Recommended Action
Adopt a resolution appointing one member to the Planning Commission.
Executive Summary
CA Review ~
Commissioner Peter Merz was initially appointed to the Planning Commission in September
2018 to fill the unexpired term of Commissioner Black for a term ending in January 2020.
Commissioner Merz is eligible for reappointment for a term ending in January 2024.
The City Clerk's office received 11 applications from residents wishing to serve on the Planning
Commission. Pursuant to City Council Policy No. 88, the Mayor has recommended the following
two residents to advance in the process and interview with the full City Council:
• Peter Merz (wishes reappointment) -District 4
• Brian Colby -District 3
Exhibit 2 includes applications for both residents.
Discussion
Government Code Section §54970-54974, known as the Maddy Act, requires that on or before
December 31 of each year the legislative body shall prepare a Local Appointments List which
contains the appointive terms of Board and Commission members which will expire in the next
calendar year. The name of the incumbent appointee, the date of appointment and the term
expiration date is also included on the list. Based on the prepared list, the City Clerk's Office
accepts applications (available on the city's website and in the City Clerk's Office) for any
upcoming vacancies.
CMC Section 2.15.050(2) states, "Although each member ofthe City Council elected by a district
shall use his or her best efforts to appoint individuals residing in that district to these
commissions, members of the City Council may appoint individuals not residing in their districts
in their discretion in order to assure that the most interested and qualified individuals serve on
the commissions."

According to City Council Resolution No. 2018-178, this Planning Commission scheduled
vacancy shall be appointed by the Mayor with the approval of the City Council. The Planning
Commission shall consist of seven members, and of four ex officio members who shall be the
Community Development Director, City Engineer, City Attorney and City Planner.

Members of the Planning Commission are subject to the provisions of the Political Reform Act
and must file a Statementof Economic Interests annually, and complete two hours of ethics
training every two years.

None.
Next Steps
Following the appointment of one member to the Planning Commission, the City Clerk's Office
will update the Commission roster, coordinate the Oath of Office, filing of the appointee's
Statement of Economic Interest and Ethics Training Certificate.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
Public Notification and Outreach
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.

for the Carlsbad City Planning Commission. I have known and have had the good fortune to work with
Peter in my day job as a Land Broker at Lee & Associates in Carlsbad. Peter has the traits that I believe
you are looking for in a future Planning Qommissioner. He is highly intelligent, and as a commercial
real estate agent, experienced in many of the planning issues that he would face if appointed to the
Commission. Additionally, he is impartial, considerate, thorough and most importantly, a conscious
human being.
Having several years of experience as a current Planning Commissioner in the City of Encinitas, I know
the challenges he will face and the tough decisions he will need to make that won't always be popular.
If Council has the foresight to appoint Peter Merz, I am highly confident he will exceed your expectations
