Executive Summary This item presents a Resolution authorizing the formation of a standing City Council Legislative Subcommittee, as directed by the City Council on April 16, 2019. Discussion On April 16, 2019, the City Council directed staff to establish a standing City Council Legislative Subcommittee. Staff is proposing that the duties of the subcommittee would include working closely with staff and the city's legislative consultants to: 1. Review City Council Policy No. 39 -Legislative Program and recommend amendments to the City Council; 2. Conduct an annual review of the City of Carlsbad Legislative Platform and recommend amendments to the City Council; 3. Continuously monitor State and Federal proposed legislation and make recommendations to the City Council to identify high priority bills and advocacy positions on bills not addressed by the Legislative Platform; and 4. Proactively seek to identify local and regional legislative needs and recommend bill sponsorship opportunities to the City Council. Formation of a subcommittee would allow the appointed City Council Members to undertake more in-depth examinations of proposed State and Federal legislation, and to consult with staff, consultants and other subject matter experts. Based upon that work, the subcommittee would be tasked to prepare reports and recommendations concerning proposed legislation for consideration by the full City Council. July 23, 2019 Item #15 Page 1 of 6 The subcommittee would continue indefinitely, and would only be dissolved at the direction of the City Council. Beginning in 2020, and in each even-numbered year thereafter, members of the City Council would be appointed to the Legislative Subcommittee upon reorganization of the City Council, pursuant to Carlsbad Municipal Code Section 2.04.050. To establish a standing City Council Subcommittee, the City Council may appoint no more than two City Council members. As a standing subcommittee, the duration of the subcommittee shall be indefinite. The City Council has the discretion to set the purview of the subcommittee to be narrow, broad or anything in between. As the subcommittee will be a standing subcommittee, the subcommittee must comply with all the requirements of the Brown Act. Regularly scheduled meetings of the subcommittee must be preceded by the posting of their agenda 72 hours in advance. Special meetings to respond to urgent legislative issues can only take place after publicly posting the agenda for at least 24 hours in advance. In addition, because City Council Policy No. 39 (Exhibit 2) establishes the guidelines of the city's legislative program and outlines the procedure by which the city is to act on pending legislation with no mention of a subcommittee's involvement, the City Council must also amend Council Policy No. 39 to incorporate the role ofthe Legislative Subcommittee. As such, it is recommended that, if the City Council approves the formation of a Legislative Subcommittee, the subcommittee's first item of business would be to review and recommend changes to City Council Policy No. 39. Any recommended changes to City Council Policy No. 39 by the Legislative Subcommittee or the full Council will require four affirmative votes of the City Council pursuant to City Council Policy No. 1 (Exhibit 3). Fiscal Analysis None. Next Steps The Legislative Subcommittee will receive information and advise the City Council on legislative matters.· Environmental Evaluation (CEQA) Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. BACKGROUND: Historically, the City handled legislation in an ad hoc procedure. As the number of bills the City addressed increased, so did the need to establish a program that more efficiently and effectively handled legislative matters. Staff researched the programs of several cities in San Diego Country to develop an appropriate and flexible program for Carlsbad. POLICY: 1. Participate in the County Legislative Coalition, which will serve to promote the unified position of municipalities in San Diego County to the State and Federal legislature. 2. Adopt a legislative platform expressing the City's general legislative concerns. 3. The Mayor or his/her designee will review specific bills for consistency with the platform. Bills of interest to the City not covered by the platform shall be forwarded to the entire City Council for consideration. 4. Only the City Council may authorize a letter be sent on behalf of the City to oppose or support legislation. H a Board, Committee, Commission or advisory group believes the City should send such a letter, staff members for that group will forward the request to the City Manager's Office. The request will be processed according to this policy.
