A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS, AWARDING A CONTRACT TO BLUE PACIFIC
ENGINEERING AND CONSTRUCTION, AND AUTHORIZATION OF ADDITIONAL
APPROPRIATION IN AN AMOUNT NOT TO EXCEED $50,000 FOR
CONSTRUCTION OF THE EL CAMINO REAL AND COLLEGE BOULEVARD
INTERSECTION IMPROVEMENTS, CAPITAL IMPROVEMENT PROGRAM (CIP)
PROJECT NO. 6071, IN AN AMOUNT NOT TO EXCEED $568,340.
WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary,
desirable and in the public interest to construct El Camino Real and College Boulevard Intersection
Improvements, CIP Project No. 6071 (Project); and
WHEREAS, on Oct. 27, 2009, per Agenda Bill AB# 20,024, the City of Carlsbad and Carlsbad
Unified School District signed a settlement agreement for Carlsbad Unified School District to contribute
$350,000 to the Project and for construction of the Project to commence within eight years of the
school opening, which is by fall 2021; and
WHEREAS, on July 14, 2020, City Council adopted Resolution No. 2020-0139 approving the plans
and specifications and authorizing advertisement for bids for construction of the Project; and
WHEREAS, on Aug. 19, 2020, staff received 14 sealed bids for the Project; and
WHEREAS, the lowest responsive and responsible bid for the Project was submitted by Blue
Pacific Engineering and Construction, in an amount of $568,340; and
WHEREAS, funding for said Project that has been appropriated from the Gas Tax fund and
General Capital Construction is not sufficient; and
WHEREAS, additional appropriations for said Project will be appropriated from the Gas Tax Fund
in the amount of $50,000; and
WHEREAS, Carlsbad Municipal Code Sections 3.28.080(C) and 3.28.080(l)(6) require City Council
to award all formally bid contracts when the value exceeds $200,000; and therefore, the Project is
subject to this requirement; and
WHEREAS, Carlsbad Municipal Code Sections 3.28.040(C)(5) and 3.28.090(B) authorize the
city manager or designee to approve change orders in an amount equal to the contingency set at the
time of project award, which is $85,251 for this Project; and
WHEREAS, the city planner has determined that the Project is exempt from the California
Environmental Quality Act (CEQA) under CEQA Guidelines Section 15301(c) — minor alteration of
Oct. 13, 2020 Item #2 Page 5 of 25
existing facilities including streets, sidewalks and similar facilities involving negligible or no expansion,
and that no exception as set forth in CEQA Guidelines Section 15300.2 applies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the City of Carlsbad maintains Project monies set forth by the settlement
agreement between City of Carlsbad and Carlsbad Unified School District in the amount
of $350,000.
3. That the bid of $568,340 submitted by Blue Pacific Engineering and Construction for
construction of El Camino Real and College Boulevard Intersection Improvements, CIP
Project No. 6071, is accepted and the mayor is hereby authorized to execute the
contract for this Project.
4. That the deputy city manager, administrative services, is authorized and directed to
appropriate Gas Tax Funds in the amount of $50,000 for construction of the Project.
5. That the city manager or designee is hereby authorized to approve construction change
orders up to $85,251; construction management and inspection costs up to $56,834;
and supplemental work items up to $100,000.
6. That the city planner has determined that the project is exempt from the California
Environmental Quality Act (CEQA) under CEQA Guidelines Section 15301(c) — minor
alteration of existing facilities including streets, sidewalks and similar facilities involving
negligible or no expansion and that no exception as set forth in CEQA Guidelines Section
15300.2 applies.
7. That the award of this contract is contingent upon Blue Pacific Engineering and
Construction executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within 20 calendar days of adoption of
this Resolution. The city manager may grant reasonable extensions of time to execute
the contract and assemble the required bonds and insurance policies.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 13th day of October, 2020, by the following vote, to wit:
AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
NAYS: None.
