Recommended Action
Adopt a Resolution accepting bids and awarding a contract to Orion Construction Corporation
for an amount not to exceed $1,859,895 for the construction of the Drainage Master Plan
Project: BCA -Tamarack Avenue, Park Drive and Monroe Street, Project Nos. 6001, 6608 and
6617.
Executive Summary
On Nov. 7, 2017, City Council approved Resolution No. 2017-213 approving the project plans
and specifications and authorizing advertisement of the Drainage Master Plan Project: BCA -
Tamarack Avenue, Park Drive and Monroe Street, Project Nos. 6001, 6608 and 6617 (Project)
for construction bids. The documents were posted on the city's website for at least 30 days.
Bids were received on Jan. 3, 2018, and the lowest and responsive bidder was Orion
Construction Corporation with a bid in the amount of $1,859,895. Staff recommends award of
the construction contract to Orion Construction Corporation.
Discussion
There are three components to the overall Project. The primary component is the city's
Drainage Master Plan Project: BCA, adopted by the City Council in November 2008, which calls
for the construction of a new storm drain system servicing the streets of Tamarack Avenue,
Park Drive and Monroe Street. The upstream terminus of the proposed drainage system will
begin at the intersection of Monroe Street, Sunnyhill Drive and Alder Avenue. The system will
then traverse down gradient under Monroe Street, Park Drive and Tamarack Avenue before it
junctions with an existing 48-inch storm drain at the intersection of Tamarack Avenue and
James Drive. Funding for this component of the Project is provided by the Planned Local
Drainage Area B Fee Program.
The second component of the Project will improve several smaller storm drain systems that
currently serve this basin. Drainage collected by these systems will be consolidated and then
rerouted into pipeline BCA to create a single comprehensive drainage network throughout the

basin. The Northwest Quadrant Storm Drain Improvement Program will fund the improvements
to the existing drainage facilities.
The third and final component of the Project will be completed upon installation of the new
storm drain improvements, when the impacted roadways will receive a 2-inch grind and asphalt
overlay consistent with and funded by the city's Pavement Management Program.
On Jan. 3, 2018, seven sealed bids were received for the construction of this Project as shown in
the following table:

Staff has completed its review of the contract documents and determined Orion Construction
Corporation is the lowest responsive and responsible bidder. Orion Construction Corporation is
responsive as it meets the requirements of the bidding documents. The bidder is also deemed
responsible as they submitted a list of similar projects to show their capability and qualification
to perform the specified work. The construction contract contains general performance
standards and references technical specifications, which if not met, allow the city to withhold
payment, and includes a one year warranty period.
Fiscal Analysis
There are three capital improvement programs contributing to the Project. The available funds
and the distribution of funding from each of the three programs are shown in the following
tables:

Next Steps
Once contract documents are fully executed and a purchase order is issued, staff will schedule a
pre-construction meeting with the contractor, and issue a notice to proceed with the
construction of the Project.
Environmental Evaluation (CEQA)
On Aug. 5, 2008, the City Council adopted Resolution No. 2008-229 certifying an Environmental
Impact Report (EIR) for the Drainage Master Plan Update (EIR 04-02). The Project (BCA) is a
sub-component of the Drainage Master Plan and was analyzed in the EIR (Table 4.1.2). The
analysis stated impacts in the Coastal Zone during constru.ction activities would be short term
and minimized with implementation of the applicable Project design features/methods and
construction measures identified in Table 3-6 of the Project EIR. The Project has been
conditioned to implement these mitigation measures and the Project is within the scope of the
prior environmental document and no further environmental documentation is required per
CEQA Guidelines Section 15162.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date. The public will be
notified in advance of the construction activities using multiple media methods such as sign age,
email, website, and other city communication channels. The construction contractor will also be
required to notify the public of construction activities. A communications consultant is currently
on contract to provide public outreach services on behalf of the city during construction.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO ORION
CONSTRUCTION CORPORATION FOR AN AMOUNT NOT TO EXCEED
$1,859,895 FOR THE CONSTRUCTION OF THE DRAINAGE MASTER PLAN
PROJECT: BCA -TAMARACK AVENUE, PARK DRIVE AND MONROE STREET,
PROJECT NOS. 6001, 6608 AND 6617.
EXHIBIT I
WHEREAS, the City Council of the City of Carlsbad, California has determined that it is necessary,
desirable, and in the public's best interest to construct the Drainage Master Plan Project: BCA -
Tamarack Avenue, Park Drive and Monroe Street, Project Nos. 6001, 6608 and 6617 (Project); and
WHEREAS, on Nov. 7, 2017, the City Council of the City of Carlsbad adopted Resolution No.
2017-213 approving plans and specifications for the construction of the Project; and
WHEREAS, the City of Carlsbad received seven sealed bids on Jan. 3, 2018 for the construction
of the Project; and
WHEREAS, Orion Construction Corporation submitted the lowest responsive and responsible
bid to construct the Project in the amount of $1,859,895; and
WHEREAS, there are sufficient funds available in the Pavement Management Program,
Northwest Quadrant Storm Drain Program, and the Drainage Master Plan Project: BCA to complete the
Project; and
WHEREAS, subsections 3.28.040(C)(S) and 3.28.090(8) of the Carlsbad Municipal Code
authorize the city manager or designee to approve change orders in the amount equal to the
contingency set at the time of the Project award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the bid of $1,859,895 submitted by Orion Construction Corporation for the
construction of the Drainage Master Plan Project: BCA -Tamarack Avenue, Park Drive
and Monroe Street, Project Nos. 6001, 6608 and 6617 is accepted and the mayor is
hereby authorized to execute a contract for this Project.
3. That the city manager or designee is hereby authorized to approve construction change
orders up to $220,000.

4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and
