Adopt a Resolution appointing one member to the Agricultural Conversion Mitigation Fee Ad
Hoc Citizens' Committee (Committee).
Executive Summary
On January 8, 2019, Committee Member Brian Flock submitted his resignation, leaving an
unexpired term on the Committee with an expiration of August 2021. The City Clerk's office has
received one application from the following resident (Exhibit 2) wishing to serve on the
Committee:

Discussion
Government Code Section §54970-54974, known as the Maddy Act, requires that on or before
December 31 of each year, the legislative body shall prepare a Local Appointments List which
contains the appointive terms of Board, Commission and Committee members which will expire
in the next calendar year. The name of the incumbent appointee, the date of appointment and
the term expiration date is also included on the list. Based on the prepared list, the City Clerk's
office accepts applications (available on the City's website and in the City Clerk's office) for any
upcoming vacancies.
City of Carlsbad Resolution No. 2005-242 states that the Committee shall consist of seven at-
large members, appointed by the Mayor with the approval of the City Council. Therefore, an
appointment to fill one unscheduled vacancy is now required.

Next Steps
Following the appointment of the new member to the Agricultural Conversion Mitigation Fee
Ad Hoc Citizens' Advisory Committee, the City Clerk's office will update the Commission roster
and coordinate the Oath of Office, filing of the appointee's Statement of Economic Interest and
Ethics Training Certificate.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
Public Notification and Outreach
The City Clerk's office advertised this vacancy on the City's website from January 15 through
February 15, 2019, and extended the vacancy notice through March 22, 2019, receiving no
applications. The Clerk's office advertised the vacancy again from March 22 through April 19,
2019 receiving only one application. With each revised vacancy notice, a Public Notice was sent
out on our website.
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.

RESOLUTION NO. 2019-154
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPOINTING ONE MEMBER TO THE AGRICULTURAL
CONVERSION MITIGATION FEE AD HOC CITIZENS' ADVISORY COMMITTEE
WHEREAS, Committee Member Brian Flock was initially appointed to the Agricultural
Conversion Mitigation Fee Ad Hoc Citizens' Advisory Committee in August 2017; and
WHEREAS, Committee Member Brian Flock resigned on January 8, 2019; and
WHEREAS, there is currently one unscheduled vacancy on the Agricultural Conversion
Mitigation Fee Ad Hoc Citizens' Advisory Committee; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the following Carlsbad resident is hereby appointed to serve on the Agricultural
Conversion Mitigation Fee Ad Hoc Citizens' Advisory Committee, for a term ending in
August 2021 or when all mitigation funds have been allocated, whichever comes first.

ARTS: Over the past 25 years, I've been creating art -and managing the .creation of art, for video games, TV, film, and a variety

and other videos for his campaign. While in Pasadena, I also worked with NASA to create a STEAM-based hackathon event
