Subject The FY 2020 5-Year and Annual Public Housing Agency Plans
Recommended Action
That the Community Development Commission hold a public hearing to consider and accept
public comment and adopt a resolution approving the City of Carlsbad 5-Year and Annual Public
Housing Agency Plan.
Executive Summary
The Housing Services Division of the Community Development Department administers the
federally funded Section 8 Rental Assistance Program' on behalf of the City of Carlsbad Public
Housing Agency. Under federal law, the housing agency is required to file a five-year plan and
an Annual Public Housing Agency Plan to the U.S. Department of Housing and Urban
Development.
These plans provide a basic guide to the housing agency's policies, and the rules and
requirements concerning the Agency's operations, programs and services. In addition, the plans
advise HUD and members of the public about the mission and strategies for serving the needs
of low-income and very low-income families within the housing agency's jurisdiction for each of
the next five years.
On February 13, 2020, the Carlsbad Housing Commission considered the plans and passed a
resolution recommending approval as proposed by staff. (Exhibit 3) The Housing Commission
passed a subsequent minute motion recommending that the City Council explore the feasibility
of implementing a parallel, locally-funded Family Self-Sufficiency program for Carlsbad
residents. A fact sheet from HUD describing the Family Self-sufficiency Program is attached as
Exhibit 5 for the City Council's information.
Under federal law, the plans must be adopted by the local Public Housing Agency's Board of
Commissioners, which for Carlsbad is the Community Development Commission. The City
Council is the legislative body that also serves as the Community Development Commission.
The Community Development Commission last approved the 5-year Plan on April 7, 2015 and
the Annual Plan on April 9, 2019.

Discussion
Plan Goals and Objectives
The 5-Year Public Housing Agency (PHA) Plan identifies quantifiable goals and objectives that
will enable the PHA to serve the needs of low-income (under 80% of the area median income),
very low-income (under 50% ofthe area median income), and extremely low-income (under 30%
of the area median income) families.
The following goals and objectives, which were developed by staff in consultation with the
Housing Commission, and have not changed from last year's report) are as follows:
1. Expand the supply of assisted housing
• PHA will apply for additional Housing Choice Voucher funding, when funds are
made available and the PHA is eligible to apply for such funds
2. Improve the quality of assisted housing
• Improve Voucher Management by continuing to be recognized as a High-
Performing Housing Agency in accordance with HU D's Section Eight
Management Assistance Program performance evaluation
• Improve management functions by streamlining functions and technical
initiatives
• Fully utilize and maintain housing assistance payment costs within HUD-funded
allocations
3. Increase assisted housing choices
• Maintain voucher payment standards to expand assisted housing choices
4. Promote self-sufficiency and asset development of families and individuals
• PHA will continue to voluntarily administer the Family Self-Sufficiency Program
for participants that are transferring into the jurisdiction that are currently on
that FSS program
5. Ensure equal opportunity and affirmatively further fair housing
• Undertake affirmative measures to ensure access to assisted housing regardless
of race, color, religion, national origin, sex, sexual orientation, familial status, and
disability
o PHA will provide educational information about equal opportunity and
fair housing at all Section 8 Program Briefings and Move Briefings
o PHA will provide reasonable accommodations for people with disabilities
and for frail elderly

o PHA will contract with the Legal Aid Society of San Diego, a non-profit
agency that provides advocacy on fair housing and tenant/landlord
mediation issues
Plan Changes from Last Year
Annually, the PHA is required to identify any Plan elements that have been revised since the
last Annual Plan submission. There are two areas that have been revised and are addressed in
the CY 2020 Streamlined Annual PHA Plan elements segment:
• Financial Resources -the amount of funding received for housing assistance payments
and program administration increased slightly since the last reporting period. For CY
2019, the Housing Agency received Annual Contributions totaling $7,192,359 overall
(previously reported $7,170,531). Of that amount, $6,637,580 (previously reported
$6,590,187) was received for rental assistance payments and $554,779 (previously
reported $580,344) for program operating expenses.
• Rent Determination -the amount paid towards household's rental subsidies increased
effective February 1, 2020 in accordance with the Federal Fiscal Year (FFY) 2019
published Small Area Fair Market Rents (SAFMRs). Payment Standards for each zip code
were calculated between 90% and 110% and are as follows:

Th.e PHA also needs to indicate the progress in meeting the goals and objectives identified in
the last approved and adopted 5-Year PHA Plan. The goals and status are described below:
1. Goal -Expand the supply of assisted housing
• The PHA received an allocation of 28 special purpose vouchers specifically for
non-elderly persons with disabilities.
2. Goal -Improve voucher management
• Carlsbad Housing Agency has been designated by HUD as a High Performing
Housing Agency for the last five fiscal years in accordance with HU D's Section
Eight Management Assessment Program (SEMAP) performance evaluation; and
• The PHA converted to a new Section 8 software program to meet the changing
requirements of HUD regulations and/or directives.

3. Goal -Increase assisted housing choices
• The PHA has maintained payment standards between 90% and 110% of the HUD
published Fair Market Rents to ensure voucher holders are able to fully utilize
their assistance and find adequate housing in Carlsbad.
• The City hired a Housing Navigator in December of 2019 to assist rental
assistance participants and residents in locating housing.
4. Goal -Promote self-sufficiency and asset development of families and individual
• The PHA voluntarily administers the Family Self-Sufficiency Program for
participants who have ported into our jurisdiction. Since FY 2015, we have
administered seven FSS participants, two of whom graduated successfully with
escrow accounts.
5. Goal -Ensure equal opportunity and affirmatively further fair housing
· • The PHA had contracted with the Center for Social Advocacy (CSA) and Legal Aid
Society of San Diego to provide Fair Housing counseling, educational Fairs and
Housing seminars for staff, tenants, and landlords. In collaboration with other
North County cities, the San Diego Regional Analysis of Impediments to Fair
Housing has given guidance to the cities and the region to affirmatively further
the goals of fair housing.
• Educational materials are available in the lobby in English and Spanish. The
materials are also included in participant briefing packets.
Additionally, the city will ensure the needs of child and adult victims of domestic violence,
dating violence, sexual assault or stalking are met per the Violence Against Women
Reauthorization Act of 2005.
• Staff has been advised of outside resources available for persons who are victims of
domestic violence, dating violence, and sexual assault or stalking;
• Brochure titled: Violence Against Women Act-What Applicants, Tenants, Owners and
Landlords Need to Know is available in the lobby and is included in briefing and move
packets. Brochure is also available in Spanish.
• HUD form 5380 Notice of Occupancy Rights under the Violence Against Women Act
(VAWA} and HUD form 5382 Certification of Domestic violence, Dating Violence, Sexual
Assault, or Stalking are included in briefing and move packets.
• VAWA Emergency Transfer Plan has been implemented and incorporated into the
Section 8 Administrative Plan.

On February 13, 2020, the Housing Commission passed a resolution recommending approval of
the 5-Year PHA Plan for fiscal years 2020-2025 and the Streamlined Annual Plan for FY 2020
(Exhibit 3). The Housing Commission passed a subsequent minute motion recommending that
the City Council explore the feasibility of implementing a parallel, locally-funded Family Self-
Sufficiency (FSS) program for Carlsbad residents. At the meeting, staff noted to the Housing
Com,mission that this program is a resource intensive activity both in terms of cash assistance to
participants and staff time to administer the program. Presently, resources are not available to
absorb an expanded FSS-style program or conduct a feasibility analysis of establishing a local
program. Should the City Council desire to explore program feasibility, staff would have
difficulty supporting the effort this year, unless other priorities of the Housing Services Division
are adjusted to accommodate it.
A fact sheet from HUD describing the Family Self-sufficiency Program is attached as Exhibit 5 for
the City Council's information.
Fiscal Analysis
The PHA Plan governs the federal funds allocated for administration of the Section 8 Rental
Assistance Program. For calendar year (CY) 2019, the City of Carlsbad's funding allocation was
$6,637,580 for rental assistance payments and $554,779 for program operating expenses. It is
expected that HUD will publish and release the funding allocations for CY 2020 in April. It is
currently anticipated that the amount of funding received for rental assistance payments will
provide rental subsidies for approximately 540 families. Over the last few years, federal
funding for program administration has either stayed the same or declined while program
operating expenses have increased. An operating funding shortfall could impact other city
funds, such as the General Fund or the Affordable Housing Trust Fund. The amount is currently
not determinable.
Next Steps
Once the Plan is approved, the following documents and public comment items are required to be
executed and submitted to HUD with the PHA Plan template (Form HUD-50075-HP):
• Form HUD-50077-ST-HCV-HP, PHA Certifications of Compliance with the PHA Plans and
Related Regulations (which includes all certifications relating to Civil Rights);
• Form HUD-50077-SL, Certification by State or Local Official of PHA Plans Consistency with
the Consolidated Plan or State Consolidated Plan;
• Resident Advisory Board (RAB) comments and a narrative describing the analysis of any
recommendations and decisions made regarding the recommendations; and
• Summary of public comments received during the 45-day review period and public
hearing.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.

Public Notification
The draft FY 2020 !:i-Year Public Housing Agency Plan and Annual Plan were available for public
review and comment for 45 days prior to adoption by the Community Development
Commission. The public review period will end on April 7, 2020 with a public hearing before the
Community Development Commission. Public comments from the public review period and the
public will be included in the final Public Housing Agency Plan submission to HUD.
Information regarding public notifications of this item such as mailings, public hearing notices
posted in the newspaper and on the city website are available in the Office of the City Clerk.

PLAN FOR FISCAL YEAR 2020 AND ANNUAL PHA PLAN FOR SUBMISSION TO

WHEREAS, Housing Services staff, on behalf of the Housing Agency (PHA), administers the Section
8 Rental Assistance Program for the City of Carlsbad; and
WHEREAS, the U.S. Department of Housing and Urban Development (HUD) has issued regulations
requiring Public Housing Agencies (PHA) to submit a 5-year and Annual Plan consistent with the City of
Carlsbad's Consolidated Plan and local objectives; and
WHEREAS, the Department of Housing and Urban Development (HUD) requires that the
Community Development Commission approve the 5-Year and Annual PHA Plans for Fiscal Year 2020 and
authorize execution of the PHA Certifications of Compliance with the PHA Plans and Related Regulations:

policies, or programs that will enable the PHA to serve the needs of child and adult victims of domestic violence,
dating violence, sexual assault, or stalking.

The PHA will continue to comply with VA WA and any new updates on the Act. Staff has been advised of outside
resources available to children and adult victims of domestic violence, dating violence, sexual assault, or stalking.
Staff has been directed to provide referrals to numerous outside agencies as outlined in the City's Emergency Transfer
Plan for persons who are experiencing domestic violence, dating violence, sexual assault, or stalking.
The PHA will continue to provide information to new participants at program briefings and by request. In addition,
fliers will continue to be available in the lobby in both English and Spanish.
Significant Amendment or Modification. Provide a statement on the criteria used for determining a significant
amendment or modification to the 5-Year Plan.
Any change that will significantly and/or negatively impact a majority of the Housing Choice Voucher participants or
waiting list applicants, unless that change is necessary because of funding constraints or regulatory changes.

B.6 Resident Advisory Board (RAB) Comments.
(a) Did the RAB(s) provide comments to the 5-Year PHA Plan?

Housing Commission acting as the Resident Advisory Board recommended that the Community Development
Commission authorize general fund money to institute a Family Self-Sufficiency Program available to all HCV
participants. This recommendation will be reviewed at the Community Development Commission meeting
tentatively scheduled for April 7, 2020.
B.7 Certification by State or Local Officials.
Form HUD 50077-SL, Certification by State or Local Officials of PHA Plans Consistency with the Consolidated
Plan, must be submitted by the PHA as an electronic attachment to the PHA Plan.

Purpose. The 5-Year and Annual PHA Plans provide a ready source for interested parties to locate basic PHA policies, rules, and requirements concerning
the PHA's operations, progran1s, and services, and informs HUD, families served by the PHA, and members of the public of the PHA's mission, goals and

Applicability. Form HUD-50075-HCV is to be completed arumally by HCV~Only PHAs. PHAs that meet the definition of a Standard PHA,

1. Goal -Expand the supply of assisted housing
• The PHA received an allocation of28 special purpose vouchers specifically for non-elderly persons
with disabilities.
2. Goal -Improve Voucher Management
• The PHA received the designation of High Performer for the last 5 fiscal years in accordance with
HUD'.s Section Eight Management Assessment Program {SEMAP) performance evaluation.
• The PHA converted to a new software program to meet the changing requirements of HUD
regulations and/or directives.
3. Goal -Increase assisted housing choices
• The PHA has maintained payment standards between 100% and 110% of the HUD published Fair
Market Rents to ensure voucher holders are able to utilize their assistance and find adequate

community in locating housing.
4. Goal -Promote self-sufficiency and asset development of families and individual
• The PHA voluntarily administers the Family Self-Sufficiency Program for participants who have
ported into our jurisdiction. Since FY 2015, we have administered 7 FSS pa rticipants, two of which
graduated successfully with escrow accounts.
5. Goal -Ensure equal opportunity and affirmatively further fair housing
• The PHA had contracted with the Center for Social Advocacy (CSA) and Legal Aid Society of San
Diego to provide Fair Housing counseling, educational Fair Housing seminars for staff, tenants, and
landlords. In collaboration with other North County cities, the San Diego Regional Analysis of
Impediments to Fair Housing has given guidance to the cities and the region to affirmatively
further the goals of fair housing.
• Educational materials are available in the lobby in English and Spanish. The materials are also
included in briefing packets.

Required Civil Rights Certifications
Acting on behalf of the Board of Commissioners of the Public Housing Agency (PHA) listed below, as its Chairman or other
authorized PHA official if there is no Board of Commissioners, I approve the submission of the XX 5-Year and/or XX Annual PHA
Plan for the P HA fiscal year beginning July, hereinafter referred to as" the Plan", of which this document is a part and make the
following certifications and agreements with the Department of Housing and Urban Development (HUD) in connection with the
submission of the Plan and implementation thereof
1. The Plan is consistent with the applicable comprehensive housing affordability strategy (or any plan incorporating such
strategy) for the jurisdiction in which the PHA is located.
2. The Plan contains a certification by the appropriate State or local officials that the Plan is consistent with the applicable
Consolidated Plan, which includes a certification that requires the preparation of an Analysis of Impediments to Fair Housing
Choice, for the PHA's jurisdiction and a description of the manner in which the PHA Plan is consistent with the applicable
Consolidated Plan.
3. The PHA has established a Resident Advisory Board or Boards, the membership of which represents the residents assisted by
the PHA, consulted with this Resident Advisory Board or Boards in developing the Plan, including any changes or revisions
to the policies and programs identified in the Plan before they were implemented, and considered the recommendations of the
RAB (24 CFR 903 .13). The PHA has included in the Plan submission a copy of the recommendations made by the Resident
Advisory Board or Boards and a description of the manner in which the Plan addresses these recommendations.
4. The PHA made the proposed Plan and all information relevant to the public hearing available for public inspection at least 45
days before the hearing, published a notice that a hearing would be held and conducted a hearing to discuss the Plan and
invited public comment.
5. The PHA certifies that it will carry out the Plan in conformity with Title VI of the Civil Rights Act of 1964, the Fair Housing
Act, section 504 of the Rehabilitation Act of 1973, and title II of the Americans with Disabilities Act of 1990.
6. The PHA will affirmatively further fair housing by examining their programs or proposed programs, identifying any
impediments to fair housing choice within those programs, addressing those impediments in a reasonable fashion in view of
the resources available and work with local jurisdictions to implement any of the jurisdiction's initiatives to affirmatively
further fair housing that require the PHA's involvement and by maintaining records reflecting these analyses and actions.
7. For PHA Plans that includes a policy for site based waiting lists:
• The PHA regularly submits required data to HUD's 50058 PIC/IMS Module in an accurate, complete and timely manner
(as specified in PIH Notice 20 I 0-25);
• The system of site-based waiting lists provides for full disclosure to each applicant in the selection of the development in
which to reside, including basic information about available sites; and an estimate of the period of time the applicant
would likely have to wait to be admitted to units of different sizes and types at each site;
• Adoption of a site-based waiting list would not violate any court order or settlement agreement or be inconsistent with a
pending complaint brought by HUD;
• The PHA shall take reasonable measures to assure that such a waiting list is consistent with affirmatively furthering fair
housing;
• The PHA provides for review of its site-based waiting list policy to determine if it is consistent with civil rights laws and
certifications, as specified in 24 CFR part 903.7(c)(l).
8. The PHA will comply with the prohibitions against discrimination on the basis of age pursuant to the Age Discrimination Act
of 1975.
9. The PHA will comply with the Architectural Barriers Act of 1968 and 24 CFR Part 41, Policies and Procedures for the
Enforcement of Standards and Requirements for Accessibility by the Physically Handicapped.
10. The PHA will comply with the requirements of section 3 of the Housing and Urban Development Act of 1968, Employment
Opportunities for Low-or Very-Low Income Persons, and with its implementing regulation at 24 CFR Part 135.
11. The PHA will comply with acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970 and implementing regulations at 49 CFR Part 24 as applicable.

12. The PHA will take appropriate affinnative action to award contracts to minority and women's business enterprises under 24

out its review under the National Environmental Policy Act and other related authorities in accordance with 24 CFR Part 58
or Part 50, respectively.
14. With respect to public housing the PHA will comply with Davis-Bacon or HUD determined wage rate requirements under
Section 12 of the United States Housing Act of 1937 and the Contract Work Hours and Safety Standards Act.
15. The PHA will keep records in accordance with 24 CFR 85.20 and facilitate an effective audit to determine compliance with
program requirements.
16. The PHA will comply with the Lead-Based Paint Poisoning Prevention Act, the Residential Lead-Based Paint Hazard
Reduction Act of 1992, and 24 CFR Part 35.
17. The PHA will comply with the policies, guidelines, and requirements ofOMB Circular No. A-87 (Cost Principles for State,
Local and Indian Tribal Governments), 2 CFR Part 225, and 24 CFR Part 85 (Administrative Requirement, for Grants and

That the Housing Commission adopt Resolution No. 2020-002 recommending that
the Community Development Commission approve the Carlsbad Public Housing
Agency (PHA) 5-Year Plan and Streamlined Annual Plan for fiscal year 2020 for
submission to the U.S. Department of Housing and Urban Development.
Staff Recommendation: Approve.
After discussion regarding the Family Self-Sufficiency Program, the Housing
Commission decided to approve the Carlsbad Public Housing Agency 5-Year and
Annual Plan as presented by staff, and passed a Minute Motion recommending to
City Council to explore the feasibility of establishing a parallel, locally-funded Family
Self-Sufficiency Program for Carlsbad residents.
Ms. Diane Rivera asked staff how they know that the Veterans did not qualify for the
HUD funds Ms. Nunn had mentioned in her presentation. Ms. Nunn will get a report
from the point-in-time count to show the number of veterans.

2. HOUSING NAVIGATOR
Ms. Bobbi Nunn introduced the recently hired Housing Navigator, Jessica Osborn,
and provided an overview of the role in providing communication and information
about access to housing resources.

Ms. Osborn gave a short description of her new position.
PUBLIC COMMENT: Ms. Diane Rivera spoke regarding the new Housing Navigator
position, recommending it be paid out of the general fund rather than the Housing Trust
Fund.
3. HOUSING ELEMENT UPDATE
The Advisory Committee met on Wednesday, February 12, 2020, and discussed
expectations as well as elected the Chairperson and Vice-Chairperson. The
committee acknowledged the effects of the new housing laws on our Housing
Element update and the challenge to meeting the regional housing needs. The
Housing Element staff is currently working on setting up a separate webpage.

CHAIRPERSON REPORT: Chairperson Nguyen-Cleary noted that the City Council's
approval of the Windsor Pointe funding has generated community concerns. Principal
Planner de Cordova informed the Housing Commission that the City Council directed
the City Manager to schedule a discussion of community concerns with the Windsor
Pointe project at a future City Council workshop meeting. Staff was working on a
Frequently Asked Questions document to post on city's website.
HOUSING SERVICES MANAGER REPORTS:
David de Cordova, Principal Planner, announced that:
• City Council approved the Housing Commission's work plan.
• The next Housing Commission will be held at a different venue. Staff will let the
commission know as soon as the alternate location is determined.

WHEREAS, the Housing Services Division administers the Section 8 Rental Assistance
Program for the City of Carlsbad Housing Agency; and
WHEREAS, the U.S. Department of Housing and Urban Development (HUD) has issued
regulations requiring PHAs to submit a 5-Year and Annual Plan consistent with the City of Carlsbad's
Consolidated Plan and local objectives; and
WHEREAS, federal regulations provide that the 5-Year and Annual Plans must be adopted
by the Carlsbad Community Development Commission and submitted to the U.S. Department of
Housing and Urban Development.

Next Steps
The PHA 5-Year Plan is required to be available for public review and comment prior to a Public
Hearing and adoption by the City Council who acts as the Community Development Commission
for this process. The public review period is 45 days and the 5-Year Plan is due to the Housing and
Urban Development Department (HUD) prior to April 17, 2020. A Public Hearing will be scheduled
when the Community Development Commission hears this item tentatively on April 7, 2020. All
public comments received on the PHA 5-Year and Annual Plan will be addressed and included in
the final documents that will be submitted to HUD.
Environmental Review
Pursuant to Public Resources-Code section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.

Any increases in the family's rent as a result of increased earned income during the family's
participation in the program result in a credit to the family's escrow account. Once a family
graduates from the program, they may access the escrow and use it for any purpose.
Who administers the FSS program?
The FSS program is administered locally by PHAs in collaboration with the PCC. The PCC is
made up of an array of organizations and the composition may vary by PHA. Some of the most
common PCC partners include:
• Workforce Investment Boards
• Financial Literacy and Credit Counseling Providers
• City or County Government
• City or County Human Services/TANF Agency
• City or County Departments of Health and Mental Health
• Community and/or 4-Year Colleges
Regulations require that the PCC include representatives from the PHA and public housing
resident representatives (or HCV participants if the PHA serves HCV families under their FSS
program). The PCC assists the PHA in developing the FSS action plan and operating procedures
and in identifying service gaps and securing service commitments from public and private
resources.

administered.
Who is eligible to participate in the FSS program?
The FSS program is available to Public Housing (PH) residents, Housing Choice Voucher
(HCV) program participants, residents ofNAHASDA-assisted housing, and, recently, residents
of project-based rental assistance (PBRA) projects.
How do families enroll in the program?
Eligible families should discuss participation in the FSS program with their local PHA. For a
list of PHAs and Tribes that have received FSS funding from HUD between 2011 and 2015, click
here. Please note that FSS funding for tribes is only applicable to the PH FSS program. Also
note that if you are a PBRA resident you will need to contact the PBRA owner of the property
where your unit is located (if different than the PHA) for more information, click here.

Can a PHA use a selection preference to select families for the FSS Program?
PHAs can give a selection preference, for up to 50 percent of their PSS slots, to eligible families
with one or more family members enrolled in, or on the waiting list for, an PSS-related service
program. If the PHA chooses to use a selection preference, it must include in its Action Plan the
information listed in 24 CPR §984.203(a)(l)-(3). The remaining PSS slots must be filled using an
objective selection system such as a lottery, the length of time the family has lived in subsidized
housing, or the date the family expressed an interest in participating in the FSS program.
How are families selected if the PHA does not use a selection preference?

Can PHAs screen families for participation in the FSS program?

motivation. The PHA may not screen for education, job history, credit rating, marital status, or
number of children, for example, and may not consider any factors which may result in
discriminatory practices or treatment toward individuals with disabilities or minority or non-
minority groups.
What is an FSS contract of participation?
One of the basic requirements of the PSS program is execution of an PSS contract of
participation between the Head of the PSS family and the PHA. The PSS contract of
participation includes the rights and responsibilities of the FSS family and the PHA, the services
to be provided to the family, and the activities to be completed by the family.
What is the term of the FSS contract of participation?
The term of the PSS contract is up to five years; however, such term may be extended for up to
two more years provided that there is good cause for the extension, such as serious illness or
involuntary loss of employment. Participants may also successfully graduate in less than five
years.

This memorandum provides information related to the FY 2020 5-Year and Annual Public Housing
Agency Plans.
Violence Against Women Act (VAWA)
Question: How does the Carlsbad Housing Agency provide information and resources to the
participants on the Section 8 Rental Assistance Program regarding the Violence Against Women
Act?.
Answer: As part of the initial intake process for new Section 8 participants and upon annual
recertification of existing participants, city staff provide formal notices to participants which
address the occupancy rights of persons who may fall under the protection of VAWA.
Additionally, an informational flier regarding VAWA is available at the Housing Services Division
public counter at 1200 Carlsbad Village Drive. The flier, "Violence Against Women Act -What
Applicants, Tenants, Owners, and Landlords Need to Know", is printed in English and Spanish and
explains the rights and protections provided by VAWA.
All current landlords have been informed of their rights and obligations under VAWA, and such
information is included in marketing packets that are sent to new landlords.·
The City has implemented and incorporated into the Public Housing Agency Administrative Plan
an "Emergency Transfer Plan" which provides procedures to allow a family to move under the
VAWA protection without fear that they will lose their housing assistance. The Emergency
Transfer Plan will expedite an impacted family's ability to transfer their rental assistance to
another jurisdiction to remove the family from a dangerous situation. This means that the
impacted individual or family may move even if their lease has not ended, without penalty.
Finally, city staff maintain a list of services and resources to share with victims of domestic
violence, dating violence, and sexual assault or stalking.
