ANNOUNCEMENT OF CONCURRENT MEETINGS: None. Council Chamber 1200 carlsbad Village Drive carlsbad, CA 92008 PLEDGE OF ALLEGIANCE: Mayor Pro Tern Blackburn led the Pledge of Allegiance. INVOCATION: None. APPROVAL OF MINUTES: Minutes of the Regular Meeting held Jan. 14, 2020. Minutes of the Special Meeting held Jan. 21, 2020. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve the minutes as presented. Motion carried unanimously, 4/0. PRESENTATIONS: Proclamation in Recognition of the Great Kindness Challenge. Mayor Hall introduced Jill McManigal, Co-Founder and Executive Director of Kids for Peace and Ben Churchill, Carlsbad Unified School District Superintendent. Mayor Hall presented the proclamation to Ms. McManigal who thanked the educators, principals, students and City Council for helping in the efforts of the program. PUBLIC COMMENT: Tom Hersant, representing a group, (Stephen Yue; Scott Margosh; Laureen Barke; Polly Yue and Antoma Hersant) introduced Juergen Hermann to speak about Karlsbad of Germany. Juergen Hermann presented a PowerPoint presentation of various statistics, facts and information about Karlsbad of Germany and its relationship with the City of Carlsbad. Marianne Townsend spoke regarding the dangers of SG and small cell phone towers. She asked the City Council to pause applications for development of future small cell phone towers. Brian Carstens spoke about the dangers of SG and small cell phone towers in Carlsbad residential neighborhoods. Feb. 11,2020 Carlsbad City Council Regular Meeting Page 2 PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced that Item No. 1 had no reportable action. Regarding Item No. 2, she explained the City Council authorized initiation of litigation and that the complaint will be made public upon service. CONSENT CALENDAR: Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve Consent Calendar Item No. 1. Motion carried unanimously, 4/0. 1. REPORT ON CITY INVESTMENTS -Acceptance of Report on City Investments as of Dec. 31, 2019. (Staff contact: Craig Lindholm, City Treasurer and Laura Rocha, Administrative Services) ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: 2. REPEAL PROVISIONS OF THE CARLSBAD MUNICIPAL CODE THAT ARE OBSOLETE OR CONFLICT WITH OTHER LAWS-Adoption of Ordinance No. CS-369 repealing Chapters 5.30, 6.15, 8.08, and 8.49 of the Carlsbad Municipal Code; and, Adoption of Ordinance No. CS-370 repealing Section 2.06.070 of the Carlsbad Municipal Code. (Staff contact: Sheila Cobian, City Clerk Services) City Manager's Recommendation: Adopt Ordinance Nos. CS-369 and CS-370. City Attorney Celia Brewer titled the Ordinances. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Ordinance No. CS-369 and Ordinance No. CS-370. Motion carried unanimously, 4/0. 3. AMENDMENTS TO CARLSBAD MUNICIPAL CODE SECTION 2.40.060-HOUSING COMMISSION FUNCTIONS -Adoption of Ordinance No. CS-371 amending Carlsbad Municipal Code Section 2.40.060 regarding Housing Commission Functions. (Staff contact: Sheila Cobian, City Clerk Services) City Manager's Recommendation: Adopt Ordinance No. CS-371. City Attorney Celia Brewer titled the Ordinance. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Ordinance No. CS-371. Motion carried unanimously, 4/0. UPDATE CITY'S FLOODPLAIN MANAGEMENT REGULATIONS TO ENSURE CONSISTENCY WITH FEDERAL GUIDELINES-Introduction of an ordinance approving a Zone Code Amendment and Local Coastal Program amendment to ensure consistency with federal guidelines related to Floodplain Management Regulations. Case Name: Floodplain Management Regulations Amendments. Case No. ZCA 2019-0001/LCPA 2019-0004 (PUB2019-0010); and, Adoption of a resolution approving a Zone Code Amendment and a Local Coastal Program Amendment to update the City's Floodplain Management Regulations to ensure consistency with federal guidelines related to Floodplain Management Regulations. (Staff contact: Melanie Saucier, Community Development) City Manager's Recommendation: Take public input, close the public hearing, introduce the ordinance and adopt the resolution. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to continue the item to the April 7, 2020 City Council Meeting. Motion carried unanimously, 4/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 5. ACQUISITION OF REAL PROPERTY COMMONLY KNOWN AS AURA CIRCLE -Adoption of Resolution No. 2020-035 authorizing the mayor to execute all appropriate acquisition documents, and for the city clerk to execute the Certificate of Acceptance of the Grant Deed for the acquisition of real property commonly known as the Aura Circle from Pacific Legacy Homes, Inc. for the purchase price of $2,070,000, plus half of the closing costs (estimated at $10,000). (Staff contact: Curtis Jackson, Real Estate) City Manager's Recommendation: Adopt the resolution. Deputy City Manager of Community Services Gary Barberio and Real Estate Manager Curtis Jackson presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Rosanne Bentley spoke in support of the purchase and the city's plans to make the property open space. In response to an inquiry from Mayor Hall, Deputy City Manager of Community Services Gary Barberio explained the city is paying for the cost of restoring the property lines of the encroaching properties because the property is being sold "as is" and the property owner will task the City to enforce the encroachment lines. In response to an inquiry from Mayor Hall, City Attorney Celia Brewer explained that the city will be able to enforce the encroachments if the property owners do not voluntarily adhere to the property boundaries. Feb.11,2020 Carlsbad City Council Regular Meeting Page 4 Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2020-035 noting the current encroachments. Motion carried unanimously, 4/0. 6. CONSIDERATION OF THE CITY'S PARTNERSHIP WITH NEW VILLAGE ARTS -Consider and discuss the city's partnership with New Village Arts and provide direction to staff as appropriate. (Staff contact: Richard Schultz, Library & Cultural Arts) City Manager's Recommendation: Receive the report and provide direction to staff as appropriate. Library & Cultural Arts Director Heather Pizzuto and Cultural Arts Manager Richard Schultz presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Scott White spoke in support of a long-term commitment between the city and New Village Arts. Robert (Bob) Lih, President of New Village Arts spoke regarding some of the misunderstandings in the staff report for this item. He asked that City Council direct staff to spend the previously allocated funds to enhance the back wall and repair the roof of the New Village Arts building. He also asked the City Council to direct staff to add signage in the Village pointing to the location of New Village Arts, and to approve an additional $250,000 to improve the exterior of the New Village Arts building. Lastly, he asked the City Council to approve an extension of the lease of the building for another 20 years. Christine Davis, Executive Director of Carlsbad New Village Association, spoke in support of a long-term commitment between the city and New Village Arts. Carlton Lund also spoke in support of a long-term commitment between the city and New Village Arts. Kristianne Kurner, Founder and Executive Artistic Director of New Village Arts, spoke in support of a long-term commitment between the city and New Village Arts. Thomas Roberts spoke in support of a long-term commitment between the city and New Village Arts. In response to a question from Mayor Pro Tern Blackburn City Manager Scott Chadwick confirmed that a budget for the repairs of the New Village Arts building had been approved but had not been initiated due to the need to consult with a Structural Engineer. Feb.11,2020 Carlsbad City Council Regular Meeting Page 5 In response to Mayor Pro Tern Blackburn, Deputy City Manager of Community Services Gary Barberio explained that New Village Arts would have to submit an application for additional signage. In response to Mayor Pro Tern Blackburn, City Manager Scott Chadwick responded that the additional $250,000 budget had not been approved and that City Council would need to decide if to include that cost in this year's budget cycle. In response to Mayor Pro Tern Blackburn, Deputy City Manager of Community Services Gary Barberio explained that the City Council does have a street naming policy and that New Village Arts can submit an application to change the name of Christiansen Way. Council Member Schumacher, Council Member Bhat-Patel, Mayor Pro Tern Blackburn and Mayor Hall all expressed interest in discussing the formation of a long-term lease with New Village Arts. City Manager Scott Chadwick asked for City Council to provide direction to staff to move forward with discussions of a long-term lease with New Village Arts including a series of meetings within 30-60 days with New Village Arts and discussion in Closed Session regarding pricing and terms. Motion by Council Member Schumacher, seconded by Council Member Bhat-Patel, to move forward with the long-term lease discussion with New Village Arts. Motion carried unanimously, 4/0. Minute Motion by Council Member Schumacher, seconded by Mayor Pro Tern Blackburn, to direct staff with no date certain to initiate a State Street Arts Specific Plan with New Village Arts. Motion carried unanimously, 4/0. 7. APPOINT ONE MEMBER TO THE BEACH PRESERVATION COMMISSION -Adoption of Resolution No. 2020-036 appointing one member to the Beach Preservation Commission. (Staff contact: Tammy McMinn, City Clerk Services) City Manager's Recommendation: Adopt the resolution. Roca Nasirpour spoke about his qualifications to serve on the Beach Preservation Commission. Motion by Mayor Hall, seconded by Council Member Schumacher, to adopt Resolution No. 2020-036 appointing Jennifer Bradley to the Beach Preservation Commission. Motion carried unanimously, 4/0. Feb.11,2020 Carlsbad City Council Regular Meeting Page 6 COUNCIL REPORTS AND COMMENTS: Minute Motion by Council Member Schumacher, seconded by Mayor Hall, to schedule a discussion of the homeless veterans housing project at a future City Council Workshop meeting. Motion carried unanimously, 4/0. Mayor Hall and City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. CITY MANAGER COMMENTS: City Manager Scott Chadwick announced that the City Council Workshop meeting scheduled for February 18, 2020 has been cancelled. He also announced the hiring of Geoff Patnoe as the new Assistant City Manager. CITY ATTORNEY COMMENTS: None. CITY CLERK COMMENTS: None. ANNOUNCEMENTS: None.
