Recommended Action Introduce an Ordinance amending Carlsbad Municipal Code (CMC} Section 10.40.145 to authorize the city traffic engineer to install and maintain parking space markings and signage indicating where the parking of vehicles beyond the markings of a single space is prohibited. Executive Summary Currently, Carlsbad Municipal Code section 10.40.145, authorizes the city traffic engineer to install and maintain parking space markings to indicate parking spaces adjacent to curbs where authorized parking is permitted. However, the current section allows for vehicles to park within and beyond the markings of a single space when the size of the vehicle is larger than a single marked parking space. The proposed amendment to Carlsbad Municipal Code Section 10.40.145 will authorize the city traffic engineer to install and maintain parking space markings and sign age indicating where the parking of vehicles beyond the markings of a single parking space shall be prohibited . Where the city installs signs or markings, no vehicle beyond the marked spaces, shall be stopped, left standing or parked contrary to such prohibition or within an area designated as prohibited or restricted. Discussion The Police Department commonly receives parking complaints from residents and businesses regarding the parking of oversized vehicles within areas of the city. Oversized vehicles are defined as vehicles that are larger than 22 feet long. The complaints fielded by the Police Department commonly involve safety (i.e. blocking line of sight to cross-traffic, nuisance conditions, sanitation (i.e. disposal of waste upon the street), and property access related concerns (i.e. lengthy vehicles are blocking access to parking along curbs) of residents and/or businesses caused by oversize vehicles being parked in the vicinity of the complainants' residences and businesses during the daytime and early evening hours . The police department does not currently have the authority to fully remedy these complaints as the current CMC allows the parking of vehicles, including oversized vehicles, beyond a single marked parking space. However, pursuant to current city provisions (CMC section 10.40.180), a permit is required to park an oversized vehicle on any city street or public property between the hours of 2:00 a.m. and 5:00 a.m. December 5, 2017 Item #8 Page 1 of 5 To provide the police department with a tool to remedy the complaints that they are receiving, California Vehicle Code section 22507(a) provides that local authorities, like the city, may, by ordinance or resolution, prohibit or restrict the stopping, parking or standing of vehicles, based on size, within 100 feet of any intersection, on certain streets or highways, or on portions thereof, during all or certain hours of the day. Based on Vehicle Code section 22507{a), if the city Council adopts the proposed ordinance, the police department will forward requests to the Public Works department to determine, based on design standards and relevant regulations, whether to install and maintain parking space markings and signage restricting oversized vehicles from stopping, standing and/or parking in the requested area. Fiscal Analysis No direct or immediate fiscal impact is anticipated as the result of this action. When the city traffic engineer makes a future determination to post signs or mark parking spaces, the city will incur the costs to do so. Next Steps Following introduction of the Ordinance, the City Clerk will prepare the Ordinance for adoption at the next Regular Council Meeting. Once adopted, the City Clerk will publish the Ordinance or a Summary of the Ordinance in a newspaper of general circulation within 15 days. The ordinance will be effective 30 days following the adoption. Environmental Evaluation (CEQA) The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301{c) -minor alteration of existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1. December 5, 2017 Item #8 Page 2 of 5 Exhibit 1 ORDINANCE NO. ---- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING SECTION 10.40.145 OF THE CARLSBAD MUNICIPAL CODE WHEREAS, Carlsbad Municipal Code section 10.40.145, authorizes the City to install and maintain parking space markings to indicate parking spaces adjacent to curbings where authorized parking is permitted. WHEREAS, Carlsbad Municipal Code section 10.40.145 currently allows for vehicles to park within and beyond the marked parking space when the size of the vehicle is larger than a single marked parking space. WHEREAS, vehicles parking, standing and/or stopping beyond a marked space can cause safety concerns. WHEREAS, vehicles parking, standing and/or stopping beyond a marked space may impede access to adjacent property. WHEREAS, Vehicle Code section 22507(a) allows the City to prohibit and/or restrict the parking, standing or stopping of vehicles on any street, highway or portion thereof. THEREFORE, the City Council of the City of Carlsbad, California, does ordain as follows: Section 1. It is the purpose and intent of the Carlsbad City Council in enacting this ordinance to authorize and empower the City, through its Public Works Department and its traffic engineers, to determine which highways, streets, lots or portions thereof in the City should contain a prohibition or restriction prohibiting and/or restricting vehicles from parking, standing or stopping beyond the marked parking spaces and once that determination is made, install and maintain parking space markings and post signage notifying motorists that parking, standing or stopping beyond the marked parking spaces is prohibited and/or restricted . Section 2. To effectuate the above stated purposes and intentions of the Carlsbad City Council, section 10.40.145 of the Carlsbad Municipal Code is hereby amended to read as follows: The city traffic engineer is authorized to install and maintain parking space markings to indicate parking spaces adjacent to curbs where authorized December 5, 2017 Item #8 Page 3 of 5 parking is permitted, and to indicate those locations wherein the parking of vehicles beyond the marked park i ng space is prohibited. When such parking space markings are placed in the highway, street or in a municipally owned and/or operated parking lot, subject to other and more restrictive limitations, no vehicle shall be stopped, left standing or parked other than within a single space unless the size or shape of such vehicle makes comp liance impossible. Where signs or markings are in stalled to indicate that stopping, standing and/or parking vehicles beyond the marked parking space is prohibited or restricted, no vehicle shall be stopped, left standing and/or parked contrary to such prohibition or restriction or within an area designated as prohibited or r estricted. Background •Police Department receives complaints regarding oversized vehicles parked during the daytime and evening hours to include: •Traffic safety: Blocking line-of-si g ht •Health and environment: Disposing of wastewater in storm drains •Parking availability: Occupying curb space that could accommodate multiple cars and prolonged parking Current City Code •10.40.145 C.M.C.-Authorizes the installation and maintenance of marked parking spaces adjacent to curbs where parking is permitted. •Oversized vehicles are not required to park within a marked space if the vehicle is too large to fit within a marked space. •10.40.180 C.M.C.-Regulates parking of oversized vehicles, defined as larger than 22 feet, during the hours of 2 and 5 AM. •There are currently no regulations that govern the parking of oversized vehicles during the daytime and evening hours. Proposed Amendment •Proposed amendment to 10.40.145 C.M.C. will authorize the installation and maintenance of marked parking spaces where the parking beyond the markings would be prohibited. •Signs or markings would be required to notify the public of the requirement to park within the marked space for enforcement to be permitted. •Police Department would provide enforcement through parking citations Authority for the Amendment •22507(a) C.V.C.-provides in part, that cities by ordinance or resolution may prohibit or restrict the stopping, parking or standing of vehicles based on size. Staff Recommendation •Introduce an Ordinance amending Carlsbad Municipal Code section 10.40.145 to authorize the city traffic engineer to install and maintain parking space markings and signage indicating where the parking of vehicles beyond the markings of a single space is prohibited.
