Executive Summary Commissioner Shelly Sander resigned her position on January 23, 2018, leaving an unexpired term to be filled through April 2021. Commissioner Sander was initially appointed in November 2017 to fill the unexpired term of Commissioner Garcia. Commissioner Linda Geldner's term expired in April 2018 and she wishes to be reappointed. Commission Geidner was initially appointed in October 2014 to fill the expired term of Commissioner Levy. The City Clerk's office received applications from the following residents wishing to serve on the Historic Preservation Commission (Exhibit 3): • Sam Souri • Linda Geidner Discussion Government Code Section §54970-54974, known as the Maddy Act, requires that on or before December 31 of each year the legislative body shall prepare a Local Appointments List which contains the appointive terms of Board and Commission members which will expire in the next calendar year. The name of the incumbent appointee and the date of appointment and the term expiration date is also included on the list. Based on the prepared list, the City Clerk's office accepts applications (available on the City's website and in the City Clerk's office) for any upcoming vacancies. Carlsbad Municipal Code Chapter 2.42 states that the Historic Preservation Commission shall consist of five members to be appointed by a majority vote of the Council, as well as one ex- officio representative from the Planning Commission. Other members ofthe Historic Preservation Commission are: Kevin Bender, Laurie Boone, and Jack Nelson. Members of the Historic Preservation Commission are subject to the provisions of the Political Reform Act, and must file a Statement of Economic Interests. Fiscal Analysis None. May 22, 2018 Item #14 Page 1 of 9 Next Steps The City Clerk's office will update the Committee roster and coordinate the Oath of Office and filing of the appointees Statement of Economic Interest. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the following Carlsbad resident is hereby appointed to serve on the Historic Preservation Commission, for a term ending in April 2021.
