor, a
rental fee for the use of the room and they will provide one million dollars in liability insurance.
Ms. Spickard stated that staff would recommend forming this class for a trial period of one
semester.
ACTION: On motion by Commissioner Van, the Senior Commission recommended approval
of a MiraCosta Spinal Fitness Class for a period of one semester.

COMMlmEE REPORTS:
Suaqestion Committee
Commissioner Van gave the Suggestion Committee report, as follows:
Sunnestion: Lights in the restrooms are sometimes turned off while people are in there and this could
be a potential for a major liability -- Sarah Bradbury
Answer: The Committee thanked Ms. Bradbury for calling this to staffs attention. The restrooms
are completely dark when the lights are turned off. This is usually done out of habit, but
it can be frightening and dangerous. Staff will investigate having new switches installed
that can only be shut off with a key, or that motion senors be installed.
Suaaestion: Table legs are unsteady. Tables should be checked regularly and adjusted for stability -

Answer: The Committee thanked Ms. Roth and stated this will be made a regular part of the Facility
Staff routine.

Nutrition Council:
Commissioner Chmiel reported a total of congregate meals served in May was 2,833, with the average
donation $1.65. Total home meals delivered in May was 972, with an average donation of $2.1 8. The
current balance in the treasury is $3,318.76, with the funds raised from dances, white elephant and bake
sales. The next District V Project Council was scheduled for the end of June.
Commissioner Chmiel continued, reporting that special events in May included a dance attended by 105
seniors, with refreshments including cookies, punch and coffee. The profit from a bake sale was $354.00,
and a decision was made to start future sales at 8:OO a.m.
Commissioner Chmiel reported the 4th of July celebration was held on July 3rd, and was a barbecue with
hamburgers and all the trimmings. Election for the Nutrition Council was held on June 22nd, with the
meeting starting at 1 1 :30 a.m. There is one Proclamation to be presented for a 50th Wedding Anniversary.

Ms. Spickard reported that the recovering of the patio chairs has become more complicated than
expected. La Jolla Patio no longer carries that type of chair and. one chair was dismantled and sent to
them as a pattern for a special order for recovering the chairs.

COORDINATORS REPORT
A basic financial seminar titled ##All About Truststt was held on
Monday, June 5. The seminar a crowd of 30 interested seniors who
learned the basics of trusts and estate planning.
The June trips were both a big success. The trip to the Old Globe
Theater to see Michael Lerned star in I1Dancing in Lughnasal' was sold out very early. Everyone enjoyed the show and the afternoon
even though everyone who attended reported that the show was somewhat Itdifferentt9 .
43 people joined the Senior Safari Trip to Cherry Valley. Cherries
were in season and were delicious. They discovered that it takes
about 15 minutes to pick 5 pounds of cherries.
Over 60 people enjoyed a concert by the Carlsbad Warblers featuring
ttBroadway Medleystt.

AGREEMENT
AN AGREEMENT BETWEEN THE CITY OF CARLSBAD,
CALIFORNIA AND THE CARLSBAD SENIOR CITIZENS'
ASSOCIATION TO PROVIDE PROGRAMS
AND ACTIVITIES FOR THE SENIORS OF CARLSBAD
THIS AGREEMENT is entered into by and between the City of Carlsbad,
California, a municipal corporation, hereinafter called "City" and Carlsbad Senior
Citizens' Association, Inc., a California corporation, hereinafter called "CSCA" .
RECITALS
WHEREAS, the City and CSCA wish to provide social and recreational
service3 to the Carlsbad Seniors; and
WHEREAS, the City owns a certain building located at 799 Pine Avenue
and is known as the Carlsbad Senior Center. This certain building is currently
used by the City and the CSCA to provide senior services.
- NOW, THEREFORE, it is agreed as follows:
1. CSCA PROGRAMS
CSCA agrees to provide and take full responsibility for the following
programs with the guidance of the City.
A. Binqo - The profits from Bingo will be used to finance programs and
activities of the CSCA. All applicable rules and laws will be
conformed to.
B. Newsletter - Monthly publication distributed to those who
subscribe. City staff will assist with subscription renewals. City
sponsored senior activities and programs shall be published in the
newsletter at no cost to the City.
C. Other Fundraisinq Activities - Profits will go to offset CSCA
operations and benefit senior programs at the Carlsbad Senior
Center. Activities will be developed and scheduled in collaboration
with the Senior Center Coordinator.
2. CITY PROGRAMS
The City will coordinate all other programs for the benefit of seniors in the
Carlsbad area.

3. FINANCIAL RESPONSI BlLlTlES .- The City will pay for the programs and activities provided by the City.
CSCA will pay for the programs and activities provided by CSCA including
- all costs and supplies relating to their operation. Additionally, CSCA shall
pay for any long distance phone calls placed from Senior Center.
4. PERSONNEL
A Senior Center Coordinator hired by the City shall direct the programs
offered by the City. CSCA will no longer employ an Executive Director,
but will hire staff or utilize volunteers for the coordination of their
programs.
5. FACILITIES
The CSCA shall be provided an office at the Senior Center, which they
may utilize to carry out their operations. Scheduling for the use of such
space shall be developed in conjunction with the Senior Center
Coordinator. Any other use by CSCA of any portion of the Senior Center
facility shall require an approved facility use application.
6. BUSINESS USE
CSCA shall not allow any business or commercial venture to use those
portions of the Senior Center utilized by the CSCA.
7. PUBLIC USE
All activities conducted by the CSCA at the Senior Center shall be open
to all seniors (persons 55 years of age or older).
8. - FEES
CSCA may charge a fee to persons participating in CSCA activities
conducted at the Senior Center. The amount of such fees shall
reasonably relate to the cost of the CSCA for conducting such activity
and shall be approved in advance by the Community Services Director or
his designee.
9. COMPLIANCE
CSCA agrees to comply with all applicable laws and will not erect any
sign or install any fixture without the prior written consent of the City.
IO. ASSIGNMENT
CSCA shall not assign or otherwise transfer its rights and privileges
arising from this agreement.

REPAIRS AND MAINTENANCE
City shall make all required repairs to Carlsbad Senior Center.
ALTERATIONS
CSCA shall make no alterations to the Senior Center or the Center
property without prior written consent of the City.
UTILITIES
The utilities, including water, shall be paid for by the City. The CSCA
will, however, pay for their own long distance telephone calls. Should
CSCA install a phone in their office area, gJ costs relating to installation,
repair service and monthly fees will be paid by CSCA.
RENTAL
For the use of the Senior Center as described herein during the term,
CSCA shall pay to the City the sum of $1 .OO annually due and payable
on the date of execution of this agreement by the City and annually on
the anniversary date of the agreement, unless the agreement is otherwise
terminated.
INSURANCE
CSCA shall obtain and maintain for the duration of the agreement liability
and property insurance against claims for injuries to persons or damage
to property which may arise or in connection with the use of the Senior
Center. Said insurance shall be in the amount of $1 million, naming the
City as an additional insured. Said insurance shall be obtained from an
insurance carrier admitted and authorized to do business in the State of
California. The insurance carrier is required to have a current Best's Key
Rating of not less than "A-:V" and shall meet the City's policy for
insurance as stated in Resolution No. 91-403. CSCA shall also provide
adequate insurance to cover any injury occurring to a volunteer providing
services to CSCA and arising out of the provision of that service. The
insurance policies are subject to approval by the City. CSCA shall be
responsible for informing the City of any condition which may render the
Senior Center building or any portion of the property unsafe.

16. HOLD HARMLESS
The City, its elected and appointed officers, volunteers and employees
shall not be liable for any claims, liabilities, penalties, fines, or any
damage to goods, properties, or effects of any person whatever; not for
personal injuries or death caused by or resulting from, or any intentional
or negligent acts of CSCA, CSCA's agents, employees, volunteers or
representatives.
Furthermore, Contractor agrees to defend, indemnify, protect, and save
free and harmless the City and its elected and appointed officers,
volunteers and employees against any claims for damages, liabilities,
penalties or fines, costs or expenses, including liabilities or claims arising
out of the conduct of CSCA in connection with the use of the Senior
Center, except only for those claims arising from the sole negligence or
sole willful conduct of the City, or its elected and appointed officers and
employees.
17. TERMINATION OF AGREEMENT
This agreement shall take effect and the term shall commence upon the
date of execution by the City and shall be automatically extended for
successive one-year periods, provided that CSCA has fully complied with
the terms and conditions of the agreement and unless sixty days notice
of termination is given by the City Council or CSCA. Notwithstanding,
anything to the contrary in this paragraph either party may terminate this
agreement at any time by giving ninety (90) days prior written notice to
the other.
18. KEYS
CSCA shall be provided from the Senior Center Coordinator two sets of
keys to the CSCA office. CSCA agrees not to duplicate or loan such
keys. Any additional keys will be distributed by the Senior Center
Coordinator. All persons issued a key will complete a City key
authorization form which will be kept on file in the Senior Center Office.

19. PRIOR AGREEMENTS
All prior agreements between the City and CSCA are superseded by this
agreement and shall be of no further force or effect.

Thank You for your bringing this to our attention. You are right,
the restrooms are completely dark when the lights are turned off. Although it is done most likely out of habit, it could be very
frightening and dangerous. We will request that new switches be
installed that can only be shut off with a key, or that motion
sensors be installed so that the lights will remain on as long as
someone is moving.
