Executive Summary CAReview WV Commissioner Marty Montgomery was initially appointed in February 2003 to fill the unexpired term of Commissioner Trigas. He was then reappointed in March 2003 and April 2007. Commission Montgomery also returned in June 2014 to fill the unexpired term of Commissioner Schumacher. Commissioner Jeff Segall was initially appointed in February 2013 to fill the unexpired term of Commissioner Arnold. He was then re~ppointed in April 2015. Both Commissioners are not eligible for reappointment. Resolution No. 2018-178 established a transition plan for the appointment of new members to the Planning Commission. All member's terms will expire in February allowing new members to attend the League of California Cities Planning Commissions Academy shortly after being appointed. The Resolution also states that as the terms expire for members of the Planning Commission, the most recently elected district Council Member or Mayor will nominate a new member. The term of the newly nominated member will be set to begin in February and expire at the time the nominating Councilperson's term expires. At this time, the two new District Council Members from District 1 and District 3 will make the appointment nominations. Carlsbad Municipal Code Section 2.15.050(2) now states, "Although each member of the City Council elected by a district shall use his or her best efforts to appoint individuals residing in that district to these commissions, members of the City Council may appoint individuals not residing in their districts in their discretion in order to assure that the most interested and qualified individuals serve on the commissions." The name of the incumbent appointee and the date of appointment and the term expiration date is also included on the list. Based on the prepared list, the City Clerk's office accepts applications (available on the City's website and in the City Clerk's office) for any upcoming vacancies. Carlsbad Municipal Code Chapter 2.24 states that the Planning Commission shall consist of seven members to be appointed by a majority vote of the Council, and of four ex officio members who shall be the Community & Economic Development Director, the City Engineer, the City Attorney and the City Planner. Other members of the Planning Commission are: Velyn Anderson, Linda Geidner, Carolyn Luna, Roy Meenes, and Peter Merz. Members of the Planning Commission are subject to the provisions of the Political Reform Act and must file a Statement of Economic Interests annually, and complete two hours of ethics training every two years. Fiscal Analysis None. Next Steps Following the appointments to the Planning Commission, the City Clerk's office will update the Commission roster and coordinate the Oath of Office and completion of the ethics training course. Environmental Evaluation {CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change February 12, 2019 Item #2 Page 2 of 62 in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. In this capacity, one of my responsibilities is to provide spokespersons training to community members wishing to speak in front of a planning commission or city council. Therefore, I am familiar with this part of the civic process. I use GIS as a valuable tool in analyzing community issues (crime, AOD, food deserts, etc.) to make evidence·based policy recommendations to policy-makers. With respect to Carlsbad, I have lived in what is now District 4 for over nineteen years, maintain a professional office in District 2, and own commercial property in The Village area of District 1. I shop at the Carlsbad Premium Outlets, Costco, and The Forum Carlsbad, have bought three cars in Carlsbad Car Country, eat at Carlsbad restaurants, and attend the TGIF Concerts in the Parks. I graduated from the Citizens Academy last spring. I know Carlsbad and its city government! My professional background and knowledge of Carlsbad would be an asset to the Planning Commission. Extensive experience in administrative hearings would enable me to collaborate with other commissioners in making fair, legally sound decisions in quasi-adjudicative permit application hearings. I also would be able to get quickly up to speed on the pressing land use issues soon coming before the Planning Commission, including the proposed LCP Amendment regarding airports and possible changes to the city's growth management standards to respond to regional requirements for affordable-housing. Joe was an excellent team player, very knowledgeable, and well-prepared at all times. When Planning Commission testimony became heated or in the face of threats of litigation, I particularly admired Joe's composure to objectively and intelligently analyze the facts in light of applicable law to provide legal guidance in a cool and thoughtful manner. Having served as the Oceanside Planning Commission legal adviser for five years, Joe is well aware of and familiar with the broad spectrum of matters that come before a planning commission. Our North County stores are heavily involved in supporting local nonprofit, youth, and other community projects. This letter is written in support of Joseph Stine in his application for appointment to the Carlsbad Planning Commission. I have !mown Mr. Stine for over seventeen years. In 2002, I hired him as my attorney to represent me in an application through the City of Vista for a permit to operate an outdoor barbeque at my Vista store. He demonstrated a keen knowledge of code enforcement and other city processes. I also was impressed by the way he worked on my behalf with city public officials and staff. He did an excellent job representing me at hearings before the Vista Planning Commission and City Council. Through his efforts, I obtained the permit to operate the barbeque that is critical to my business success. Over the years, Mr. Stine also has become a close friend and confidant who regularly visits me at the Vista store, Together, for the past five years, we have enabled a blind young athlete from a modest income Fresno family to compete in a triathlon held each May on Mission Bay. She is a straight "A" middle school student and inspires children with serious physical challenges to live full, active lives. Answer: No. The city is not aware of any specific information related to any individual applicant and organization that would create a conflict of interest such that the applicant could not fulfill the mandates of serving on a Commission or Committee. Therefore, no current applicant should be generally disqua lified from consideration by the City Council. W ith sincerest t hanks, Ed Hanlon 760-805-5066 1 Statement of Edward Hanlon Jr., Applicant for the Planning Commission Members of the City Council, My apologies for being unable to attend in person this Council Session intended in part to interview applicants for the Planning Commission. Due to a long planned business meeting in NYC 12-14 February, I must request your understanding as I simply did not have time to make other arrangements. It was suggested that I provide a brief statement as to my background and reasons for submitting my application. My wife and I live on Highland Drive and have since September 2012 as we repatriated from Brussels, BE where I had been assigned while on active duty in the Marines and later served as the senior executive of a major US Corporation in Europe. Previous to that, we lived in Carlsbad from July 1981 through July 1987. She and I are both graduates of the Citizens Academy which we did within the first year of our return to Carlsbad in 2012. My professional life was 39 years in the Marine Corps followed by six years as a Vice President of Raytheon International in Europe as their senior executive. In the Marine Corps I had the distinct privilege of Commanding Camp Pendleton, (CPEN) CA from 1998 until 2001 when I was then reassigned to Quantico, VA. As the Commanding General of Camp Pendleton, I came in frequent contact with the mayors and City Councils of San Clemente, Oceanside, San Marcos, Vista, Encinitas, Del Mar, Solana Beach, San Diego County and of course Carlsbad. I, along with my staff, worked with SAN DAG, agencies/departments of the State of CA as well as federal agencies. Understanding the regulations, laws, policies, and constraints of outside regulatory agencies is absolutely essential to success. During the period of 1998 onward, Camp Pendleton began a major revamping of the base and infrastructure, one example being base housing which was 100% rebuilt or replaced, and became the model for other DoD bases and stations around the US. To put this into perspective, CPEN is larger than Carlsbad, Del Mar, Encinitas, Escondido, Oceanside, San Marcos, Solana Beach and Vista combined. The planning and coordination to accomplish this modernization on schedule and in budget, was substantial. Needless to say, this occurred across federal, state and local jurisdictions and today CPEN is a modern and vibrant military installation--and neighbor--with numerous Carlsbad residents assigned to military and civilian jobs aboard the base. During my tenure at CPEN I came in contact with Carlsbad and their master "General Plan" and watched as the city disciplined itself to adhere to their plan to include the financial underpinnings of this plan. Having lived in the city '81-'87, then watched from CPEN '98-'01, and living here again 2012 until now, I remain impressed and forever thankful to the countless men and women on the Council, previous commissions, and city staff, who have made that General Plan become reality. The reality is that Carlsbad is recognized as one of the most successful and family oriented communities in the State of California. As I noted above, being a graduate of the Citizens Academy allowed me to meet the employees who serve us and protect us and I came away with a deep appreciation for the commitment to excellence that permeates the entire city. The reason we moved back to Carlsbad was that after 45 years living around the US and in four foreign countries, we realized this was where we wanted to call home. The reason I respectfully submit my application for the Planning Commission, knowing full well that there are many highly qualified fellow citizens, is that it is the right thing to do as a citizen and if selected, to continue to prepare for the future. Bottom line: never stop serving. Former President Dwight David Eisenhower, famous for his detailed planning in the Army, once said "Plans are worthless, but planning is everything". His lesson from this was that a plan is a piece of paper but the planning process demands the thorough examination of options and opportunities. The knowledge gained during this process is crucial to the selection of viable courses of action." My take away from this is that the City's General Plan provides a solid foundation based on sound analysis and planning over the years. I fully adhere to this process and discipline. However, the City Council, the Planning Commission, the planning and city staff and fellow citizens must stay engaged to ensure the General Plan brings the future into the present and thrives in an everchanging environment. The other major organization I serve on in California is as Vice Chair of the Governor of California's Military Advisory Council and have served since 2013. I also serve on the Board of Advisors of the San Diego Military Advisory Council (SDMAC). I serve also on the national Board of Directors of the Military Officers Association of America (MOAA). As the elected and paid leaders of a vibrant, healthy community, it is incumbent upon you to develop transparent methods to select those whom you appoint to committees, commissions, and boards. I found the application and selection process to be ill conceived and poorly administered. I put myself in your shoes and I struggle to see how that process gave you the information that you needed to make an informed decision. I am writing this letter in good faith and in the hope that the selection process can be improved. You need to be the protagonists of the selection process. I have served on multiple selection panels related to government functions and employment and the first step is to determine what you are looking for in applicants and set out a selection process that will capture them. Create a consistent scoring rubric and share the basics of the rubric with the applicants. This is also necessary to avoid impartiality and the appearance of impartiality. If none ofthe applicants knows on what they are being judged, there is no way to be assured that the process is fair or that you really are getting the best candidates. For example, some of the Planning Commission applicants spoke with broad brush strokes about policy, some spoke of personal experience, some spoke of prior political experience, but nobody spoke to everything. If the applicants did not cover the same ground, the point of the hearing is lost. You were left comparing apples to oranges and I was left thinking that I would not want to cast such an important vote for my community on such low-quality, inconsistent information. You need to take control of the process and get information from the applicants that you know to be relevant instead of waiting for applicants to produce information that might be relevant. My suggestion would be that you develop a blind application and rank the applicants. Then, call in the top applicants for a structured interview (or hearing) that drills down on the attributes that you think are important and score them accordingly.
