SUBJECT: CDF 01-08 - MCGRADY FAMILY RESIDENCE - Request for approval of a
Coastal Development Permit to allow for the construction of a single-family
residence within the City's Coastal Zone located at 4100 Sunnyhill Drive within
Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5057
APPROVING Coastal Development Permit CDP 01-08 based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single-
family home within the City's Coastal Zone requires the processing and approval of a Coastal
Development Permit (CDP). The CDP application was reviewed for consistency with Local
Coastal Program (LCP) policies and implementation. The proposed residence is consistent with
the Mello 2 segment of the city's LCP. There are no unresolved issues. The staff recommended
approval with conditions is supported by the analysis as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill lot located at the corner of Tamarack Avenue and Sunnyhill Drive
outside the appeal area of the coastal zone as shown on the attached location map. The site
consists of a split level pad that slopes gently downward from the rear to the front property line.
The lot area is .437 acres (19,018 square feet) and is mostly useable.
Proposed Residential Construction: New 4,175 square foot two story residential structure and
attached 734 square foot two-car garage with workshop area. The two-story "Spanish" style
structure will be constructed of wood framing with stucco exterior and a decorative red tile roof.
There is an existing 1,200 square foot residential structure located onsite that the applicant
currently occupies. The applicant will occupy this structure until the new residence is completed.
Prior to the issuance of final occupancy for the new residence, the existing residence will be
converted to an accessory building by removing the kitchen. The conversion of the existing
residence to an "accessory building" is a condition of approval for the Coastal Development
Permit. The accessory building is an allowed use per Chapter 21.10.010 of the Carlsbad
Municipal Code and meets all of the developments standards for the R-l zone.

SIDENCE
Proposed Grading: The proposed grading quantities include 436 cubic yards cut and 381 cubic
yards fill. These grading quantities require a grading permit to be issued by the Engineering
Department.
Impact on Coastal Resources: None.
IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 5057.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Local Coastal Program Segment.
The project proposes the construction of a new two-story single-family residence in an
area designated for single-family residential development. As discussed below, the
project complies with the applicable Local Coastal Program provisions. The LCP Land
Use Plan designates the subject site for RML (Residential Medium Low) density
development, which allows 3.2 du/ac. Based on a density of 3.2 du/ac, the lot could
accommodate one dwelling unit.
The proposed residence will be located on the southeast corner of Tamarack Avenue and
Sunnyhill Drive. The two-story residence is consistent with the surrounding development
of one-and two-story structures. The two-story residence will not obstruct views of the
coastline as seen from public lands or the public right-of-way or otherwise damage the
visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are
there any sensitive resources located on the developed property. The proposed residence
is not located on an area of known geologic instability or flood hazard. No public
opportunities for coastal shoreline access are available from the subject site since it is not
located between the first public road and the ocean, and no public access requirements are

conditioned for the project. The residentially designated site is not suited for water-
oriented recreation activities.
2. Coastal Overlay Zones.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
due to its location and the absence of slopes steeper than or equal to 25% inclination
and/or native vegetation, additional submittals, standards or requirements do not apply.
The project requires a grading permit. Construction of the project will adhere to the
City's Master Drainage and Storm Water Quality Management Plan and Grading
Ordinance to avoid increased runoff and soil erosion.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single-
family residences in urbanized areas from environmental review.
A Notice of Exemption will be filed by the Planning Director upon project approval.
