Blackburn, M. Schumacher, C. Schumacher, M. Packard. ANNOUNCEMENT OF CONCURRENT MEETINGS: None. PLEDGE OF ALLEGIANCE: Mayor Pro Tern Blackburn led the Pledge of Allegiance. INVOCATION: None. APPROVAL OF MINUTES: None. PRESENTATIONS: None. PUBLIC COMMENT: Chas Wick spoke regarding the Planning Workshop that was to take place on July 24, 2018. Glenn Bernard spoke regarding his opposition to urban forests. Mary Lucid spoke about the Senior Center and the homeless. Anthony Welsh spoke regarding the future development on the Ponto beachfront. CONSENT CALENDAR: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 1. NORTH BEACH INTERIM LIFEGUARD PROGRAM REPORT & PRESENTATION OF RFP RESULTS TO PROVIDE OCEAN LIFEGUARD SERVICES -1.) Receive a report on the 2018 North Beach lifeguard program; 2.) Consider proposals received from California State Parks and OC Lifeguards in response to the City's Request for Proposals to Provide Lifeguard Services; 3.) Consider a proposed ocean lifeguard program to be operated by the City of Carlsbad Fire Department; and, 4.) Identify the City Council's preferred ocean lifeguard services provider, and direct staff to pursue next steps, as appropriate. (Staff contact: Michael Calderwood and Nate Pearson, Fire Department) City Manager's Recommendation: Receive the report, consider options and provide direction to staff. Oct. 23, 2018 Carlsbad City Council Special Meeting Page 2 Assistant to the City Manager Jason Haber gave the background of the item and introduced Fire Chief Michael Calderwood and Fire Battalion Chief Nathan Pearson who gave the report and a brief PowerPoint presentation (on file in the Office of the City Clerk). K. Cinciarelli stated that continuous eyes on the water at Ponto Beach is needed. ACTION: Motion to move forward with Option 3 made by Mayor Pro Tern Blackburn, seconded by Council Member M. Schumacher. Motion carried, unanimously 5/0. Mayor Hall called a recess at 9 a.m. and announced that Item No. 3 would be heard at this time. The meeting was reconvened by Mayor Hall at 9:13 a.m. CLOSED SESSION: (Council adjourned to the Law Library for Closed Session) 3 .. CONFERENCE WITH LEGAL COUNSEL REGARDING INITIATION LITIGATION -To authorize a closed session regarding initiation litigation of one case, pursuant to Government Code Section 54956.9(d)(2). (Staff contact: Celia Brewer, City Attorney) City Attorney Celia Brewer read the Council into Closed Session at 9:13 a.m. The Special Meeting of the Carlsbad City Council was called back into session at 11:35 a.m. ACTION: The City Council directed counsel to file a legal challenge to the approval of the McClellan-Palomar Airport Master Plan and the certification of the program EIR unless the County agrees to extend the deadline for the City to file a suit, and also to pursue a creative and forceful strategy to supplement the litigation. Notwithstanding its decision, the City Council made it clear that the door is always open to a negotiated resolution should the County change its approach to the City and its resident's interests. 3/2 (M. Hall; M. Packard -No). 2. GROWTH MANAGEMENT PLAN UPDATE SCOPING SESSION -Receive a staff presentation and direct staff on the scope (update tier) and timing of potential Growth Management Plan revisions. (Staff contact: David de Cordova and Scott Donnell, Community & Economic Development) City Manager's Recommendation: Receive the presentation and provide direction to staff. Community & Economic Development Director Debbie Fountain provided a brief background of the item and introduced Principal Planner Scott Donnell who gave a PowerPoint presentation (on file in the Office of the City Clerk). Jean Camp spoke about the open space standards and park deficits in Zone 9. Lance Schulte represented a group (Harry Peacock and J. Jones) and gave a presentation on behalf of People for Ponto. Oct. 23, 2018 Carlsbad City Council Special Meeting Page 3 Don Christiansen spoke regarding the Envision Carlsbad Program and how the new plan goes against this program. Fred Sandquist, President of Batiquitos Lagoon Foundation, spoke in support of Option No. 2 and forming an ad-hoc committee. K. Cinciarelli spoke about the City's /ow-income housing needs. Paige DeCino, Trail Captain at lake Calavera Preserve, spoke about the conflicts arising as more people are using the open spaces. Brian Rupp, Senior Vice President of Shopoff Realty Investments, spoke regarding the transparency of the planning for the Ponto Beachfront area and his support of the rezoning of Ponto East. Mark Matthess spoke in support of the City and thanked staff for their hard work. Steve Reith, resident of Oceanside, spoke about limited housing due to too much open space. Betty Prentice stated that the safety and traffic issues have not been addressed and the people are not being represented. Jon Prentice requested the Council do what is good for the community. ACTION: Motion by Mayor Hall, seconded by Council Member Packard to move forward on Tier 4/Option 2. Motion carried, unanimously 5/0. This item was heard before Item No. 2. CLOSED SESSION: 4.
