AGENDA OF: September 1, 2010 Application complete date: May 26, 2010 Project Planner: Shelley Glennon Project Engineer: David Rick SUBJECT: CDF 00-58(AVSUP 00-1UAVCUP 00-32xl(A) - CA-SDG5657 MARJA ACRES - Request for an amendment to Coastal Development Permit No. 00-58, Special Use Permit No. 00-11, and Conditional Use Permit No. CUP 00-32x1 to allow Clear Wireless to consolidate 6 of 9 existing Sprint/Nextel antennas to 3 Sprint/Nextel iDen antennas and to add 3 new Clear Wireless WiMax antennas, 3 DAP head units and 3 directional antennas for a total of 12 antennas mounted on an existing 32 foot tall mono-palm and for the addition of one Clear Wireless rack within an existing equipment shelter located at 4901 El Camino Real in the R-A- 10,000 and C-2-Q/C-2 zones and in Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6722, 6723 and 6724 APPROVING an Amendment of CDP 00-58, SUP 00-11 and CUP 00-32x1 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The application is a request for approval of a Coastal Development Permit (CDP) Amendment, Special Use Permit (SUP) Amendment and Conditional Use Permit (CUP) Amendment to allow Clear Wireless, a Wireless Communication Facility (WCF), to consolidate 6 of 9 existing Sprint/Nextel antennas to 3 Sprint/Nextel iDen antennas and to add 3 new Clear Wireless WiMax antennas, 3 DAP head units and 3 directional antennas for a total of 12 antennas mounted on an existing 32 foot tall mono-palm and for the addition of one Clear Wireless rack within an existing Sprint/Nextel equipment shelter located at 4901 El Camino Real. Currently, the Sprint/Nextel WCF has 9 antennas on the existing mono-palm. Quasi-public facilities are permitted in the General Commercial - Qualified Development Overlay Zone and the Residential-Agriculture zone by a CUP. The proposal complies with all CUP findings, SUP findings and Coastal Development Permit findings, as well as all guidelines of the City Council Policy No. 64 (Wireless Communication Facility Ordinance) which addresses WCFs. III. PROJECT DESCRIPTION AND BACKGROUND The applicant (Clear Wireless) is proposing to consolidate 6 of 9 existing Sprint/Nextel antennas to 3 Sprint/Nextel iDen antennas and to add 3 new Clear Wireless WiMax antennas, 3 DAP head units and 3 directional antennas for a total of 12 antennas mounted on an existing 32 foot tall mono-palm and for the addition of one Clear Wireless rack within an existing equipment shelter o CDP 00-53(A)/SUP 00-11(A)/CUP 00-32x1 (A) - CA-SDG5657 MARJA ACRES September 1,2010 PAGE 2 located at 4901 El Camino Real. The Sprint/Nextel WCF currently has 9 antennas on the existing mono-palm. This proposal will remove 6 of the 9 existing antennas to provide space for the new antennas. A total of 12 antennas can be located on the 3 antenna arrays. The new antenna proposal consists of 3 consolidated Sprint/Nextel iDen antennas, 3 Clear Wireless WiMax antennas, 3 DAP head units (located behind the WiMax mounting pipe), and 3 directional antennas. The proposed antennas will be located on the existing antenna arrays adjacent to the three remaining Sprint/Nextel antennas. The 3 existing Sprint/Nextel antennas are measured at 4' x 1' (length x width). The proposed Sprint/Nextel iDen antennas are measured at 4' x 1'. The proposed Clear Wireless WiMax antennas are measured at 4' x l'-l". The 3 proposed direction antennas are measured at T-3.3" in diameter, and the 3 proposed DAP head units (located behind the WiMax mounting poles) are measured at 1'- 7" x 1'- 2.7". Therefore, the proposed iDen, WiMax, and directional antennas and DAP head units will not exceed the total length of the existing antennas on the antennas arrays, however, will exceed the width of the existing antennas by a maximum of 2.3 inches. The additional inches in width will not be noticeably different than the existing antenna width from public view at approximately 80 feet higher in grade than the commercial parcel and at 300 feet in distance from El Camino Real. Additionally, the antennas will be painted green to match the color of the palm fronds. The project proposes fuller palm frond foliage to be installed for additional concealment of the new antennas (see Exhibits D-E for antenna layout and project elevations), thereby creating a better stealth design than originally approved. Currently, the existing mono-palm is located on the residential-agriculture zoned parcel and the equipment shelter is located on the commercial zoned parcel. The existing residential- agriculture parcel is developed with three existing mono-palms (including the Sprint/Nextel mono-palm) surrounded by fully grown palm trees to allow the mono-palms (faux palm trees) to blend into the natural surroundings. The commercial parcel has a palm-tree nursery, an existing commercial building (the Country Store) and four equipment shelters which have been designed to match the existing commercial building. On April 4, 2001 the Planning Commission approved CUP 00-32 for 5 years to allow the Sprint/Nextel WCF installation of 12 antennas on a 32-foot tall mono-palm (only 9 of the approved 12 antennas were built). The Planning Commission concurrently approved a Coastal Development Permit (CDP 00-58) and a Special Use Permit (SUP 00-11) for the project. On April 19, 2006, the Planning Commission approved the first extension of CUP 00-32 which is to expire on April 3, 2011. This amendment to the CUP will approve this amended project and also extend the existing project for another 10 years to alleviate Sprint/Nextel from having to process a second extension next year. IV. ANALYSIS Staffs recommendation of approval for the amendment to the CDP, SUP and CUP was developed by analyzing the project's consistency with the applicable City regulations and policies. This analysis will present in text the project's consistency with the applicable regulations listed below: CDP 00-53(A)/SUP 00-11(A)/CUP 00-32xl(A) - CA-SDG5657 MARJA ACRES September 1,2010 PAGE 3 A. The City of Carlsbad General Plan; B. Residential Agriculture (R-A-10,000) Zone (Chapter 2L08 of the Carlsbad Municipal Code) and General Commercial (C-2-Q/C-2) with a Qualified Development Overlay Zone (Chapter 21.28 and 21.06 of the Carlsbad Municipal Code); C. Scenic Corridor Overlay (El Camino Real Development Standards); D. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code); E. Wireless Communication Facilities Policy (City Council Policy 64); F. Coastal Development Policies and Regulations for the Mello II LCP Segment and Coastal Resource Protection Overlay Zone (CMC Chapter 21.203); and G. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code) and Zone 1 Local Facilities Management Plan. A. The City of Carlsbad General Plan The project complies with the General Plan in that, the use is necessary and desirable for the development of the community because of the benefit and demand for digital communications and data transmissions for businesses, individuals, public agencies and emergency service systems in this part of the City. The use is consistent with the General Plan in that the L (Local Shopping Center) and RLM (Residential Low Medium) General Plan Land Use designations do not preclude the provision of Wireless Communication Facility (WCF) uses. Additionally, the project's location and stealth design comply with General Plan objectives that seek to maintain and enhance Carlsbad's appearance. B. Residential Agriculture (R-A-10,000) Zone (Chapter 21.08 of the Carlsbad Municipal Code) and General Commercial (C-2-Q/C-2) with a Qualified Development Overlay Zone (Chapter 21.28 and 21.06 of the Carlsbad Municipal Code) Wireless Communication facilities are permitted in the General Commercial - Qualified Development Overlay Zone and the Residential-Agriculture zone by a Conditional Use Permit (CUP). The site upon which the mono-palm is located is zoned R-A-10,000 and the equipment cabinet is located in the C-2-Q/C-2 zone. The existing mono-palm which the proposed antennas are located on, are not within any of the required front, rear or side yard setbacks of the R-A-10,000 zone; however, the mono-palm does exceed the 30 foot height limitation permitted by the R-A-10,000 zone at 32 feet in height at the antenna radius. However, a higher elevation than allowed by the zone may be approved through a CUP issued by the Planning Commission. Therefore, with Planning Commission approval of this CUP (CUP 00-32x1 (A)), the proposed antennas located on an existing 32 foot tall mono- palm will comply with the development standards of the R-A-10,000 zone. The equipment rack located within the existing equipment shelter also meets all development standards of the C-2- Q/C-2 zone in that the equipment rack is below the maximum 35 foot height and is not located within any of the required rear, or side yard setbacks (no front yard setback is required in this zone). The required CUP findings (discussed below in Section D) can be made for the proposed WCF as it is a desirable public convenience and is compatible with its surroundings. Scenic Preservation Overlay Zone (El Camino Real Development Standards) The project site is located approximately 300 feet from El Camino Real, which has been designated as a Scenic Roadway by the City's General Plan. Consequently, the project is subject to the requirements of the El Camino Real Scenic Corridor Development Standards (Area 3) and requires a Special Use Permit Amendment. The new Clear Wireless WCF on the revised Sprint/Nextel WCF will maintain a distant view, since both WCFs will be located slightly over 300 feet in distance from the roadway. The surrounding natural view shed will not be obstructed and is also not considered significant due to the fact that it has been partially degraded by existing development between the project and El Camino Real including: a mobile home park development to the east, utility poles and lines along El Camino Real, and SDG&E transmission towers to the west. To reduce the visibility of the WCFs and for the WCFs to blend into the existing rural area, the antennas will be painted green and located on an existing mono-palm which maintains a "stealth" design with the existing and proposed palm fronds concealing both Sprint/Nextel and Clear Wireless antennas. The existing mono-palm is surrounded by natural palm trees of varying heights to further blend in with its surroundings. The mono-palm and surrounding palm trees will also blend in with the palm tree nursery located along the driveway on the west side of the site. As previously mentioned, there are two other existing mono-palms located on the site. The CUPs for these facilities all have been renewed within the last few years for an additional 10 years. Given that the new Clear Wireless WCF antennas and modified Sprint/Nextel antennas on an existing Sprint/Nextel 32-foot tall mono-palm, is approximately 300 feet in distance from the El Camino Real corridor; exhibits stealth design by painting the antennas green and concealing the antennas within proposed palm fronds; is blended into the natural "rural" settings with existing palm trees of varying heights surrounding the stealth facility, therefore preserving the quality of views along the route both to the natural and man-made environments; and is compliant with all the El Camino Real Corridor Development Standards, staff has concluded that this proposal conforms to the requirements of the Scenic Preservation Corridor Overlay. D. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code) Conditional uses, such as WCFs possess unique and special characteristics that make it impractical to include them as permitted uses "by right" in any of the various zoning classifications (i.e. residential, commercial, office, industrial). The authority for the location and operation of these uses is subject to Planning Commission review and the issuance of Conditional Use Permits. Staff has reviewed the proposed project and found that all the necessary finding can be made to approve the CUP Amendment. The required findings and satisfaction of these findings are illustrated below in Table A: CDP 00-53(A)/SUP 00-11(A)/CUP 00-32xl(A) - CA-SDG5657 MARJA ACRES September 1,2010 PAGE 5 TABLE A - CONDITIONAL USE PERMIT FINDINGS FINDINGS PROJECT CONSISTENCY That the requested use is necessary or desirable for the development of the community, and is in harmony with the various elements and objectives of the general plan, including, if applicable, the certified local coastal program, specific plan or master plan. The requested use is necessary and desirable for the development of the community because of the benefit and demand for digital communications and data transmissions for businesses, individuals, public agencies and emergency service systems in this part of the City. The use is consistent with the General Plan in that the L (Local Shopping Center) and RLM (Residential Low Medium) General Plan Land Use designations do not preclude the provision of Wireless Communication Facility (WCF) uses and the use is also consistent with the Mello II Local Coastal Program Segment as discussed in Section F below. Additionally, the proposed antennas will not exceed the length of the existing antennas and will only exceed the width of the existing antennas by approximately 2.3 inches maximum. However, the antennas will be painted green and the applicant proposes fuller palm frond foliage to better conceal the existing and proposed antennas. Therefore, the project's improved stealth design complies with the General Plan objectives that seek to maintain and enhance Carlsbad's appearance. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. The requested Clear Wireless WCF and modification to the existing Sprint/Nextel antennas on an existing Sprint/Nextel WCF mono-palm and all aspects of both WCFs are not detrimental to existing uses, or to uses permitted in the zone in that the amended project is stealth in design and the WCF use is not precluded by the project site's C-2-Q/C-2 and R-A-10,000 zoning. Furthermore, the placement of new Clear Wireless antennas and consolidation of Sprint/Nextel antennas on the existing Sprint/Nextel mono-palm and the associated Clear Wireless equipment rack within the existing Sprint/Nextel equipment shelter will not result in any additional building coverage, does not visually impact the existing site, and the WCF does not interfere with other surrounding uses. The project also complies with the Federal Communications Commission (FCC) Radio Frequency (RF) Exposure Guidelines. CDP 00-53(A)/SUP 00-11(A)/CUP 00-32xl(A) - CA-SDG5657 MARJA ACRES September 1,2010 PAGE 6 TABLE A - CONDITIONAL USE PERMIT FINDINGS - CONTINUED FINDINGS PROJECT CONSISTENCY That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the Planning Director, planning commission or city council, in order to integrate the use with other uses in the neighborhood. The site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code in that the existing mono-palm which the proposed antennas are located on is not within any of the required front, rear or side yard setbacks of the R-A-10,000 zone; however, the mono-palm does exceed the 30 foot height limitation permitted by the R-A-10,000 zone at 32 feet in height at the antenna radius. However, a higher elevation than allowed by the zone may be approved through a CUP issued by the Planning Commission. Therefore, with Planning Commission approval of this CUP (CUP 00-32x1 (A)), the proposed antennas located on an existing 32 foot tall mono-palm will comply with the development standards of the R-A-10,000 zone. The equipment rack located within the existing equipment shelter also meets all development standards of the C-2-Q/C-2 zone in that the equipment rack is below the maximum 35 foot height and is not located within any of the required rear, or side yard setbacks (no front yard setback is required in this zone). That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. The project generates only one trip per month for maintenance and occasional emergency maintenance visits in response to operational problems. The existing street system is adequate to properly handle any traffic generated by the use. E. Wireless Communication Facilities Ordinance (City Council Policy 64) The City Council adopted a policy (City Council Policy 64) regarding prioritization for the location of Wireless Communication Facilities (WCF) within the City of Carlsbad on October 3, 2001 (revised on July 15, 2009). The proposal to consolidate 6 of 9 existing Sprint/Nextel antennas to 3 Sprint/Nextel iDen antennas and to add 3 new Clear Wireless WiMax antennas, 3 DAP head units and 3 directional antennas for a total of 12 antennas mounted on an existing 32 foot tall mono-palm and for the addition of one Clear Wireless rack within an existing equipment shelter, complies with all City Council Policy 64 guidelines as stated below: CDP 00-53(A)/SUP 00-11(A)/CUP 00-32xl(A) - CA-SDG5657 MARJA ACRES September 1,2010 PAGE? The City Council Policy 64 guidelines state that WCFs should be located on buildings and structures, not on vacant land. The new Clear Wireless WCF and the consolidation of 6 Sprint/Nextel Antennas to 3 iDen antennas are proposed to be located on the three existing antennas arrays of an existing Sprint/Nextel 32 foot tall mono-palm. City Council Policy 64 identified preferred locations of WCFs, in order of priority are: industrial, commercial, public, other non-residential, public utility, park, or community facility property. The existing mono-palm with proposed modified and new antennas is located in the R-A-10,000 Residential zone. Residential zones are considered "discouraged locations" pursuant to City Council Policy 64. However, WCFs may be located in "discouraged locations" if the applicant demonstrates that no feasible alternative site exists within a preferred location. The applicant has submitted coverage maps indicating the coverage needs for this facility (see Attachments 13 and 14). The areas requiring coverage are residential, with the exception of the Country Store located on the commercial parcel along El Camino Real. There are no other properties within the vicinity that have a non-residential land use designation and are at a high enough elevation to meet the required WCF coverage objectives as the existing site. The commercial parcel is approximately 30 feet lower in elevation than the existing mono-palm site. To relocate the WCF on the commercial parcel, a new WCF at approximately 62 feet in height would need to be constructed to achieve the same area of coverage. Additionally, the closest lattice tower (SDG&E tower) that could be used for collocation is located northeast of the subject site and is at a lower elevation than the surrounding topography, thereby eliminating one-half of the coverage objectives. The design guidelines of City Council Policy 64 require that all aspects of a WCF, including the supports, antennas, screening methods, and equipment should exhibit "stealth" design techniques so they visually blend into the background or the surface onto which they are mounted. The policy encourages collocation wherever feasible and appropriate. The project complies with the policy design guidelines in that the proposed antennas will not exceed the size of the existing antennas and will be painted green and concealed within the existing and newly proposed palm fronds on the existing mono-palm. The existing mono-palm is also surrounded by mature palm trees to further blend the mono-palm into its natural surroundings. The Clear Wireless equipment rack will be fully concealed within an existing Sprint/Nextel equipment shelter. The consolidation of the Sprint/Nextel antennas has allowed Clear Wireless to collocate their antennas onto the existing Sprint/Nextel antenna arrays. Therefore, no new Clear Wireless WCF structure will be required. Lastly, the applicant has submitted a Radio Frequency (RF) Exposure Analysis Report to ensure that the RF exposure will not exceed the FCC guidelines Maximum Permissible Exposure (MPE). The report indicates that the RF exposure of the Clear Wireless antennas will be well below the FCC standard for continuous public MPE. Additionally, the combined exposures of Sprint/Nextel & Clear Wireless Facilities on the same mono-palm, as well as the two nearby mono-palms used by AT&T (formerly Cingular PCS) and Verizon Wireless will not exceed the FCC Radio Frequency Guidelines. CDP 00-53(A)/SUP 00-11(A)/CUP 00-32xl(A) - CA-SDG5657 MARJA ACRES September 1,2010 PAGES F. Coastal Development Policies and Regulations for the Mello II LCP Segment and Coastal Resource Protection Overlay Zone (CMC Chapter 21.203) Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The subject site has a LCP Land Use Plan designation of RLM (Residential Low Medium) and GC (General Commercial) and a LCP zoning designation of R-A-10,000 (Residential Agriculture) and C-2-Q/C-2 (General Commercial with a Qualified Development Overlay Zone) and the project is consistent with the LCP Land Use Plan and zoning designations which permit this type of use subject to approval of a Conditional Use Permit Amendment. The project will be located at 4901 El Camino Readjust south of Tamarack Avenue and north of Cannon Road. The project will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The existing mono-palm and equipment shelter are not located in an area of known geological instability or flood hazard. No public opportunities for coastal shoreline access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The commercial and residentially zoned site is not suited for water-oriented recreation for the project. G. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance) and Zone 1 Local Facilities Management Plan. The proposed site is located within Local Facilities Management Plan Zone 1. The installation of the antennas on the existing mono-palm and the equipment rack within the existing Sprint/Nextel equipment shelter would not result in increased public facilities demands and therefore, the project would not exceed performance standards for public facilities. V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301(e) "Addition to Existing Facilities," of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
