SUBJECT: CDP 07-02 -WALTERS GUEST HOUSE -Request for approval of a Coastal
Development Permit to allow for the construction of a 1,461 square foot detached
guest house on a 1.47 acre site previously developed \\ith a single family
residence located at 5305 Carlsbad Boulevard within the Mello II Segment of the
Local Coastal Program (LCP) and Local Facilities Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 6307
APPROVING Coastal Development Permit CDP 07-02 based upon the fmdings and subject to
the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.060 of the Carlsbad Municipal Code, improvements to a single family
residence within the Coastal Zone ,,,here the residence or proposed improvements would
encroach within fifty feet of the edge of a coastal bluff requires the processing and approval of a
Coastal Development Permit (CDP). The CDP application was reviewed for consistency ,vith
Local Coastal Program (LCP) policies and implementation plan. There are no unresolved issues.
The staff recommendation of approval with conditions is supported by the analysis as follows.
ID. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: The 1.47-acre previously developed lot is located on the west side of
Carlsbad Boulevard at 5305 Carlsbad Boulevard as shown on the attached location map.
Topographically, from east to west, the relatively flat lot sits slightly belm\' street grade and
transitions into a moderately steep coastal bluff slope at the rear of the property. The developable
rear portion of the site is improved \\ith a newly constructed two-story single-family residence
(CDP 02-56). The proposed guest house \\iII be located near the front of the property just behind
the required front yard setback. The lot is located within the appeal area of the Mello II Segment
of the Coastal Zone and any final decision on the Coastal Development Permit by the City of
Carlsbad is appealable to or by the California Coastal Commission.
Proposed Construction: The applicant is proposing to construct a 1,461 square foot detached
guest house on a single-family residential lot. The site is currently improved with an 8,185
square foot single-family residence. \Vhen completed, the one story guest house \\ill be
architecturally compatible with the main residence. The structure's exterior \\ill be fmished with o

smooth stucco and stone veneer, feature wood rafter tails, copper clad wood doors and windows,
and a tile roof, all matching the existing residence. The guest house includes a large bedroom
with private full size bathroom, sitting room with a wet-bar and fireplace, and a powder room.
The sole purpose of the guest house is for the temporary use by guests of the occupants of the
main single family residence.
Proposed Grading: No grading is proposed for this project.
Impact on Coastal Resources: The development is the construction of a detached guest house on
a previously developed lot; no agricultural activities, sensitive resources, geological instability,
flood hazard or vertical coastal access opportunities exist onsite and the development does not
obstruct views of the coastline as seen from public lands or public right-of-way or otherwise
damage the visual beauty of the coastal zone.
IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 6307.

stringline setback.
Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello n Segment of the Local Coastal Program. The project
proposes to construct a one-story detached guest house in an area designated for single-
family development. The subject site has an LCP Land Use Plan designation ofRLMlOS

(Residential Low-Medium and Open Space; 0-4.0 dulac), which allows for 3.2 dwelling
units per acre at the Growth Management Control Point. The OS General Plan Land Use
designation applies to the coastal bluff portion of the site and no development is proposed
within this area. The proposed guest house is consistent with the land use type and
density regulations for the property.
The proposed guest house would be consistent with the surrounding development of one
and two-story single-family residences and accessory structures. The one-story structure
will not obstruct views of the coastline as seen from public lands or the public right-of-
way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses
currently exist on the previously developed site, nor are there any sensitive resources
located on the property. The proposed guest house is not located in an area of kno\\n
geologic instability or flood hazard. No public opportunities for vertical coastal shoreline
access are available from the subject site, and no public access requirements are
conditioned for the project. The residentially designated site is not suited for water-
oriented recreation activities.
2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
The property is located along the west side of Carlsbad Boulevard, however, there are no
opportunities for vertical coastal access or recreational activities from the subject site.
Per the Local Coastal Program, the subject site is not required to provide beach access, as
there is an existing concrete stairway public access point located approximately 250 feet
to the south of the site providing public access from Carlsbad Boulevard to the beach.
Therefore, the project will not interfere with the public'S right to physical access to the
sea.
3. Coastal Overlay Zones.
The project is consistent \\ith the provisions of the Coastal Resource Protection Overlay
Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the
City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard
Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff
Management Program (JURMP) to avoid increased urban run off, pollutants and soil
erosion. No development is proposed in areas of steep slopes (coastal bluff) and no
native vegetation is located on the subject property. The site is not located in an area
prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. In
addition, the project is consistent with the provisions of the Coastal Shoreline
Development Overlay Zone (Chapter 21.204 of the Zoning Ordinance) in that the
previous project (CDP 02-56) was conditioned to provide the public with the right of
lateral access to a minimum of twenty-five feet of dry sandy beach at all times of the year.
The guest house will be consistent \\ith the stringline provisions as the proposed one-
story structure is located near the fr.ont of the property (131' landward of the existing
stringline setback) and will not encroach seaward of the existing residence which is
parallel to the adjacent properties to the north and south and will not be adjacent to any
steep slopes (CMC Section 21.204.050).

v. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemption listed below:
(1) Section 15303 of CEQ A exemptions (Class 3) exempts the construction oflimited
number of new, small facilities or structures, such as a guest house from
environmental review.
A Notice of Exemption will be fIled by the Planning Director upon project approval.
