SUBJECT: CD 2019-0021 (DEV2016-0015)-VIASAT PHASE V-A SITE & BUILDINGS
The City Planner has completed a review of your application for a Consistency Determination, CD 2019-
0021 (APN 213-260-12-00), which is a modification to Major Site Development Plan SOP 16-17 (related
permits include MP 178K, PUD 16-05, SUP 16-01, and MS 16-04) approved pursuant to Planning
Commission Resolution No. 7197 and Minor Site Development Plan SDP 2018-0008 approved
administratively per the approval letter dated December 26, 2018.
After careful consideration of the request, the City Planner has determined that the request meets all of
the findings below and APPROVES this request. The proposed modifications include:
• A four-foot maximum increase in grade pad height from 312.1 feet to 316.1 feet.
• Site plan changes to allow large and small Viasat special events to occur on-site.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1} No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the increase in grade height is
negligible, does not impair the safety of the site, and will not be discernible to the public. The
site pion changes to allow Viasat special events within the central courtyard area are not visible
from the street as the area remains surrounded by buildings and/or landscape and events will
be subject to the requirements of the General Plan Noise Element and the City of Carlsbad Noise
Manual.
2) The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding neighborhood in that the increase in grade height
is negligible, will not be discernible to the public, and the design and height of the building will
not change. The site plan changes to allow special events within the central courtyard are not
visible from the street and do nat impact the design features ar materials of the buildings and
events will be subject to the requirements of the General Plan Noise Element and the City of
Carlsbad Noise Manual.
3} The proposed revision does not change the density or boundary of the subject property.

4) The proposed revision does not involve the addition of a new land use not shown on the original
permit in that special events areas were originally included in the site plan, special events
. curreritly oen,r at the site, and large special event areas are typical for large companies.
5) The proposed revision does not rearrange the major land uses within the development in that the
site changes do not impact the layout of the buildings.
6} The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code in that the additional four feet of grade height for the site results in buildings
that are, at a maximum, 8.9% higher from the finished pad grade {44.5' tall building + 4'
additional grade= 48.5'/44.5' = 8.9%}. The maximum actual building height of 44.5' approved
for the project will not change as part of the project.
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8} The proposed change would not result in any health, safety or welfare impacts.
9} There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10} The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved in that the Increase in grade height
is negligible and will not be discernible. The site plan changes to allow special events within the
central courtyard area are not visible fram the street as the area remains surrounded by
buildings and/or landscape and events will be subject to the requirements of the General Plan
Noise Element and the City of Carlsbad Naise Manual.
Therefore, the City Planner has determined that the application qualifies for a consistency determination
with the approved permits and approves the changes to the project based on Planning Division
Administrative Policy No. 35.
