Recommended Action
Adopt a resolution approving the appropriation of $3,000,000 to pay for costs related to the
COVID-19 local emergency.
Executive Summary
On March 17, 2020, the City Council adopted Resolution No. 2020-048 declaring a local state of
emergency as recommended by the city manager due to the significant risk of the widespread
transmission of the COVID-19 virus. Staff is seeking the appropriation of three million dollars
($3,000,000) from the city's economic uncertainty set-aside in the General Fund to pay for costs
related to the COVID-19 local emergency.
Discussion
COVID-19 is an emerging respiratory disease that is easily transmitted and can cause serious
illness in older adults and people with certain underlying health conditions. On March 16, 2020,
the city manager, acting as the director of emergency services for the City of Carlsbad,
proclaimed a local emergency as a result of the spread of COVID-19 after determining that (1)
conditions of extreme peril to the safety of persons and property have arisen within the City of
Carlsbad caused by the spread of COVID-19; and (2) the conditions require emergency
response, with the potential need for resources beyond the capacity and control of the
services, personnel, equipment, and facilities of the City of Carlsbad.
On March 17, 2020, the City Council adopted Resolution No. 2020-048. This measure:
1)Ratified the proclamation of local emergency
2)Extended the proclamation until May 15, 2020 at 5:00 p.m.
3)Directed and authorized the director of emergency services to obtain any and all local,
county, state and federal aid to assist in addressing the state of emergency
4)Authorized the city manager and purchasing officer to make purchases, as needed, in
keeping with Carlsbad Municipal Code Sections 3.28.ll0{A) and, as, appropriate,
3.28.120.

Fiscal Analysis
Staff is requesting $3,000,000 from the city's economic uncertainty reserve funds in the
General Fund to offset the city's costs related to the COVID-19 emergency. These would be
unanticipated costs over and above the city's normal operating costs. The appropriation will
cover citywide costs that have been incurred to date as well as future anticipated costs.
The city's economic uncertainty set-aside currently has a balance of $19.1 million. If $3 million
is spent during the emergency, the new balance of the set-aside would be $16.1 million. If any
of the $3 million is left unspent at the end of the emergency, the remaining funds will be added
back to the economic uncertainty set-aside.
There is the potential for partial reimbursement of these costs from either state and/or federal
agencies. The degree to which these costs are reimbursable is currently unknown and is
dependent upon the receipt of the necessary approvals from the state and federal agencies.
The total costs to respond to the local emergency are unknown at this time.
Next Steps
At the conclusion of the emergency, or sooner, if requested by the City Council, staff will
present a full accounting of all costs incurred including all material, labor, regular and
professional services and if any state and/or federal government reimbursement will be
available.
Environmental Evaluation (CEQA)
Emergency projects are statutorily exempt from the California Environmental Quality Act under
CEQA Guidelines Section 15269.
Public Notification and Outreach
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to scheduled meeting date.

RESOLUTION NO. 2020-061
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROPRIATING $3,000,000 FROM THE CITY'S ECONOMIC
UNCERTAINTY SET-ASIDE IN THE GENERAL FUND TO PAY FOR COSTS
RELATED TO THE COVID-19 LOCAL EMERGENCY
WHEREAS, on March 16, 2020 the Director of Emergency Services proclaimed the existence of
a local emergency due to conditions of extreme peril to the safety of persons and property as a result
of the spread of COVID-19; and
WHEREAS, on March 17, 2020 the City Council of the City of Carlsbad adopted Resolution No.
2020-048 declaring a local state of emergency pursuant to California Government Code section 8630;
and
WHEREAS, the City Council will review the need for continuing the state of local emergency on
or before May 15, 2020; and
WHEREAS, the city has incurred and continues to incur significant expenses as a result of the
COVID-19 local emergency; and
WHEREAS, the city currently has $19.1 million set-aside for economic uncertainty in the General
Fund;and
WHEREAS, it is the intent of the City Council to seek the maximum aid, comfort and restitution
to its citizens who are victims of this calamity; and
WHEREAS, it is the intent of the City Council to do all things necessary to effectuate this intent.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the Deputy City Manager, Administrative Services is authorized to appropriate
three million dollars ($3,000,000} from the city's economic uncertainty set-aside in the
General Fund to cover the cost of expenditures related to the COVID-19 local
emergency.
3. That any of the three million dollars ($3,000,000) left unspent at the end of the
emergency will be added back to the city's economic uncertainty set-aside in the
General Fund.

RATIFYING THE PROCLAMATION OF A LOCAL EMERGENCY DECLARED ON
MARCH 16, 2020, BY THE DIRECTOR OF EMERGENCY SERVICES AS A RESULT

WHEREAS, COVID-19 is an emerging respiratory disease and older adults and persons with
severe underlying health conditions are at increased risk of more serious illness after contracting
COVID-19;
WHEREAS, on January 31, 2020, United States Health and Human Services Secretary Alex M.
Azar II declared a Public Health Emergency for the United States, effective January 27, 2020, to aid the
nation's health care community in responding to the spread of COVID~19; and
WHEREAS, on February 14, 2020, the San Diego County Health Officer declared a Local Health
Emergency as a result of the spread of COVID-19, which was subsequently ratified by the Board of
Supervisors on February 19, 2020; and
WHEREAS, on March 4, 2020, the State of California declared a State of Emergency as a result
of the spread of COVID-19; and
WHEREAS, on March 11, 2020, the World Health Organization began characterizing COVID-19
as a pandemic; and
WHEREAS, on March 13, 2020, the President of the United States declared a national
emergency as a result of the spread of COVID-19; and
WHEREAS, the transmission of COVID-19 is increasing in the State of California and there is .a
significant risk of widespread introduction and transmission of COVID-19 into the County of San Diego;
and
WHEREAS, to reduce the spread of COVID-19:
1. The Center for Disease Control has recommended, for the next eight weeks, cancelling
or postponing in-person events consisting of 50 people or more; cancelling gatherings
of more than 10 people for organizations that serve higher risk populations; and
cancelling events of any size unless they can be carried out virtually or with adherence
to guidelines for protecting vulnerable populations, hand hygiene, and social distancing;

2. The California Department of Public Health has recommended, through the month of
March, cancelling or posting all gatherings of 250 people or more; cancelling or
postponing any smaller gatherings in venues that do not allow for social distancing of
six feet per person; and limiting gatherings of individuals who are at higher risk for
severe illness from COVID-19 to no more than 10 people;
3. The Health Officer of the County of San Diego has issued an order prohibiting all
gatherings of 50 or more people; strongly discouraging non-essential gatherings of any
size; closing all bars, adult entertainment establishments, and other business
establishments that serve alcohol and do not serve food; closing all on-site dining at
restaurants and other business establishments that serve food; requiring all businesses
to enact social distancing, increase sanitation standards, suspend any policy or
procedures requiring doctor verification for sick or other leave approval; and use
telecommuting for its workforce whenever possible; strongly recommending persons
who are 65 years or older or who have a chronic underlying condition or a compromised
immune system to self-quarantine at home; ·
4. The Governor of the State of California has issued Executive Order N-25-20 requiring
state residents to heed any order and guidance of state and local public health officials
to control the spread of COVID-19;
5. The Governor of the State of California has further called for bars, wineries, nightclubs,
brewpubs and related businesses to close; for restaurants to reduce capacity to allow
for deep social distancing; and for people over age 65 or with chronic health conditions
to isolate themselves at home; and
6. The President of United States has issued guidelines for the next 15 days to slow the
spread of COVID-19, which include listening and following the directions of state and
local authorities; self-isolation for those at increased risk of more serious illness from
COVID-19; working or engaging in school from home whenever possible; avoiding social
. gatherings of more than 10 people; avoiding eating or drinking at bars, restaurants, or
food courts and instead using drive-thru, pickup, or delivery options; avoiding
discretionary travel, shopping trips, and social visits; avoiding non-critical visits to
nursing homes or retirement or long-term care facilities; and practicing good hygiene.
WHEREAS, the Director of Emergency Services has determined that (1) conditions of extreme
peril to the safety of persons and property have arisen within the City of Carlsbad caused by the spread
of COVID-19; and (2) the conditions require emergency response, with the potential need for resources
beyond the capacity and control of the services, personnel, equipment, and facilities of the City of
Carlsbad; and
WHEREAS, on March 16, 2020 the Director of Emergency Services signed a Proclamation of
Local Emergency as a Result of the Spread of Covid-19; and

WHEREAS, Chapter 6.04 of the Carlsbad Municipal Code designates the City Manager as the
Director of Emergency Services and empowers the Director of Emergency Services to proclaim a Local
Emergency when there exists, or there threatens to be conditions of disaster or of extreme peril to the
safety of persons or property, including an epidemic, within the City of Carlsbad and when the City
Council is not in session; and
WHEREAS, COVID-19 is an emerging respiratory disease and older adults and persons with
severe underlying health conditions are at increased risk of more serious illness after contracting ·
COVID-19;

Background

•On March 16, 2020, the City proclaimed a local emergency
due to the spread of COVID-19 after determining that:
•Conditions of extreme peril to the safety of persons and
property had arisen within the City of Carlsbad; and
•Conditions required emergency response, with the
potential need for resources beyond the capacity and
control of the services, personnel, equipment, and
facilities of the City of Carlsbad.
City Council Direction
•On March 17, 2020, the City Council adopted Resolution No.
2020-048. This measure:
1)Ratified the proclamation of local emergency
2)Extended the proclamation until May 15, 2020 at 5:00 p.m.
