A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA,
ACCEPTING BIDS AND AWARDING A CONTRACT TO CCL CONTRACTING, INC.
FOR CONSTRUCTION OF THE VALVE REPLACEMENT PHASE II, CAPITAL
IMPROVEMENT PROGRAM (CIP) PROJECT NO. 5019-E, AND CONDITION
ASSESSMENT, CIP PROJECT NO. 5051, IN AN AMOUNT NOT TO EXCEED
$1,335,500
WHEREAS, the Carlsbad Municipal Water District (CMWD) Board of the City of Carlsbad,
California has determined it necessary, desirable, and in the public interest to replace broken valves at
prioritized locations, to concurrently make other improvements and to conduct a condition assessment
of pipes at the same locations; and
WHEREAS, on July 28, 2020, through adoption of Resolution No. 1643, the CMWD Board
approved plans and specifications, and authorized the secretary to the Board to advertise to receive
bids for the Project; and
WHEREAS, on Sept. 15, 2020, 15 sealed bids were received for construction of the Project; and
WHEREAS, the lowest responsible and responsive bid was submitted by CCL Contracting, Inc. in
the amount of $1,335,500; and
WHEREAS, Carlsbad Municipal Code (CMC) Sections 3.28.080(C) and 3.28.080(1)(6) require the
CMWD Board of Directors to award all formally bid contracts when the value exceeds $200,000;
therefore, the Project is subject to this requirement; and
WHEREAS, funds have been appropriated from the Water Valve Repair Replacement Program,
CIP Project No. 5019, and from the Water Infrastructure Condition Assessment Program, CIP Project
No. 5051, and are sufficient for completion of this Project; and
WHEREAS, CMC Section 3.28.040(C)(5) authorizes the executive manager or designee to
approve change orders in the amount equal to the contingency set at the time of Project award, which
is $264,900 for the Project; and

WHEREAS, the city planner has determined that the Project is exempt from the California
Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15302(c) - replacement or
reconstruction of an existing utility system and/or facility involving negligible or no expansion of
capacity and that none of the exceptions described in CEQA section 15300.2 are applicable to this
project.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the bid in the amount of $1,335,500 submitted by CCL Contracting, Inc. for
construction of the Project, is accepted, and the president of the Board is hereby authorized to execute
a contract with CCL Contracting, Inc.
3. That the executive manager or designee is hereby authorized to approve construction
change orders up to $264,900.
4. That the city planner has determined that the Project is exempt from the California
Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15302(c) - replacement or
reconstruction of an existing utility system and/or facility involving negligible or no expansion of
capacity and that none of the exceptions described in CEQA section 15300.2 are applicable to this
project.
5. That the award of this contract is contingent upon CCL Contracting, Inc. executing the
required contract and submitting the required bonds and insurance policies, as described in the
contract, within 20 days of adoption of this Resolution. The executive manager may grant reasonable
extensions of time to execute the contract and assemble the required bonds and insurance policies.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of Directors of the
Carlsbad Municipal Water District of the City of Carlsbad on the 17th day of November, 2020, by the
following vote, to wit:
AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
NAYS: None.
ABSENT: None.
