Box 1733 Carlsbad, CA 92008 SUBJECT: HDP 95-03 - BODJANAC DUPLEX City staff has reviewed the above referenced project application and has concluded that no discretionary permit is required to build the proposed duplex residence. As you know, there was a Notice of Grading Violation recorded on the property site in 1989. However, the City's Engineering Department has since cleared, that Notice of Grading Violation. Because the violation has now been cleared, and because the proposed duplex development does not propose any disturbance of the now existing slope, a Hillside Development Permit is.not required. The project can be built with approval of a Building Permit. Staff notes that the project proposed is for a duplex. and not' for a two-lot minor subdivision nor for a condominium development (separate air-space ownership of the two units). As you know, condominium projects must be built to comply with the City's Planned Unit Development (PUD) standards. Since. the project is not proposed as a condo permit, staff has, not reviewed the project for compliance with the PUD ordinance.. Should the owner wish to convert the duplex to a condominium ownership arrangement in the future, the project would still be required to comply with those PUD' standards. Staff is withdrawing the above referenced HDP application as of this date. We will also refund any review application fees paid for this review. Site preparation, compaction, and testing were accomplished in July 1991. Based on our observations and testing, it is our opinion that the work performed during that period was in general conformance with the City of Carlsbad Grading Ordinance and the Soil Investigation Report by Ketchum Engineering Inc. dated December 27, 1989. On 9 July 1991, grading began on the subject lot with the contractor removing some surface vegetation. CLIENT: BODJANAC PROJECT: B0D691 DATE: 24 JULY 1991 On this date, the contractor excavated for a supporting shear key at the toe of the Easte,rly facing fill slope for the house pad by cutting a slot 15-feet wide into the firm natural soil and tilting the bottom downward into the slope. Fill material, silty sand generated from cuts along the Westerly side of the pad, was then watered and recompacted on he Easterly side of the house pad. On July 12, the contractor began placing imported soils. Import materials consisting, of silty fine sands, were compacted on the house pad to bring it up to the desired grade. Density was achieved by the use of a D-6 Bulldozer trackwalking the soil -as fill was placed in thin lifts. Since existing and imported soils were were low in moisture content, the contractor had to spend additional time and effort in his mixing operation in order to ensure near-optimum moisture and proper compaction in the fill material. As indicated by our Compaction Test Results, Enclosure (2), density tests performed in the construction of the fill slopes and the house pad indicated over 90% relative compaction as compared to ASTH Test Procedure D 15576-78. Foundations shall be sized and constructed in accordance with the recommendations found in the Soil Investigation Report by Ketchum Engineering Inc., dated December 27, 1989. For foundation design purposes, an allowable bearing strength of 2000 psf may be utilized for all continuous or spread footings found in dense soils compacted to 90% relative compaction per ASTM D 1557-78. This design bearing value is in accordance with the Uniform Building Code and was calculated based on Terzaghis' Formula. Footings placed on or adjacent to fill slopes shall have a minimum horizontal distance of five feet (5') from the edge of the footings to the face of the slope. Findings of this Report are valid as of this date; however, changes in conditions of a property can occur with passage of time, whether they be due to natural process or works of man on this or adjacent properties. In addition, changes in applicable or appropriate standards occur whether they result from legislation or broadening of knowledge. Accordingly, findings of this Report may be invalidated wholly or partially by changes outside our control. Therefore, this Report is subject to review and should not be relied upon after a period of three years. LEUCADIA COUNTY WATER DISTRICT APPLICATION FOR SEWER SERVICE The application must be signed by the owner (or his representative) of the property to be served. The total charges must be paid to the District at the time the application is submitted. APPLICANT MUST SUBMIT EVIDENCE OF BUILDING PERMIT WITHIN 60 DAYS. FAILURE TO MAKE SUCH SUBMITTAL WILL RESULT IN AUTOMATIC CANCELLATION OF THE SEWER PERMIT. THE SEWER CONNECTION FEE LESS A $50 ADMINISTRATIVE FEE WILL BE REFUNDED. A six-month construction period shall be provided and sewer service charges for the balance of the fiscal year shall be collected at the time of application for sewer permits. Sewer service charges for subsequent fiscal years shall be collected on the tax roll in same manner as property taxes. If the six-month construction period extends into the subsequent fiscal year, a prorated sewerservice charge forthat fiscal year shall be collected on the tax roll in the same manneras property taxes. The full sewerservice charges for all subsequent years shall be collected on the tax roll in the same manner as property taxes. There will be no additional fee or refUnd if service actually commences on a different date. . The prorated sewer service charge shall. not be required in those application for sewer permits for subdivisions. Such applicants shall be required to notify the District, on forms provided by the District, of escrow closing on individual propertieswithin the subdivision. Sewer service charges shall commence upon close of escrow and will be the responsibility of the buyer. If a service lateral is required, it must be installed by the owner/applicant in conformance with the specifications, rules and regulations of the District and subject to inspection by the District. A DISTRICT INSPECTOR MUST BE ON THE SCENE AT THE TIME OF CONNECTION. The service lateral is that part of the sewer system that extends from the main collection line in the street (or easement) to the point in the street (at or near the applicant's property line) where the service lateral is connected to the applicant's building sewer. The applicant is also responsible for the construction, at the applicant's expense, of the building of sewer from the applicant's plumbing to the point in the street (or easement) where a connection is made to the service lateral and for construction, maintenance and connection of the service lateral to the main line. IT MUST BE INSPECTED AND APPROVED BY THE DISTRICT BEFORE THE SEWER SYSTEM MAY BE USED BY THE APPLICANT. THE APPLICANT, OR HIS AUTHORIZED REPRESENTATIVE MUST NOTIFY THE DISTRICT AT THE TIME INSPECTION IS DESIRED. ANY CONNECTION MADE TO THE SERVICE LATERAL OR COLLECTION LINE WITHOUT PRIOR APPROVAL AND INSPECTION BY THE DISTRICT WILL BE CON- SIDERED INVALID AND WILL NOT BE ACKNOWLEDGED. ALL SUCH CONNECTIONS MUST BE MADE WITH AN LCWD INSPECTOR ATTHE SCENE ATTHETIME OF CONNECTION.
