Executive Summary Carlsbad Municipal Code section 1.20.060 (C) allows any member of the City Council to add an item to the City Council agenda. This item was requested under this authority to discuss the official role and responsibilities of the City Council during times of emergencies, such as access to city resources including, but not limited to, social media, official city newsletters, Communications staff and Communications resources. This report provides background information on the official role of the City Council in the context of federal, state, county and city laws, regulations and systems related to emergency management as well as the city’s Emergency Operations Plan. Discussion The City of Carlsbad’s approach to emergency management is derived from the provisions of state and federal guiding documents developed by various emergency and public safety agencies. The current structure and practice of emergency management used by cities, counties, states and the federal government was developed by the Federal Emergency Management Agency in the aftermath of 9/11. Although some nuances exist, federal and state emergency management protocols share common principles, including: Using a standardized approach with clearly defined roles and responsibilities when managing large scale emergencies. Facilitating priority setting, interagency cooperation, and the efficient flow of resources and information. The specific reference documents used by the City of Carlsbad when creating its Emergency Operations Plan include: California Emergency Services Act California Standardized Emergency Management System @ S~~fi R~port April 14, 2020 Item #2 Page 1 of 20  State of California’s Emergency Operations Plan  National Incident Management System The role of cities Although the overall frameworks for emergency management are established at the federal and state levels, local authorities, such as cities, maintain operational control and responsibility of emergency management activities within their jurisdictions, unless otherwise superseded by statute or agreement. The California Emergency Services Act (Cal. Gov. Code, § 8550 et seq.) most directly informs the City of Carlsbad’s Emergency Operations Plan. Section 8550, subdivision (a): [Confers] upon the Governor and upon the chief executives and governing bodies of political subdivisions of this state the emergency powers provided herein; and to provide for state assistance in the organization and maintenance of the emergency programs of such political subdivisions. City of Carlsbad Emergency Operations Plan The Carlsbad City Council adopted the City of Carlsbad Emergency Operations Plan on May 22, 2018 (Resolution 2018-080). This plan defines the city’s emergency organization and responsibilities and lines of communication, consistent with the state’s Standardized Emergency Management System and the federal National Incident Management System. The plan provides a comprehensive approach to emergency management that includes all community sectors. Called the “whole community approach,” FEMA guidelines recognize that a government-centric approach to disaster management is not sufficient to meet the challenges posed by a catastrophic incident. The Emergency Operations Plan follows the organizational structure and role descriptions of the National Incident Management System, including a Policy Group led by the City Manager (acting as the Director of Emergency Services, as described in Carlsbad Municipal Code section 6.04.090) The Policy Group includes leaders of city operational areas most critical to emergency management, including finance, legal, technology, human resources and public safety. Specifically, according to the city’s Emergency Operations Plan, the Policy Group is responsible for:  Strategic level legal, financial, human resource, and inter-jurisdictional mutual aid decision- making.  Managing city continuity of operations challenges created by the hazard or threat.  Strategic oversight of Emergency Operations Center operations. Emergency Operations Center The Emergency Operations Center is the centralized location for response-support decision-making, guided by the Policy Group. Some of the main EOC functions include:  Create situational awareness and a common operational picture  Establish EOC objectives and tasks and identify resources  Develop and disseminate public safety communications and warnings  Prepare and submit situation reports, operational reports, and other response and recovery reports as appropriate April 14, 2020 Item #2 Page 2 of 20 City Council role The role of the City Council outlined in the city’s Emergency Operations Plan is to establish public safety and community welfare policy. General responsibilities include:  Consulting with the Policy Group  Ascertaining incident details and public safety and community welfare impact  Addressing the public  Consulting with other jurisdiction officials  Adopting a local emergency proclamation resolution as necessary It should be noted that the Emergency Operations Plan has, by definition, an operational focus. Elected officials’ roles and responsibilities far pre-date the onset of an emergency. By establishing overall city policies and allocating resources, the City Council is directly responsible for the high level of readiness the community enjoys today. Continuity of operations is a main objective of emergency management, and this is another area where ongoing investments and policy direction from the City Council is critical. Some of the specific ways the City Council role has been enacted during the COVID-19 public health emergency include:  Maintaining situational awareness through daily briefings with the Director of Emergency Services.  Adopting a resolution declaring a local emergency, which provides much needed flexibility and access to resources.  Adopting a resolution suspending commercial evictions to provide relief to affected businesses.  Forming an ad hoc subcommittee to develop proposed economic revitalization measures.  Keeping the community informed on how to best mitigate the risk and follow public health orders by amplifying official city communication messages through traditional and social media, email and newly implemented teleconferencing technologies. Use of city resources during an emergency The Carlsbad Municipal Code does not provide a method for the City Council or individual City Council members to direct city staff or resources except by a majority vote at a City Council meeting. These powers and duties are described in several sections of the Carlsbad Municipal Code, including: 2.12.035 Powers and duties G. Financial Reports. It shall be the duty of the city manager to keep the city council at all times fully advised as to the financial conditions and needs of the city and make such recommendations as the city manager may deem desirable. H. Budget and Salary Plan. It shall be the duty of the city manager to prepare and submit the proposed annual budget and the proposed annual salary plan to the city council, with a message describing important features thereof, and be responsible for its administration after adoption. I. Expenditure Control and Purchasing. It shall be the duty of the city manager to see that no expenditures shall be submitted or recommended to the city council except on approval of the city manager or authorized representative. The city manager, or authorized representative, shall be responsible for the purchase of all supplies, materials and equipment for all the departments or divisions of the city for which funds are provided in the annual budget, and prepare and submit to the council as of the end of the fiscal year a complete report on the finances and administrative activities of the city for the preceding year. April 14, 2020 Item #2 Page 3 of 20 2.12.110 Council-manager relations The city council and its members shall deal with the administrative services of the city only through the city manager, except for the purpose of inquiry, and neither the city council nor any member thereof shall give orders or instructions to any subordinates of the city manager. The city manager shall take his or her orders and instructions from the city council only when sitting in a duly convened meeting of the city council and no individual councilmember shall give any orders or instructions to the city manager; however, any councilmember may, as an individual, request pertinent information on municipal affairs and citizen complaints from the city manager and from department heads through the city manager. These requests will be answered promptly. (Ord. 1156 § 9, 1973; Ord. 1040 § 21) Disaster councils Disaster councils are authorized through the state (Cal. Gov. Code, § 8610) at the city and county levels. The purpose of disaster councils is to recommend to the director of the local emergency organization rules and regulations for dealing with local emergencies that can be adequately dealt with locally. Since May 9, 1961, the City of Carlsbad has been a member of the Unified San Diego County Civil Defense and Disaster Organization, known as the Unified Disaster Council. Section 6.04.010 of the Carlsbad Municipal Code authorizes the mayor, on behalf of the city, to enter into and sign a civil defense and disaster agreement regarding the coordination of all of San Diego County cities with the County of San Diego into a unified organization. (Ordinance 1126 § 1, 1970; Exhibit 1). In 1953, Ordinance 1015 established a disaster council for the City of Carlsbad, which is codified in the Carlsbad Municipal Code Sections 6.04.050 - 6.04.080. (Exhibits 2 & 3.) The disaster council is chaired by the mayor, with the director of emergency services (the city manager) as vice chair. The disaster council also includes the assistant director of emergency services, the public safety chiefs and community organizations. Carlsbad Municipal Code section 6.04.120 describes the disaster council’s role in developing a city emergency plan to provide for the effective mobilization of resources and provide for the organization, powers and duties, services, and staff of the emergency organization. Such plans shall take effect upon adoption by resolution of the city council. The disaster council may be called to meet during a disaster by the chair (mayor) or, if absent, the vice chair (City Manager). To staff’s knowledge, the disaster council has not been called to meet since the establishment of an emergency services function within the city organization. The last emergency fitting the definition of a specific local impact was the 2014 Poinsettia Fire. Fiscal Analysis This item is for informational purposes only. There is no fiscal impact.
