PWL18-106GS CITY OF CARLSBAD PUBLIC WORKS LETTER OF AGREEMENT Cole Library Step Replacement This letter will seNe as an agreement between Urban Corps of San Diego, a not-for-profit corporation (Contractor) and the City of Carlsbad (City). The Contractor will provide all equipment, material and labor necessary to remove and replace existing exterior step treads at Dove Library located at 1775 Dove Lane, Carlsbad, CA 92009 per Exhibit "A" and City specifications, for a sum not to exceed two thousand six hundred dollars ($2,600). This work is to be completed within thirty (30) working days after issuance of a Purchase Order. ADDITIONAL REQUIREMENTS 1. City of Carlsbad Business License 2. The Contractor shall assume the defense of, pay all expenses of defense, and indemnify and hold harmless the City, and its agents, officers, officials, employees, and volunteers from all claims, loss, damage, injury and liability of every kind, nature and description, directly or indirectly arising from or in connection with the performance of this Contract or work; or from any failure or alleged failure of the contractor to comply with any applicable law, rules or regulations including those relating to safety and health; except for loss or damage which was caused solely by the active negligence of the City; and from any and all claims, loss, damage, injury and liability, howsoever the same may be caused, resulting directly or indirectly from the nature of the work covered by this Contract, unless the loss or damage was caused solely by the active negligence of the City. The expenses of defense include all costs and expenses, including attorney's fees for litigation, arbitration, or other dispute resolution method. 3. Contractor shall furnish policies of general liability insurance, automobile liability insurance and a combined policy of workers compensation and Employers' Liability in an insurable amount of not less than one million dollars ($1,000,000) each, unless a lower amount is approved by the Risk Manager or the City Manager. Said policies shall name the City of Carlsbad as an additional insured. The full limits available to the named insured shall also be available and applicable to the City as an additional insured. Insurance is to be placed with California admitted insurers that have a current Best's Key Rating of not less than "A-:VII",; OR with a surplus line insurer on the State of California's List of Approved Surplus Line Insurers (LASLI) with a rating in the latest Best's Key Rating Guide of at least "A:X"; OR an alien non-admitted insurer listed by the National Association of Insurance Commissioners (NAIC) latest quarterly listings report. Proof of all such insurance shall be given by filing certificates of insurance with contracting department prior to the signing of the contract by the City. 4. The Contractor shall be aware of and comply with all Federal, State, County and City Statues, Ordinances and Regulations, including Workers Compensation laws (Division 4 California Labor Code) and the "Immigration Reform and Control Act of 1986" (8USC, Sections 1101 through 1525), to include but not limited to, verifying the eligibility for employment of all agents, employees, subcontractors and consultants that are included in this Contract. 5. The Contractor may be subject to civil penalties for the filing of false claims as set forth in the California False Claims Act, Gov~~ent Code sections 12650, et seq., and Carlsbad Municipal Code Sections 3.32.025, et seq. .k~. init _____ init 6. The general prevailing rate of wages, for each craft or type of worker needed to execute the contract, shall be those as determined by the Director of Industrial Relations pursuant to the Section 1770, 1773 and 1773.1 of the California Labor Code. Pursuant to Section 1773.2 of the California Labor code, a current copy of applicable wage rates is on file in the office of the City Engineer. Contractor shall not pay less than the said specified prevailing rates of wages to all workers employed by him or her in the execution of the work covered by this Letter of Agreement. Contractor and any subcontractors shall comply with Section 1776 of the California Labor Code, which generally requires keeping accurate payroll records, verifying and certifying payroll records, and making them available for inspection. Urban Corps of San Diego County (Urban Corps) meets the certification standards for each criterion outlined in the Community Conservation Corps Manual, Revised August 2016. The California Conservation Corps (CCC) Certification Review Team examined organizational, educational, and programmatic documentation during the week of January 2, 2017, and observed Urban Corps' operations on January 12, 2017. Based on the review and site visit, the CCC certifies Urban Corps for the 2017/2018 fiscal year. 2. What arre your genera! comments? Urban Corps is a vital resource to the greater San Diego region both for young adults in need of education and work experience and the communities that benefit from the natural resource and recycling work Urban Corps performs. During the 201· 5/2016 review period, Urban Corps secured new grants, including one from the California Fire Safe Council to do fuel load reduction projects, and one from the Community Development Block Grant from the US Department of Housing, which allowed Urban Corps to hire an additional case manager. Urban Corps received other grants from CalFire, Natural Resource Agency, Wildlifo Conservation Board, and Proposition 39. 11 - COMMUNITY CONSERVATION CORPS CERTIFICATION REPORT Urban Corps of San Diego County • March 28, 2017 For the following criteria, provide a narrative related to each rating. Report on the documentation, review activities conducted, and/or information that justify the mark given in the box. Recommend Recommend CRITERIA PASS FAIL Corrective Further Action Documentation AVERAGE ENROLLMENT: The corps consists ofan average annual enrollment of not less than 50 corpsmembers X between 18 and 25 years of age. (PRC§ 14507.5[a][5]) NARRATIVE RELATED TO RATING: Urban Corps' average annual enrollment for the 2015/2016 fiscal year was 192 corpsmembers. Urban Corps submitted the signed Corpsmember Enrollment Certification Form, certifying that corpsmembers counted in the average annual enrollment during the review period were between the ages of 18 and 25, enrolled participants in the conservation corps work program, and have signed corpsmember contracts/agreements. The Review Team examined payroll records for the months of August 2015 and May 2016 to substantiate the Corpsmember Enrollment Certification Form, and no discrepancies were identified. (PRC§ 14507.5[a][1]) NARRATIVE RELATED TO RATING: To verify Urban Corps is organized in the form of supervised work crews, the Review Team requested copies of supervisors' daily crew rosters, crew supervisor minimum qualifications and/or job specifications, and one year of training records for crew supervisors. Urban Corps submitted: • Daily crew rosters for the weeks of December 14, 2015 and January 2, 2016 showing date, department, crew, project number, project name, supervisor, corpsmember name, corpsmember signature, and time worked. Crew rosters were signed by the supervisor and project coordinator. • Job description for Urban Corps' crew supervisor position. Crew supervisors are required to have a high school diploma and a minimum of one year of supervisory experience. • Crew supervisor training records for 2015/2016, which included courses in workplace privacy, leadership skills, ladder safety, stress management, workplace ethics, and preventing sexual harassment. Urban Corps' documentation was complete and no issues were identified. (PRC§ 14507.5[a][1]) The corps selects young men and women for participation on X the basis of motivation for hard work, personal development, and public service, without regard for their prior employment or educational background and consistent with Section 14402. (PRC§ 14507.5[a][1]) NARRATIVE RELATED TO RATING: 2 COMMUNITY CONSERVATION CORPS CERTIFICATION REPORT Urban Corps of San Diego County • March 28, 2017 To verify that Urban Corps' program is for one year with the possibility of extension, Urban Corps submitted a copy of its corpsmember handbook, which states that the job-training program is a one-year program. To verify that Urban Corps is in compliance with the hiring practices stated in PRC§ 14507.5[a][1], the Review Team examined documentation related to recruitment, the application process, Equal Employment Opportunity (EEO), and high school diploma status upon entering the program. Urban Corps submitted: • Corpsmember recruitment flyers, advertising paid job training and earning a high school diploma. Flyers also have eligibility and contact information. • Corpsmember job application to join Urban Corps' job training program. • EEO policy information. Urban Corps' EEO Officer is the Human Resources Manager. • List of corpsmembers who enrolled during the 2015/2016 fiscal year and their high school diploma status upon enrollment. Urban Corps hired eight corpsmembers who had already received a high school diploma. The Review Team also verified that EEO information is posted in an area visible to corpsmembers. Urban Corps' documentation was complete and no issues were identified. Recommend Recommend CRITERIA PASS FAIL Corrective Further Action Documentation WAGE SCALE AND POST PLACEMENT: The corps compensates corpsmembers at not less than the federal minimum wage.(PRC § 14507.5[a][3]) X The corps provides corpsmembers assistance in obtaining permanent employment following their participation in the corps program. (PRC§ 14507.5[a][3]) NARRATIVE RELATED TO RATING: For the 2015/2016 fiscal year, Urban Corps paid corpsmembers a starting wage of $10.00 per hour, which was the minimum wage for the State of California, and is higher than the federal minimum wage of $7.25. To verify that Urban Corps provides corpsmembers assistance in obtaining permanent employment, the Review Team requested documentation outlining Urban Corps' post-corps employment assistance plan, listing programs and services for job training and career development, as well as a list of job-specific skills available to corpsmembers and post-corps placement statistics. Urban Corps submitted: • Description of Urban Corps' Corps-to-Career program, which includes evaluations, individual development plans, life skills classes, and assistance in building resumes, practicing interviews, enrolling in college and navigating financial aid, and completing career exploration activities. Corpsmembers also receive active case management services to remove barriers to employment. • List of job-specific skills that corpsmembers can develop in the job training program, including punctuality, accountability, time management, and customer service, in addition to the recycling, landscaping, and natural resource skills corpsmembers can build. • Post-corps placement tracking sheet, indicating that Urban Corps tracks corpsmembers' employment and education status. To substantiate the post-corps employment assistance plan submitted by Urban Corps, the Review Team examined career/employability files for 20 corpsmembers. Career files contained senior portfolios, case management documents, work readiness exercises, individual development plans, and resumes. Urban Corps' documentation was complete and no issues were identified. 3 COMMUNITY CONSERVATION CORPS CERTIFICATION REPORT Urban Corps of San Diego County• March 28, 2017 Recommend Recommend CRITERIA PASS FAIL Corrective Further Action Documentation EDUCATIONAL PROGRAM: The educational component of the corps' program includes enrollment in a vocational education program, public or charter high school, or postsecondary community college. (PRC§ 14507.5[a][2]) The Corps shall give priority to providing an educational component for corpsmembers who have not completed high school. The component shall be equal in content to a high X school curriculum and provide course credits leading to a high school diploma or its equivalent, such as a California high school equivalency certificate. The work of the Corps shall be structured to accommodate the educational component without significantly reducing the productivity of the Corps. (PRC§ 14402) NARRATIVE RELATED TO RATING: To verify that Urban Corps' educational program, Urban Corps of San Diego County Charter School, is in compliance with PRC§ 14507.5[a][2] and PRC§ 14402, the Review Team requested a copy of Urban Corps' most recent charter school accreditation by the Western Association of Schools and Colleges r:,NASC), a copy of the approved charter, a corpsmember graduation list for the 2015/2016 fiscal year, and a list of education goals and objectives for corpsmembers who already have a high school diploma. Urban Corps submitted: • WASC letter dated July 3, 2016 indicating that Urban Corps Charter School is accredited through June 30, 2022. • Evidence of charter renewal by the Mono County Office of Education, signed July 1, 2016. • List of corpsmembers who graduated from Urban Corps Charter School during the 2015/2016 fiscal year, which was 179. • Description of academic goals for corpsmembers with a high school diploma, which includes required enrollment in community college or vocational education, as well as Corps-to-Career academic activities. The CCC lead reviewer verified on the Mono County Office of Education's website that Urban Corps' charter is currently active. To verify that Urban Corps educational component does not significantly reduce the productivity of the Corps (PRC§ 14402), the Review Team also requested copies of school attendance rosters and a description of Urban Corps' work-school attendance model. Urban Corps' submitted class rosters for the weeks of October 19, 2015 and April 18, 2016. Student corpsmembers attend class two days per week and work three days per week. Urban Corps' documentation was complete and no issues were identified. (PRC§ 14507.5[a][2]) NARRATIVE RELATED TO RATING: To verify that Urban Corps' program develops corpsmembers' character and civic consciousness, the 4 COMMUNITY CONSERVATION CORPS CERTIFICATION REPORT Urban Corps of San Diego County • March 28, 2017 Review Team requested a list of work ethic standards from a corpsmember handbook/agreement, a description of civic consciousness activities that corpsmembers participate in, and a description of how Urban Corps rewards and recognizes corpsmembers, with samples of awards and/or certificates. Urban Corps submitted: • Description of standards of conduct from Urban Corps' corpsmember agreement, including reporting to work every day on time, working to the best of their ability, and abstaining from illegal drugs and alcohol. • Documentation of civic consciousness activities, including participating in Urban Corps' Corpsmember Advisory Board and Government Education Day, and hearing guest speaker Senator Ben Hueso discuss Senate Bill 1216. • Description of recognition program and awards offered, including awards for corpsmember of the month, perfect attendance, and safety. Urban Corps' documentation was complete and no issues were identified. During the certification site visit on January 12, 2017, the Review Team spoke with three corpsmembers from two different crews about their experience at Urban Corps. When asked how being a participant in the program has helped them personally, one corpsmember stated that it has helped him develop a more positive attitude toward people and he has learned how to communicate better with others. Another corpsmember stated that he feels like he is doing something good with his life. These interviews provided additional information in how Urban Corps is helping corpsmembers develop good work ethic and character. Recommend Recommend CRITERIA PASS FAIL Corrective Further Action Documentation PROJECT WORK: The corps engages in recycling and litter abatement projects, as well as projects that accomplish the conservationist and other purposes described in subdivision (a) through (h), inclusive, of Section 14300, and that assist X agencies of local governmental and other nonprofit community organizations in developing, rehabilitating, and restoring park/ands, recreational facilities, and other community resources. (PRC§ 14507.5[a][4]) NARRATIVE RELATED TO RATING: To verify that Urban Corps engages in both recycling/litter abatement projects and projects that accomplish conservationist purposes as described in PRC§ 14300, and assists local government and nonprofit organizations, the Review Team requested Urban Corps' project list for the 2015/2016 fiscal year, as well as copies of project evaluations or completion letters from agencies/organizations. Urban Corps submitted: • Project list with sponsor, type of work, and date. Sponsors included Coastal Roots Farm (weed abatement), County of San Diego (landscaping), City of San Diego (event recycling), and River Partners (habitat restoration). • Evaluations from the City of Carlsbad Public Works Department and the City of San Diego, as well as quality control reports from the City of San Diego. Urban Corps' documentation was complete and no issues were identified. The Review Team also visited an active project on the day of the on-site review. Urban Corps staff escorted the group to the project site visit, located in San Diego, where corpsmembers are planting new trees at a park for the City of San Diego .. 5 COMMUNITY CONSERVATION CORPS CERTIFICATION REPORT Urban Corps of San Diego County • March 28, 2017 Recommend Recommend CRITERIA PASS FAIL Corrective Further Action Documentation DESIGNATION: The corps has been designated by a Q1Y. (PRC§ 14581.1[a][2]) NARRATIVE RELATED TO RATING: To demonstrate that Urban Corps has been designated by a city with a population of more than 250,000 persons to perform litter abatement, recycling, and related activities, Urban Corps provided a copy of their contract with the City of San Diego to perform recycling at Qualcomm Stadium. The population of the City of San Diego was estimated at 1,394,928 in 2015, above the 250,000 threshold. Recommend Recommend CRITERIA PASS FAIL Corrective Further Action Documentation ANNUAL BUDGET: Any grants provided pursuant to this paragraph shall not comprise more than 75 percent of the X annual budget of a Community Conservation Corps. (PRC § 14581.1[b]) NARRATIVE RELATED TO RATING: Urban Corps provided an income statement for 2015/2016 from its general ledger, which listed Urban Corps' total revenue at $9,184,325. The 2015/2016 total grant allocation from CalRecycle was $1,585,725, which is 17% of Urban Corps' total revenue.
