INVOCATION: None. APPROVAL OF MINUTES: Minutes of the Regular Meeting held April 14, 2020. Motion by Mayor Pro-Tern Blackburn, seconded by Council Member Bhat-Patel, to approve the minutes as presented. Motion carried unanimously, 4/0. PRESENTATIONS: Proclamation in recognition of Bike Month. Mayor Hall read the proclamation. Proclamation in recognition of National Public Works Week. Mayor Pro Tern Blackburn read the proclamation. PUBLIC COMMENT: City Clerk Barbara Engleson read the public comments received from the following individuals into the record: Robert Caudill wrote about the lack of enforcement on groups sitting and gathering at the beach. Kim Tanner wrote about the lack of enforcement on groups gathering at the beach and the lack of face mask use. Kelly Lauro wrote asking when Carlsbad tennis facilities would be opened. Deborah Hargis wrote that it was time to reopen Carlsbad. Ali Pendleton wrote about bike lanes needing to be improved. ACCEPTANCE OF DONATION -Adoption of a resolution accepting a donation of $196,072 from the Carlsbad Library & Arts Foundation to the City of Carlsbad's Library & Cultural Arts department. SIDE LETTER AGREEMENTS WITH CPMA, CPOA, CCEA, CFA AND APPROVING AN AMENDMENT TO THE MANAGEMENT COMPENSATION AND BENEFITS PLAN FOR COVID-19 EMERGENCY RESPONDER LEAVE BENEFITS -Adoption of Resolution No. 2020-087 approving Side Letter Agreements with the Carlsbad Police Management Association (CPMA), Carlsbad Police Officers' Association (CPOA), Carlsbad City Employees' Association (CCEA), and Carlsbad Firefighters' Association, Inc. SIDE LETTER AGREEMENT WITH CARLSBAD CITY EMPLOYEES' ASSOCIATION -Adoption of Resolution No. 2020-088 approving a Side Letter Agreement with the Carlsbad City Employees' Association (CCEA) to amend the parties' Memorandum of Understanding to add Article 58 regarding confined space pay and modify Article 18, Section D, regarding safety footwear. AGREEMENT WITH DUDEK FOR DESIGN SERVICES -Adoption of Resolution No. 2020-089 authorizing a professional services agreement with Dudek for design services for the south shore Agua Hedionda Lagoon (Hub Park) Trail, in an amount not-to-exceed $509,975. TRAFFIC CALMING PLANS FOR SEGOVIA WAY AND HARWICH DRIVE -Adoption of Resolution No. 2020-090 approving the traffic calming plans for Segovia Way and Harwich Drive, Capital Improvement Program Project No. 6070, per the Carlsbad Residential Traffic Management Program. AUTHORIZE CONTRACT WITH AND RECEIPT OF HOMELESSNESS PREVENTION AND INTERVENTION FUNDS FROM THE STATE OF CALIFORNIA -Adoption of a resolution authorizing a contract with and receipt of homelessness prevention and intervention funds from the State of California and authorizing a second contract with designated partner agency, the Community Resource Center. Motion carried unanimously, 4/0. ORDINANCES FOR INTRODUCTION: 7. AMENDMENTS TO CARLSBAD MUNICIPAL CODE CHAPTER 1.08, PENALTIES. AND CHAPTER 1.10, ADMINISTRATIVE CODE ENFORCEMENT REMEDIES-Introduction of Ordinance CS-374 amending Title 1, Chapter 1.08, Penalties of the Carlsbad Municipal Code; and Introduction of Ordinance CS-375 amending Title 1, Chapter 1.10, Administrative Code Enforcement Remedies of the Carlsbad Municipal Code. (Staff contact: Cindie McMahon and Marissa Kawecki, City Attorney) City Manager's Recommendation: Introduce the Ordinances. City Attorney Celia Brewer titled the Ordinances. ROMERIA POINTE APARTMENTS -This request for hearing was withdrawn by the applicant on May 14, 2020. The item will be presented to the Planning Commission on a date to be determined. COVID-19 ACTIONS AND EXPENDITURES REPORT -Receive a report on recent actions and expenditures related to the city's response to the COVID-19 pandemic and provide direction as appropriate. City Clerk Barbara Engleson read the public comments received from the following individuals into the record: Polly Williams wrote about celebrating Carlsbad Graduating seniors with banners. Kerry Siekmann wrote regarding Terramar traffic issues and suggested three-way stops at El Arbo/ Dr. and Cerezo. Catherine Miller wrote about her neighborhood streets being greatly impacted by beach parking. Pete Radice wrote about government officials asking Carlsbad to now wait for the cure. Dan Walsh wrote the issue of beach parking in his neighborhood at Terramar. Laura Stearn wrote about honoring Carlsbad's class of 2020 and including graduates in the 92009 zip code area. Diane Tindall wrote asking when beach parking would be reopened. Jeffrey Lee wrote asking that the disabled parking along the coast be opened. Andrew Lee wrote asking that the tennis courts reopening. Bob Pritchard wrote asking that beach parking from the Village to Poinsettia be reopened. Brad Smith wrote about beach parking issues at Terramar. Greg Hallinan submitted a comment regarding beach parking for the record. Mayor Hall called a recess at 4:58 p.m. Mayor Hall reconvened the meeting at 5:09 p.m. City Clerk Barbara Engleson read the public comments received from the following individuals into the record: May 19, 2020 Carlsbad City Council Regular Meeting Maryam Samady wrote about the limited use openings of the parks. Ray Stainback wrote about the Jack of beach parking. Page 5 Minute Motion by Mayor Pro Tern Blackburn, seconded by Mayor Hall, to open parking on Carlsbad Blvd. as soon as City Clerk, City Attorney and City Manager can rescind the emergency parking ordinance. Motion failed -2/2 (Bhat-Patel, Schumacher-No). Minute Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to follow staff recommendations for installing banners recognizing senior classes graduating from high schools located within Carlsbad. Motion carried unanimously, 4/0. Minute Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to give the City Manager the authority to open the beaches for passive use only on June 1, 2020 consistent with the consensus of the coastal cities, and schedule a discussion the week of June 1, 2020 related to parking for Countil's consideration. Motion carried unanimously, 4/0. Minute Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to allow use of active areas of parks by members of the same household (consistent with the San Diego County's protocols for parks) starting at 2 p.m. on May 20, 2020, including that use at active amenity sites such as Chase Fields and Zone 5 Park -once the county's protocol forms are prepared by staff, but excepting that use at 10 school district properties under joint-use agreements with the city, at half-court basketball courts in three community parks, and at half (3 of 6) of the pickleball courts in Poinsettia Park. Motion carried unanimously, 4/0. Council Member Schumacher commented that she wanted to assure the community that the parking situation in beach neighborhoods would not be ignored. City Manager Scott Chadwick stated he would meet with Police Chief Neil Gallucci to make sure the community's needs are being met. 10. FIRE DEPARTMENT STANDARDS OF COVERAGE REPORT -Receive a report on the 2020 Standards of Coverage and potential service and deployment improvements. (Staff contact: Nick Ordille, Fire) City Manager's Recommendation: Receive the report. Assistant Fire Chief Nick Ordille and Stewart Gary of Citygate Associates, LLC presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
