Executive Summary On October 16, 2018, the City Council directed staff to bring forward a resolution drafted by Council Member Michael Schumacher in support of community and school safety, with minor amendments, for consideration at a future meeting. At that time, the City Council also directed staff to develop and bring forward a resolution in support of gun violence prevention. This item presents both resolutions for City Council consideration. Discussion A draft resolution in support of community and school safety was prepared by Council Member Michael Schumacher and reviewed by the City Council on October 16, 2018. The resolution is presented for City Council consideration, as amended by the City Council (Exhibit 1). A resolution in support of gun violence prevention (Exhibit 2) was drafted by city staff, pursuant to City Council direction on October 16, 2018. The resolution incorporates and adapts certain elements of a draft resolution prepared by the nonprofit Moms Demand Action for Gun Sense in America, and certain elements of the Statement of Principles of the National Law Enforcement Partnership to Prevent Gun Violence, a project of the nonprofit National Police Foundation. This resolution is also presented for City Council consideration. Next Steps To be determined, as directed by City Council. Fiscal Analysis No city funding is being requested at this time. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action of considering community and school safety and gun violence prevention policies, does not constitute a "project" within the November 27, 2018 Item #14 Page 1 of 7 meaning of the California Environmental Quality Act {CEQA) in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act (California Government Code Section 54950 et seq.), published and distributed at least 72 hours prior to the meeting date and time. Exhibits 1. Resolution in support of gun violence prevention November 27, 2018 Item #14 Page 2 of 7 RESOLUTION NO. 2018-203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, IN SUPPORT OF COMMUNITY AND SCHOOL SAFETY WHEREAS, the City of Carlsbad is a coastal community in the north coastal region of San Diego, California that contains five school districts and is home to over 113,000 residents who deserve the highest level of public safety; and WHEREAS, the City of Carlsbad is committed to supporting our public safety officers and first responders who serve at the front lines in the protection of our residents and visitors; and WHEREAS, children need to feel secure traveling to and from school and within the school building for adequate learning to occur; and WHEREAS, the City of Carlsbad promotes safety for its residents and, notably, children and youth; and WHEREAS, the crisis of violence in our country necessitates a sustained, coordinated, and collaborative effort involving entire communities, elected officials at every level of government, law enforcement, and the entire criminal justice system; and WHEREAS, the hazards encountered by children in their schools, homes, and communities vary widely in different localities and cannot be specifically enumerated or predicted at the national level. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City of Carlsbad promotes safety for children and youth and continues its long-standing tradition of coordination, collaboration, education and emergency preparedness training, with all five school districts and the entire community. 3. That the City of Carlsbad urges its state agencies, county agencies and school districts to work with other community groups and agencies to expand mental November 27, 2018 Item #14 Page 3 of 7 health and social-emotional health services in school and maintain continued vigilance and monitoring of safety matters in their areas. 4. That state and federal laws and local ordinances be monitored and enforced to assure adequate safety regulations for the protection of children and youth and support the inclusion of safety education in their curriculum at school districts to develop school safety guidelines and comprehensive safety audits for each school. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 27th day of November, 2018, by the following vote, to wit: AYES: M. Hall, K. Blackburn, M. (SEAL) t November 27, 2018 Item #14 Page 4 of 7 RESOLUTION NO. 2018-204 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, IN SUPPORT OF GUN VIOLENCE PREVENTION WHEREAS, the City of Carlsbad is a coastal community in the north coastal region of San Diego, California that contains five school districts and is home to over 113,000 residents who deserve the highest level of public safety; and WHEREAS, the City of Carlsbad is committed to supporting our public safety officers and first responders who serve at the front lines in the protection of our residents and visitors; and WHEREAS, the City of Carlsbad promotes safety for its residents and, notably, children and youth; and WHEREAS, the level of gun violence in the United States, specifically firearm- related injuries and deaths including homicides, suicides, and accidental shootings, is unacceptable and demands immediate attention and action; and WHEREAS, the City of Carlsbad is committed to addressing gun violence and its horrific impact on communities across America; and WHEREAS, elected officials must commit to closing gaps in the current regulatory system, including those that enable felons, people convicted of domestic violence, minors, persons with mental illness, and other prohibited persons to access firearms, and those that allow the trafficking of illegal guns; and WHEREAS, law enforcement plays a central and critical role in preventing gun violence and solving crime; effective strategies for the strict enforcement of laws concerning the illegal possession, trafficking, and criminal use of firearms are vital, and need to be supported by data, research, technology, training, and best practices; and WHEREAS, because the public's health and safety depends on the efforts of law enforcement, agencies must have resources sufficient to prioritize the protection of communities against illegal guns and gun violence; and November 27, 2018 Item #14 Page 5 of 7 WHEREAS, the crisis of gun violence in our country necessitates a sustained, coordinated, and collaborative effort involving citizens, elected officials at every level of government, law enforcement, and the entire criminal justice system. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City of Carlsbad demands that federal and state government officials take immediate action to enact meaningful legislation to prevent gun violence. 3. That the City of Carlsbad urges its federal and state agencies, county agencies and school districts to work with other community groups and agencies to expand mental health and social-emotional health services and maintain continued vigilance and monitoring of safety matters in their areas. 4. That the City of Carlsbad supports the elimination of restrictions on the collection and compiling of data related to violence perpetrated with firearms, including research into the causes and consequences of gun violence. 5. That the City of Carlsbad shall transmit copies of this resolution to the Speaker of the United States House of Representatives, the President pro tempore of the United States Senate, the Attorney General of the United States, the Secretary of Health and Human Services, the Secretary of Education, the Secretary of the Department of Homeland Security, the Majority and Minority Leaders of the United States Senate, the Majority and Minority Leaders of the House of Representatives, California Governor-elect Gavin Newsom; U.S. Senators Feinstein and Harris; U.S. Representative-elect Mike Levin; State Senator Patricia Bates; and State Assembly Member-elect Tasha Boerner Horvath.
