The project consists of an existing wireless communication facility (WCF) originally approved on February 19, 2003 (CUP 02-26, Planning Commission Resolution No. 5369). The original Conditional Use Permit was converted to a Minor Conditional Use Permit (MCUP 08-16) on January 12, 2009. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code (CMC) Chapter 2142 and Wireless Communication Policy 64, and (2) the findings required for granting a Minor Conditional Use Permit extension can be made, therefore, the City Planner APPROVES the first extension to Minor Conditional Use Permit MCUP 08-16 for ten (10) years based on the following findings and conditions Findings: 1 The permit or approval remains consistent with the general plan, all titles of the code and growth management program policies and standards in place are the time the extension was considered, and all of the findings contained in the City Planner approval letter dated January 12, 2009, for MCUP 08-16x1- SD06747A - CARLSBAD PACIFIC BUILDING apply to this extension and are incorporated herein by reference and remain in effect 2 Circumstances have not substantially changed since the approval was originally granted as the wireless communication facility is existing and no changes have been proposed 3 The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301 - Existing Faalities, of the state CEQA Guidelines In making this determination, the City Planner has found that the exceptions listed in Section 15300 2 of the state CEQA Guidelines do not apply to this project I Community & Economic Development Planning Division 1 1635 Faraday Avenue Carlsbad, CA 92008-73141 760-602-46001760-602-8560 f j www carlsbadca gov MCUP 08-16 (DEV02087) - SD06747A CARLSBAD PACIFIC BUILDING May 7, 2018 Page 2 [ Conditions: 1 This Minor Conditional Use Permit extension is granted for a period often (10) years retroactively from February 17, 2018 to February 16,2028. 2 All of the conditions contained in Planning Director's approval letter dated January 12,2009 for MCUP 08-19 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 9 which Is superseded by Condition No. 1 of this approval letter ' CITY OF CARLSBAD TERI DELCAMP Pnncipal Planner TDCSdh Brookwood Pacific Office, 138 Conant Street, Beverly MA 01915-1665 T-Mobile, Joseph Rose, 10509 Vista Sorrento Parkway, San Diego, CA 92121 Tecia Levy, Project Engineer Data Entry File Copy HPRM
