Appoint Two Members to the Traffic Safety Commission
Recommended Action
Adopt Resolutions appointing two members to the Traffic Safety Commission.
Executive Summary
CA Review ~
At the September 25, 2018 Council Meeting, Ordinance No. CS-342 was agopted adding two
new positions to the Traffic Safety Commission. Resolution No. 2018-178 established a
transition plan for the appointment of new members to the Traffic Safety Commission. The
Resolution states that as the terms expire for members of the Traffic Safety Commission, the
most recently elected district Council Member or Mayor will nominate the new members. The-
term of the newly nominated members will be set to begin in February and expire at the time
the nominating Council Member's term expires. At this time, the two new District Council
Members from District 1 and District 3 will make the appointment nominations.
Carlsbad Municipal Code Section 2.15.050(2) now states, "Although each member of the City
Council elected by a district_shall use his or her best efforts to appoint individuals residing in
that district to these commissions, members of the City Council may appoint individuals not
residing in their districts in their discretion in order to assure that the most interested and
qualified individuals serve on the commissions."
The City Clerk's office received applications from the following residents wishing to serve on the
Traffic Safety Commission (Exhibit 3):

Discussion
Government Code Section §54970-54974, known as the Maddy Act, requires that on or before
December 31 of each year the legislative body shall prepare a Local Appointments List which
contains the appointive terms of Board and Commission members which will expire in the next
calendar year. The name of the incumbent appointee and the date of appointment and the

term expiration date is also included on the list. Based on the prepared list, the City Clerk's
office accepts applications (available on the City's website and in the City Clerk's office) for any
upcoming vacancies.
Other members of the Traffic Safety Commission are: Bill Fowler, Monica Gocan, Chuck Hunter,
Jonnie Johnson and Peter Penseyres. Members of the Traffic Safety Commission are subject to
the provisions of the Political Reform Act and must file a Statement of Economic Interests
annually, and complete two hours of ethics training every two years.

None.
Next Steps
Following the appointment ofthe two members to the Traffic Safety Commission, the City
Clerk's office will update the Commission roster and coordinate the oath of office and filing of
the appointees Statement of Economic Interest and ethics training certificates.

I'm an avid cyclist, a runner, a competitive athlete (Gold & Bronze medalist at the US Olympic Festival) and a proud
parent with a receptive ear when it comes to road safety and transportation issues. I have spent countless hours in
the community as an advocate for cycling as a mea·ns for bike safety and for transportation. As this city continues to
grow, there is a propensity for pedestrians and traffic to interact more and subjecting themselves to risk. To be on
the front line for traffic and pedestrian safety for the City of Carlsbad would be a civic participation worthwhile. I am
privileged to live in a great community and it would be an honor to serve at the pleasure of the Mayor and City
Council as a member of the Traffic Safety Committee for the City of Carlsbad.

I will not be able to attend the Council meeting at 4p on Tuesday. Could you please forward the following note to the
Mayor and Council members?
My application for Traffic Safety Commission (TSC) was inadvertently left out of your original agenda packets
due to a filing error at the City. I have been told that you will be considering the applications at a 4 PM meeting
on Tuesday, which I am unable to attend. However, if you have any questions for me, I am happy to answer
them via email, telephone, or in-person interview.
I noted that the positions being considered may be specific to Districts 1 and 3. I live in District 4, but I can
pledge to represent the interests of any district on the TSC and to voluntarily give up my position at any point. I
have closely followed traffic issues in Carlsbad and surrounding communities for many years. As a scientist, I am
very data-driven and have delved deeply into traffic-related studies and policies.

recreational, quasi-governmental, and political activities. In addition, I have worked for the
Burnham Institute and multiple start-up biotechnology companies in the area of cancer
diagnostics.

If appointed, my primary goal would be to achieve, in a fiscally responsible way, the
proper balance of safety ~nd aesthetics for local re.sidents with efficient service for
pedestrian, bicycle, vehicle, and mass transit users, which is dependent on the context
of the individual roadways.

Question:
Should an applicant being considered for appointment to a Commission or Committee be
disqualified from consideration based on the fact that he/she has a relationship with certain
organizations in the city?
Answer:
No. The city is not aware of any specific information related to any individual applicant and
organization that would create a conflict of interest such that the applicant could not fulfill the
mandates of serving on a Commission or Committee. Therefore, no current applicant should be
generally disqualified from consideration by the City Council.
That is not to say that, if appointed to a Commission or Committee, an applicant could have a
conflict of interest on specific items and/or issues that may come before the Commission or
Committee. If that were to occur, the selected applicant must recuse themselves from
participating in those items. To help ensure that no conflict of interest issue arises, all members
of Comm1ssions and Committees receive ethics training, are subject to the California Political
Reform Act and must file a Statement of Economic Interests annually.
Because the city and the City Coun.cil may not have all relevant information to judge an
applicant's potential conflicts of interest, at the meeting, City Council Members are free to ask
any applicant whether or not he/she is aware of any information that would pose a conflict of
· interest if he/she were selected to serve on a Commission or Committee. '

Feedback related to the committee and commission selection hearings
Dear Mayor and Councilmembers,
I am writing to you today to provide you feedback related to the Committee and Commission selection hearings that
took place yesterday, February 12, 2019. As the elected and paid leaders of a vibrant, healthy community, it is
incumbent upon you to develop transparent methods to select those whom you appoint to committees,
commissions, and boards. I found the application and selection process to be ill conceived and poorly
administered. I put myself in your shoes and I struggle to see how that process gave you the information that you
needed to make an informed decision. I am writing this letter in good faith and in the hope that the selection
process can be improved.
You need to be the protagonists of the selection process. I have served on multiple selection panels related to
government functions and employment and the first step is to determine what you are looking for in applicants and
set out a selection process that will capture them. Create a consistent scoring rubric and share the basics of the
rubric with the applicants.
This is also necessary to avoid impartiality and the appearance of impartiality. If none ofthe applicants knows on
what they are being judged, there is no way to be assured that the process is fair or that you really are getting the
best candidates. For example, some of the Planning Commission applicants spoke with broad brush strokes about
policy, some spoke of personal experience, some spoke of prior political experience, but nobody spoke to
everything. If the applicants did not cover the same ground, the point of the hearing is lost. You were left
comparing apples to oranges and I was left thinking that I would not want to cast such an important vote for my
community on such low-quality, inconsistent information.
You need to take control of the process and get information from the applicants that you know to be relevant instead
of waiting for applicants to produce information that might be relevant. My suggestion would be that you develop a
blind application and rank the applicants. Then, call in the top applicants for a structured interview (or hearing) that
drills down on the attributes that you think are important and score them accordingly.
I thank you for taking the time to read this letter and I hope you will reflect upon my feedback and consider my
recommendations. I wish you well.

Thank you for this email. I was already aware that I was not selected having been present at the council meeting to which
I was invited and as the appointments were made. I signed in and spoke and I note that your office was present and
monitored the process.
It became clear that the decisions had in effect already been made before the event and that persons appointed did not
have to be present at the meeting. The latter is something that was not made known to applicants and should be.
Unless there is useful purpose in conducting what turns out to be an unnecessary open vetting, then the actual decision
process needs to be described accurately and publicly announced.
I would appreciate your providing a copy of this reply to the City Council members for their consideration. If you are
unable to do so within your scope of duties I would appreciate your so notifying me.
I noted that certain questions on the form are apparently of a pass/go nature for some council members but not
others. Nothing stated by the Council members demonstrated that a uniform process had been undertaken before hand
such as a review and comparison of all applicants submitted data or use of any qualifying or disqualifying standards
applied for such a process. It may be useful in the future to announce desirable qualifications for each commission to
guide those wishing to serve.
I found it odd that all candidates were asked by the Mayor to react to a posted adage in the Chamber which was as
offensive and foolish as it was empty of logic. it seemed to suggest that the public voice was less valid than whatever was
assumed to be right in Council decisions which any review of its past actions would make it clearly absurd as a standard.
I wish to remain on the lists as submitted in the event my service are needed. I would appreciate your notifying me of
vacancies to any of the commissions checked on my application.
