Recommended Action
Adopt Resolutions appointing two members to the Planning Commission.
Executive Summary
CAReview WV
Commissioner Marty Montgomery was initially appointed in February 2003 to fill the unexpired
term of Commissioner Trigas. He was then reappointed in March 2003 and April 2007.
Commission Montgomery also returned in June 2014 to fill the unexpired term of
Commissioner Schumacher. Commissioner Jeff Segall was initially appointed in February 2013
to fill the unexpired term of Commissioner Arnold. He was then re~ppointed in April 2015.
Both Commissioners are not eligible for reappointment.
Resolution No. 2018-178 established a transition plan for the appointment of new members to
the Planning Commission. All member's terms will expire in February allowing new members to
attend the League of California Cities Planning Commissions Academy shortly after being
appointed. The Resolution also states that as the terms expire for members of the Planning
Commission, the most recently elected district Council Member or Mayor will nominate a new
member. The term of the newly nominated member will be set to begin in February and expire
at the time the nominating Councilperson's term expires. At this time, the two new District
Council Members from District 1 and District 3 will make the appointment nominations.
Carlsbad Municipal Code Section 2.15.050(2) now states, "Although each member of the City
Council elected by a district shall use his or her best efforts to appoint individuals residing in
that district to these commissions, members of the City Council may appoint individuals not
residing in their districts in their discretion in order to assure that the most interested and
qualified individuals serve on the commissions."

Discussion
Government Code Section §54970-54974, known as the Maddy Act, requires that on or before
December 31 of each year the legislative body shall prepare a Local Appointments List which
contains the appointive terms of Board and Commission members which will expire in the next
calendar year. The name of the incumbent appointee and the date of appointment and the
term expiration date is also included on the list. Based on the prepared list, the City Clerk's
office accepts applications (available on the City's website and in the City Clerk's office) for any
upcoming vacancies.
Carlsbad Municipal Code Chapter 2.24 states that the Planning Commission shall consist of seven
members to be appointed by a majority vote of the Council, and of four ex officio members who
shall be the Community & Economic Development Director, the City Engineer, the City Attorney
and the City Planner.
Other members of the Planning Commission are: Velyn Anderson, Linda Geidner, Carolyn Luna,
Roy Meenes, and Peter Merz. Members of the Planning Commission are subject to the provisions
of the Political Reform Act and must file a Statement of Economic Interests annually, and
complete two hours of ethics training every two years.

None.
Next Steps
Following the appointments to the Planning Commission, the City Clerk's office will update the
Commission roster and coordinate the Oath of Office and completion of the ethics training
course.
Environmental Evaluation {CEQA)
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change

in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.

I currently work for a non-profit that advocates for safe and healthy communities by promoting policies that reduce crime and alcohol and other drug-related (AOD) problems.
In this capacity, one of my responsibilities is to provide spokespersons training to community members wishing to speak in front of a planning commission or city council.
Therefore, I am familiar with this part of the civic process.
I use GIS as a valuable tool in analyzing community issues (crime, AOD, food deserts, etc.) to make evidence·based policy recommendations to policy-makers.

I previously was a member of the Hope Elementary School PTA as chair of the Hospitality Committee
and Book Fair coordinator. I have also volunteered as a public information liaison for the San
Diego/Imperial Counties Chapter of the American Red Cross.
Additional information or comments
I feel we all have a civic duty to provide a safe, healthy, and thriving community for
ourselves, our kids, and our fellow community members. Carlsbad has been home for
the past 11 years and lam deeply invested in securing its future through strategic
long-term planning.

Officer for the NROTC Unit (1979), and as Executive Officer and Commanding Officer
of the summer OCS Bulldog companies. He was promoted to major in October 1978.
From August 1980 to June 1981, he was a student at the Marine Corps Command and
Staff College at Quantico. The following month, he reported to the 1st Marine Division,
Camp Pendleton, CA, where he served as the Battalion S-4 for the id Battalion, 11th
Marines; Executive Officer of 3d Battalion, 11th Marines; and Division Staff Secretary.
In October 1983, he was promoted to lieutenant colonel.
General Hanlon was then ordered in May 1984 to the 3d Marine Division for duty as
Commanding Officer, 3d Battalion, 12th Marines. The following May, he returned to
Marine Corps Recruit Depot, San Diego, for duty as the Director of Personal Services.
From August 1986 through June 1987, he was a student at the Industrial College of the
Armed Forces in Washington, D.C.
Returning overseas in July 1987, General Hanlon was assigned to Headquarters FMF
Europe in London, United Kingdom, for duty as the Assistant Chief of Staff for Plans (G-
5) and for Operations (G-3). He was promoted to colonel in August 1989. In September
1990, he reported to the U.S. Atlantic Fleet for duty as the Fleet Marine Officer. General
Hanlon was assigned duty as Commanding Officer of the 10th Marines, 2d Marine
Division in April 1992. While serving in this capacity, he was selected in March 1993 for
promotion to brigadier general. He was advanced to brigadier general on July 8, 1993,
and was assigned as the Deputy Commander, Naval Striking and Support Forces,
Southern Europe, Naples, Italy, where he served until July 1996.
He was promoted to Major General on July 1, 1996, and was assigned duty as the
Director, Expeditionary Warfare Division (N85) where he served until August 1998. On
August 21, 1998 to June 15, 2001, Major General Hanlon served as the Commanding
General of Marine Corps Base, Camp Pendleton. He was promoted to Lieutenant General
on 11 July 2001 and assumed command of Marine Corps Combat Development
Command, Quantico, VA. He most recently served as the U.S. Military Representative to
the NATO Military Committee in Brussels, Belguim from October 2004 through
November 2006.

efforts for a 100-Million-dollar project for the storage of low-level radioactive waste .. Hired and
directed a team of engineers, contractors and consultants on the design and construction of this
project. Managed the geotechnical and material testing contractor for material removal and cell
construction. Moved more than 9 Million cubic feet of material on the project. Project involved
the construction of two massive in ground landfill cells with all associated infrastructure and
seven buildings.
Accomplishments:
• Completed the construction of this major facility in a remote location well within schedule
and below budget.
• Completion allowed the delivery of private and government low level radioactive waste.
VICE PRESIDENT
Cameron-Cole, LLC -Directed and lead a team of environmental and geotechnical engineers for
a national environmental engineering firm in developing, designing and constructing a wide range
of environmental and geotechnical engineering projects, including property remediation projects,
air quality engineering services, and construction management. Responsible for management of
coinpany engineering plan set designs, construction permitting process, contractor bid packages,
engineering project cost estimation, construction contracting, job site inspection, and project
quality control. Managed the profit and loss of the engineering group (located in multiple offices)
within the company.
Accomplishments:
• Responsible for acquiring and managing the largest remediation project for the company ($11
Million over two years).
• Launched a new environmental technology throughout the United States. Successful
installation of the technology at more than 20 sites.
• Reorganization of the company and its environmental engineering assets to move past
investigation into remediation.
SENIOR VICE PRESIDENT
U.S. Laboratories/Bureau Veritas -As Senior Vice President of a national engineering
company specializing in environmental, geotechnical and material testing (laboratory) and
special inspection, directed a total staff of over 120 people with an operating budget of$ 12
Million. Managed all aspects of the company including profit and loss, business development,
client management and implementation of the company's business and strategic plans.

nonprofit entities, professional organizations, or the courts. These involvements
have a distinct North County focus. North County is where I was raised, raised my
family, served as an assistant city attorney, and run a private law / mediation/
hearing officer practice.
With respect to Carlsbad, I have lived in what is now District 4 for over nineteen
years, maintain a professional office in District 2, and own commercial property in
The Village area of District 1. I shop at the Carlsbad Premium Outlets, Costco, and
The Forum Carlsbad, have bought three cars in Carlsbad Car Country, eat at
Carlsbad restaurants, and attend the TGIF Concerts in the Parks. I graduated from
the Citizens Academy last spring. I know Carlsbad and its city government!
My professional background and knowledge of Carlsbad would be an asset to the
Planning Commission. Extensive experience in administrative hearings would
enable me to collaborate with other commissioners in making fair, legally sound
decisions in quasi-adjudicative permit application hearings. I also would be able to
get quickly up to speed on the pressing land use issues soon coming before the
Planning Commission, including the proposed LCP Amendment regarding airports
and possible changes to the city's growth management standards to respond to
regional requirements for affordable-housing.
I would welcome the opportunity to use my education, experience, and local
knowledge in service to the citizens of Carlsbad as a member of the Planning
Commission.

I understand that Joseph L. Stine is making application for appointment to the
Carlsbad Planning Commission.
I am a retired attorney who formerly resided in Oceanside, CA. I met Joe in 1994
when I was appointed to the Oceanside Planning Commission (on which I served
for twelve years). At that time, Joe was a member of the Oceanside City
Attorney's staff assigned to the Planning Commission as legal adviser.
Joe was an excellent team player, very knowledgeable, and well-prepared at all
times. He not only understood the legal aspects of the items coming before the
Planning Commission, but he understood and could analyze the underlying facts
of each project considered. When Planning Commission testimony became
heated or in the face of threats of litigation, I particularly admired Joe's
composure to objectively and intelligently analyze the facts in light of applicable
law to provide legal guidance in a cool and thoughtful manner. Having served as
the Oceanside Planning Commission legal adviser for five years, Joe is well
aware of and familiar with the broad spectrum of matters that come before a
planning commission.
I can highly recommend Joe and believe he would be a great addition to the
Carlsbad Planning Commission.

I immigrated to the United States as a young man from war-tom Lebanon
in 1985 and have raised my family in North County. My three sons have been
educated at Carlsbad's Army and Navy Academy. Over the last two decades, I
have built three very successful specialty markets under the name "Primo Foods"
which employ over eighty workers. Our North County stores are heavily involved
in supporting local nonprofit, youth, and other community projects.
This letter is written in support of Joseph Stine in his application for
appointment to the Carlsbad Planning Commission. I have !mown Mr. Stine for
over seventeen years. In 2002, I hired him as my attorney to represent me in an
application through the City of Vista for a permit to operate an outdoor barbeque
at my Vista store. He demonstrated a keen knowledge of code enforcement and
other city processes. I also was impressed by the way he worked on my behalf
with city public officials and staff. He did an excellent job representing me at
hearings before the Vista Planning Commission and City Council. Through his
efforts, I obtained the permit to operate the barbeque that is critical to my business
success.
Over the years, Mr. Stine also has become a close friend and confidant who
regularly visits me at the Vista store, Together, for the past five years, we have
enabled a blind young athlete from a modest income Fresno family to compete in a
triathlon held each May on Mission Bay. She is a straight "A" middle school

Question:
Should an applicant being considered for appointment to a Commission or Committee be
disqualified from consideration based on the fact that he/she has a relationship with certain
organizations in the city?
Answer:
No. The city is not aware of any specific information related to any individual applicant and
organization that would create a conflict of interest such that the applicant could not fulfill the
mandates of serving on a Commission or Committee. Therefore, no current applicant should be
generally disqua lified from consideration by the City Council.
That is not to say that, if appointed to a Commission or Committee, an applicant could have a
conflict of interest on specific items and/or issues that may come before the Commission or
Committee. If that were to occur, the se lected applicant must recuse themselves from
participating in those items. To help ensure that no conflict of interest issue ari_ses, all members
of Comm1ssions and Committees receive ethics training, are subject to the California Political
Reform Act and must file a Statement of Economic Interests annually.
Because the city and the City Council may not have all relevant information to judge an
applicant's potential conflicts of interest, at the meeting, City Council Members are free to ask
any applicant whether or not he/she is aware of any information that would pose a conflict of
interest if he/she were selected to serve on a Commission or Committee. '

Statement of Edward Hanlon Jr., Applicant for the Planning Commission
Members of the City Council,
My apologies for being unable to attend in person this Council Session intended in part to
interview applicants for the Planning Commission. Due to a long planned business meeting in
NYC 12-14 February, I must request your understanding as I simply did not have time to make
other arrangements. It was suggested that I provide a brief statement as to my background
and reasons for submitting my application.
My wife and I live on Highland Drive and have since September 2012 as we repatriated from
Brussels, BE where I had been assigned while on active duty in the Marines and later served as
the senior executive of a major US Corporation in Europe. Previous to that, we lived in Carlsbad
from July 1981 through July 1987. She and I are both graduates of the Citizens Academy which
we did within the first year of our return to Carlsbad in 2012.
My professional life was 39 years in the Marine Corps followed by six years as a Vice President
of Raytheon International in Europe as their senior executive. In the Marine Corps I had the
distinct privilege of Commanding Camp Pendleton, (CPEN) CA from 1998 until 2001 when I was
then reassigned to Quantico, VA. As the Commanding General of Camp Pendleton, I came in
frequent contact with the mayors and City Councils of San Clemente, Oceanside, San Marcos,
Vista, Encinitas, Del Mar, Solana Beach, San Diego County and of course Carlsbad. I, along with
my staff, worked with SAN DAG, agencies/departments of the State of CA as well as federal
agencies. Understanding the regulations, laws, policies, and constraints of outside regulatory
agencies is absolutely essential to success. During the period of 1998 onward, Camp Pendleton
began a major revamping of the base and infrastructure, one example being base housing
which was 100% rebuilt or replaced, and became the model for other DoD bases and stations
around the US. To put this into perspective, CPEN is larger than Carlsbad, Del Mar, Encinitas,
Escondido, Oceanside, San Marcos, Solana Beach and Vista combined. The planning and
coordination to accomplish this modernization on schedule and in budget, was substantial.
Needless to say, this occurred across federal, state and local jurisdictions and today CPEN is a
modern and vibrant military installation--and neighbor--with numerous Carlsbad residents
assigned to military and civilian jobs aboard the base.
During my tenure at CPEN I came in contact with Carlsbad and their master "General Plan" and
watched as the city disciplined itself to adhere to their plan to include the financial
underpinnings of this plan. Having lived in the city '81-'87, then watched from CPEN '98-'01,
and living here again 2012 until now, I remain impressed and forever thankful to the countless
men and women on the Council, previous commissions, and city staff, who have made that
General Plan become reality. The reality is that Carlsbad is recognized as one of the most
successful and family oriented communities in the State of California. As I noted above, being a
graduate of the Citizens Academy allowed me to meet the employees who serve us and protect
us and I came away with a deep appreciation for the commitment to excellence that permeates
the entire city.
The reason we moved back to Carlsbad was that after 45 years living around the US and in four
foreign countries, we realized this was where we wanted to call home. The reason I
respectfully submit my application for the Planning Commission, knowing full well that there
are many highly qualified fellow citizens, is that it is the right thing to do as a citizen and if
selected, to continue to prepare for the future. Bottom line: never stop serving.
Former President Dwight David Eisenhower, famous for his detailed planning in the Army, once
said "Plans are worthless, but planning is everything". His lesson from this was that a plan is a
piece of paper but the planning process demands the thorough examination of options and
opportunities. The knowledge gained during this process is crucial to the selection of viable
courses of action." My take away from this is that the City's General Plan provides a solid
foundation based on sound analysis and planning over the years. I fully adhere to this process
and discipline. However, the City Council, the Planning Commission, the planning and city staff
and fellow citizens must stay engaged to ensure the General Plan brings the future into the
present and thrives in an everchanging environment.
The other major organization I serve on in California is as Vice Chair of the Governor of
California's Military Advisory Council and have served since 2013. I also serve on the Board of
Advisors of the San Diego Military Advisory Council (SDMAC). I serve also on the national Board
of Directors of the Military Officers Association of America (MOAA).

Feedback related to the committee and commission selection hearings
Dear Mayor and Councilmembers,
I am writing to you today to provide you feedback related to the Committee and Commission selection hearings that
took place yesterday, February 12, 2019. As the elected and paid leaders of a vibrant, healthy community, it is
incumbent upon you to develop transparent methods to select those whom you appoint to committees,
commissions, and boards. I found the application and selection process to be ill conceived and poorly
administered. I put myself in your shoes and I struggle to see how that process gave you the information that you
needed to make an informed decision. I am writing this letter in good faith and in the hope that the selection
process can be improved.
You need to be the protagonists of the selection process. I have served on multiple selection panels related to
government functions and employment and the first step is to determine what you are looking for in applicants and
set out a selection process that will capture them. Create a consistent scoring rubric and share the basics of the
rubric with the applicants.
This is also necessary to avoid impartiality and the appearance of impartiality. If none ofthe applicants knows on
what they are being judged, there is no way to be assured that the process is fair or that you really are getting the
best candidates. For example, some of the Planning Commission applicants spoke with broad brush strokes about
policy, some spoke of personal experience, some spoke of prior political experience, but nobody spoke to
everything. If the applicants did not cover the same ground, the point of the hearing is lost. You were left
comparing apples to oranges and I was left thinking that I would not want to cast such an important vote for my
community on such low-quality, inconsistent information.
You need to take control of the process and get information from the applicants that you know to be relevant instead
of waiting for applicants to produce information that might be relevant. My suggestion would be that you develop a
blind application and rank the applicants. Then, call in the top applicants for a structured interview (or hearing) that
drills down on the attributes that you think are important and score them accordingly.
I thank you for taking the time to read this letter and I hope you will reflect upon my feedback and consider my
recommendations. I wish you well.
