Dear Mr. Neu:
I have a client who is interested in purchasing this property. As part of his due diligence, he
wanted me to find out about a reduced side yard setback for the property along the north
property line. The reduced property line dimension would be 5'-0" minimum.
The reasons for the reduced side yard are:
1. Such a condition is available if approved by the Planning Director per MC. 21.10.070.A-1-B.
2. When the lot improvements were completed to qualify for a legal lot: the access apron was
put 5' -0" .±. off the north property line, and
3. The water lateral was approved and constructed just south of the vehicle access apron.
Without a reduced side yard setback, an encroachment permit and documents would need to be
processed and the cost of demolition and relocating the apron and lateral would be excessive
and unnecessary.
If the Planning Director agrees with our position and grants the reduced side yard setback, my
client wants something in writing, to assure his ability to improve the property with the reduced
setback.
Attached is a proposed site design showing a reduced 5'-0" side yard setback. If the reduced
setback is approved, please provide me with a letter confirming this decision. Should you have
any questions, please contact me.
