Executive Summary This item presents a Resolution authorizing the formation of an Ad-Hoc City Council Carlsbad Municipal Code and City Council Policy Update Subcommittee, as directed by the City Council on January 8, 2019. Discussion On January 8, 2019, the City Council approved a Minute Motion directing staff to return with an agenda item to appoint members of an Ad-Hoc City Council Carlsbad Municipal Code and City Council Policy Update Subcommittee. Ad-hoc committees are not subject to the Brown Act notice and posting requirements so long as the committee is: {1) comprised solely of members of the City Council (i.e., no staff and no members of the public); (2) consists of no more than two members of the City Council; (3) has a defined purpose and a limited time frame to accomplish that purpose; and (4) is advisory, (i.e., has not been delegated any decision-making power and will be returning to the full City Council with its recommendations). On May 23, 2017, two former members of the City Council were appointed by a City Council Minute Motion to serve on an ad-hoc subcommittee to work with staff on updating Chapters 1 and 2 of the Carlsbad Municipal Code. July 23, 2019 Item #11 Page 1 of 3 Given that the work of the prior subcommittee ended upon conclusion of the former City Council members' terms of office, that subcommittee also ceased to exist at that time. As such, this Resolution serves to authorize the formation of a new ad-hoc subcommittee, appoints two City Council members to serve on the subcommittee, and defines the subcommittee's duties and limited duration, as required. The duties of the subcommittee would include working with staff to conduct a review of the Carlsbad Municipal Code and City Council Policies, to identify sections of the code and policies in need of updating, and to recommend amendments for consideration by the full City Council. The subcommittee would automatically be dissolved upon completing an update of the Carlsbad Municipal Code and City Council Policies. Beginning in 2020, members of the City Council would be appointed annually to the Carlsbad Municipal Code and City Council Policy Update Subcommittee upon reorganization of the City Council, pursuant to Carlsbad Municipal Code Section 2.04.050. Fiscal Analysis None. Next Steps The Ad-Hoc Subcommittee will conduct a review of the Carlsbad Municipal Code and City Council Policies and recommend amendments to the City Council. Environmental Evaluation (CEQA) Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to scheduled meeting date. Exhibits 1. City Council Resolution July 23, 2019 Item #11 Page 2 of 3 RESOLUTION NO. 2019-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AUTHORIZING THE FORMATION OF AN AD-HOC CITY COUNCIL CARLSBAD MUNICIPAL CODE AND CITY COUNCIL POLICY UPDATE SUBCOMMITTEE WHEREAS, the City Council of the City of Carlsbad, California has determined that formation of an ad-hoc City Council subcommittee is needed to conduct a review of the Carlsbad Municipal Code and City Council Policies, identify code sections and policies in need of updating, and recommend amendments to the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That a City Council ad-hoc subcommittee comprised of the following two City Council members is hereby formed: (a) Council Member Blackburn; (b) Council Member Schumacher 3. Beginning in 2020, members of the City Council shall be appointed annually to the Carlsbad Municipal Code and City Council Policy Update Subcommittee upon reorganization of the City Council, pursuant to Carlsbad Municipal Code Section 2.04.050. 4. That the duties of the ad-hoc subcommittee will include working with staff to conduct a review of the Carlsbad Municipal Code and City Council Policies, identify code sections and policies in need of updating, and recommend amendments to the City Council; and 5. That the ad-hoc subcommittee will automatically be dissolved upon completing an update of the Carlsbad Municipal Code and City Council Policies. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 23rd day of July, 2019, by the following vote, to wit: AYES: Hall, Blackburn, Bhat-Patel, Schumacher, Hamilton.
