Motion by Council Member M. Schumacher, seconded by Council Member C. Schumacher, to
approve the minutes as presented. Motion carried unanimously, 4/0/1 (M. Hall -Absent).

PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: None.
PUBLIC COMMENT:
Jean Camp expressed her concerns regarding the Ponto area open space deficit issue.
Colin Robertson requested that instead of Veteran's Park, that a park be built in the Ponto area.
Chas Wick spoke regarding an alternative location for Veteran's Park.
Owen Rassman provided his concerns regarding the Shopoff development.
Glenn Bernard spoke about various environmental concerns.

1. SETTLEMENT OF WORKERS' COMPENSATION CLAIM -Adoption of a resolution authorizing
settlement of the Workers' Compensation claim of Richard Galanos. (Staff contact: Donna

2. LICENSE AGREEMENT WITH NEW CINGULAR WIRELESS PCS, LLC -Adoption of a resolution
authorizing the City Manager to execute a license agreement with New Cingular Wireless PCS,
LLC to operate a wireless communication facility at the Crossings Golf Course (APN: 212-270-
01, 02 and 07). (Staff contact: Curtis Jackson, City Manager Department)

3. REQUEST FOR PROPOSALS FOR LEASING HAWTHORNE PROPERTY -Adoption of a resolution
authorizing the release of a Request for Proposals for leasing the property located at 2065
Camino Vida Roble, commonly known as the Hawthorne Property. (Staff contact: Curtis
Jackson, City Manager Department)
4. AGRICULTURAL LEASE AGREEMENT WITH REY RIVER FARMS, INC. -Adoption of Resolution
No. 2018-055 authorizing the City Manager to execute an Agricultural Lease Agreement for
one year with Rey River Farms, Inc. for a portion of APN: 210-090-17, commonly referred to
as the Cannon Lake Park. (Staff contact: Curtis Jackson, City Manager Department)
5. HOMELAND SECURITY GRANT PROGRAM -Adoption of Resolution No. 2018-056 accepting
and appropriating funds in the amount of $82,262 for emergency management planning
through the Fiscal Year 2017 State Homeland Security Grant Program. (Staff contact: David
Harrison, Fire Department)
6. HOMELAND SECURITY GRANT PROGRAM -Adoption of Resolution No. 2018-057 accepting
and appropriating funds through the Fiscal Year 2017 State Homeland Security Grant
Program, in an amount not to exceed $52,112. (Staff contact: Cindy Anderson, Police
Department)
7. CARLSBAD VILLAGE CENTER -Adoption of Resolution No. 2018-058 denying a Major Review
Permit and Coastal Development Permit for 1) the removal of an existing retail use; and 2)
the construction of a 25,631 square foot, four-story, mixed-use building consisting of a
subterranean parking garage, ground floor retail, commercial office space and five (5)
residential apartments located at 2995 State Street in Land Use District 1 of the Village Review
Zone, the Village Segment of the Local Coastal Program and within Local Facilities

8. AMENDMENT TO THE LICENSE AGREEMENT WITH NEW CINGULAR WIRELESS PCS, LLC -
Adoption of CMWD Resolution No. 1593 authorizing the Executive Manager to execute a first
amendment to the license agreement between New Cingular Wireless PCS, LLC and the
Carlsbad Municipal Water District allowing for the removal and replacement of a water tank

ladder through the purchase and provision of a Z-Boom scissor lift machine located at the

9. AMENDMENT TO MASTER SALES AGREEMENT WITH ITRON, INC. DBA IBS -Adoption of a
CMWD resolution authorizing the execution of Amendment No. 1 to the Master Sales
Agreement with Itron, Inc. DBA IBS, in an amount not to exceed $148,316 for advanced
metering infrastructure. (Staff contact: Mario Remillard, Public Works)
10. QUITCLAIM OF WATERLINE EASEMENT OVER LOT 18 OF MAP NO. 7292 -Adoption of CMWD
Resolution No. 1594 approving a quitclaim of a waterline easement over a portion of a single
family property located at 4936 Park Drive. (Staff contact: Tim Carroll, Community &
Economic Development)

2018-053 authorizing the City Manager to execute a license agreement with New Cingular
Wireless PCS, LLC to operate a wireless communication facility at the Crossings Golf Course

Assistant City Manager Gary Barberio presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
In response to Council Member C. Schumacher, Assistant City Manager Gary Barberio stated
that typical base height limit of 25 feet in open space zoning but can be increased if a minor
conditional use permit is granted.
In response to Council Member C. Schumacher's inquiry, Assistant City Manager Barberio
stated that you might be able to catch a glimpse of the monopine from College Boulevard
going North but it would not be front and center.
Motion by Council Member M. Schumacher, seconded by Council Member M. Packard, to
approve Resolution No. 2018-053. Motion carried, 3/1/1 (C. Schumacher -No; M. Hall -
Absent).

Assistant City Manager Gary Barberio presented the report and reviewed a PowerPoint
presentation (on file in the Office ofthe City Clerk).

Grant Lohr requested that whoever goes in to the property be a good neighbor and not
operate 24 hours a day, seven days a week and be mindful of their lights.
Council Member C. Schumacher commented that the funds for operations of the building
such as the maintenance, the water, etc. are taxpayer's dollars.
In response to Council Member M. Schumacher, Assistant City Manager Barberio stated that
the lease revenue would go to the CFD and the operations costs would be borne by the tenant
relieving the City of the monthly and yearly costs the City currently has.
Motion by Council Member M. Schumacher, seconded by Council Member C. Schumacher, to
approve Resolution No. 2018-054. Motion carried, 4/0/1 (M. Hall -Absent).

PUBLIC HEARING:
11. WEED ABATEMENT PROGRAM PUBLIC HEARING -Receive public comments and adopt
Resolution No. 2018-059 declaring as public nuisances weeds, rubbish and refuse upon
private property in the City of Carlsbad in conjunction with the City of Carlsbad Weed
Abatement Program. (Staff contact: Randy Metz, Fire Department)
City Manager's Recommendation: Take public input, close the public hearing and adopt the
resolution.
Assistant Fire Marshall Cindy Wong presented the report.
Mayor Pro Tern Blackburn opened the duly noticed Public Hearing at 7:11 p.m. Seeing no one
wishing to speak, Mayor Pro Tern Blackburn closed the duly noticed Public Hearing at 7:11
p.m.
ACTION: Motion by Council Member M. Schumacher, seconded by Council Member C.
Schumacher, to approve Resolution No. 2018-059. Motion carried unanimously, 4/0/1 (M.
Hall -Absent).

13. DISCUSSION OF SAMPLE RESOLUTION IN SUPPORT OF GUN VIOLENCE PREVENTION -Discuss
a sample resolution in support of gun violence prevention, and provide direction to staff.

Assistant to the City Manager Jason Haber presented the report.
Dan Maclellan spoke about his opposition to having multiple gun shows held at the Del Mar
fairgrounds.
Jennifer Lanbom shared statistics about gun violence and expressed her support for ending
gun shows on public property.
Cindi Clemens expressed her appreciation for using the Moms Demand Action resolution
template and including the repeal of the Dickey Amendment.
Nikki Faddick expressed her support for approving the resolution in support of gun violence
prevention.
Ed Hanlon expressed his concerns stating that many would see this resolution as political and
not as a public safety initiative.
Lisa Gunther expressed her opposition to approving the resolution in support of gun violence
prevention.
Jesse Collins provided statistics about gun violence.
Richard Rocha spoke about his opposition to gun regulations and the resolution being
presented.
Allison Shaewitz expressed her support for the second amendment and her support for the
resolution in support of gun violence stating that it is a safety issue not a political issue.
Rose Ann Sharp shared a letter received regarding gun violence prevention.
David Schlereth expressed his opposition to the resolution being presented.
Wes Cross requested that Council take no action and work towards developing the resolution
further by including other organizations in the conversation of gun violence prevention.

12. ANIMAL SERVICES AGREEMENT WITH SAN DIEGO HUMANE SOCIETY-Adopt Resolution No.
2018-060 authorizing the City Manager to execute the Animal Services Agreement with the
San Diego Humane Society for animal control services in Fiscal Year 2018-19 in an amount
not to exceed $941,341. (Staff contact: Cindy Anderson, Police Department)
City Manager's Recommendation: Adopt the resolution.
Police Chief Neil Gallucci and Senior Management Analyst Cindy Anderson presented the
report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
Motion by Council Member M. Schumacher, seconded by Council Member C. Schumacher, to
adopt Resolution No. 2018-060. Motion carried, 4/0/1 (M. Hall -Absent).
PUBLIC COMMENT: Continuation of the Public Comments
Harry Peacock spoke about a letter sent addressing coastal south park needs at Ponto.
Michael Short spoke about the parking situation on Marron Road at Agave at the Preserve.
Michael Sebahar provided input on the Ponto Beach/rant development.
April Kennedy expressed her concerns about the southern preserve trail fence.
COUNCIL REPORTS AND COMMENTS:
Mayor Pro Tern Blackburn and Council Members reported on activities and meetings of some
committees and sub-committees of which they are members.
