SUBJECT: MCUP 10-14-GERICO COMMUNICATIONS SITE 1ST EXTENSION

The Planning Division has completed a review of your application for the first extension to Minor
Conditional Use Permit MCUP 10-14 -GERICO COMMUNICATIONS SITE, located at 850 Tamarack
Avenue. The application was submitted on June 3, 2020, prior to the expiration date on August 24, 2020.
The project consists of an existing wireless communication facility {WCF) designed as a flagpole. The
WCF was originally approved on July 7, 1997 {CUP 97-08, Planning Commission Resolution No. 4156),
which was modified and approved as a Minor Conditional Use Permit for a period of 10 years on August
24, 2010.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code
(CMC) Chapter 21.42 and Wireless Communication Policy 64, and (2) the findings required for granting a
Minor Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the first
extension to Minor Conditional Use Permit MCUP 10-14-GERICO COMMUNICATIONS SITE for ten (10)
years from August 24, 2020, to August 24, 2030, based on the following findings and conditions.
Findings:
1. The permit or approval remains consistent with the general plan, all titles of the code and growth
management program policies and standards in place are the time the extension was considered,
and all of the findings contained in the City Planner approval letter dated August 24, 2010, for
MCUP 10-14 -GERICO COMMUNICATIONS SITE apply to this extension and are incorporated
herein by reference and remain in effect.
2. Circumstances have not substantially changed since the approval was originally granted as the
wireless communication facility is existing and no changes have been proposed.
3. The City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15301-Existing Facilities of the state CEQA Guidelines. In making
this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the
state CEQA Guidelines do not apply to this project.

Conditions:
1. This Minor Conditional Use Permit extension is granted for a period of ten (l0)years from August
24, 2020, to August 24, 2030.
2. The conditions contained in City Planner's approval letter dated August 24, 2010, for MCUP 10-
14 apply to this extension and are incorporated herein by reference and remain in effect except
for Planning Condition No. 6 which is superseded by Condition No. 1 of this approval letter.
