Executive Summary The term of Commissioner Laurie Boone expired in April 2017. Ms. Boone was originally appointed in February 2014 to fill the unexpired term of Commissioner Joyce Smith and is eligible for reappointment. She has submitted a letter and an updated application requesting reappointment (Exhibit 2). The City Clerk's office has received applications from the following residents wishing to serve on the Historic Preservation Commission (Exhibit 3): • Michael Flemming • Holly Hart • Shelly Sander • Shantella Slaten Discussion Government Code Section §54970-54974, known as the Maddy Act, requires that on or before December 31 of each year the legislative body shall prepare a Local Appointments List which contains the appointive terms of Board and Commission members which will expire in the next calendar year. The name .of the incumbent appointee and the date of appointment and the term expiration date is also included on the list. Based on the prepared list, the City Clerk's office accepts applications (available on the City's website and in the City Clerk's office) for any upcoming vacancies. Staff inadvertently allowed Commissioner Boone's term to expire prior to scheduling the appointment for Council consideration. Although Ms. Boone's term expired in April, she has graciously continued to serve on the Commission until the Council appointment · could be scheduled on the agenda. Ms. Boone has served the remaining portion of an unexpired term and is eligible for reappointment. She has submitted a letter and an updated application requesting to be reappointed for a term ending in April 2021. Page 537 Carlsbad Municipal Code Chapter 2.42 states that the Historic Preservation Commission shall consist of five members to be appointed by a majority vote of the Council, as well as one ex- officio representative from the Planning Commission. Other members of the Historic Preservation Commission are: Kevin Bender, Christopher Garcia, Linda Geidner and Jack Nelson. Members of the Historic Preservation Commission are subject to the provisions of the Political Reform Act, and must file a Statement of Economic Interests. Fiscal Analysis None. Next Steps Following the appointment of one member to the Historic Preservation Commission, the City Clerk's office will update the Commission roster and coordinate the oath of office and filing of the appointees Statement of Economic Interests. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1.
