RECOMMENDED ACTION:
That the City Council hold a public hearing and:
a. Adopt a Resolution acknowledging receipt of the California Coastal Commission's resolution of
certification including suggested modifications for LCPA 07-02, and approving the associated
amendments to the Local Coastal Program land use map (LCPA 07-02) and General Plan land use
map (GPA 07-02); and
b. Introduce an Ordinance approving amendments to the Zoning Map (LCPA 07-02/ZC 15-02)
pursuant to the California Coastal Commission's suggested modifications to Local Coastal
Program Amendment (LCPA 07-02).
ITEM EXPLANATION:
On September 22, 2015, the City Council approved a comprehensive General Plan update, including
associated amendments to the city's Local Coastal Program (LCP) and Zoning Ordinance. The
amendments included revisions to the General Plan and LCP land use maps, the zoning map and Zoning
Ordinance. Although approved by the City Council, the LCP and zoning amendments are not effective
until the California Coastal Commission approves the LCP land use and zoning amendments and the
commission's approval becomes effective.
On November 9, 2015, the city submitted an application to the Coastal Commission requesting to amend
the city's LCP. The city's LCP amendment application requested to:
• Make numerous LCP land use and zoning map revisions, consistent with the map revisions approved
as part of the General Plan update; and
• Amend the city's Zoning Ordinance to:
o Eliminate references to "RHNA base density"
o Reduce the minimum density from 20 dwellings per acre to 15 dwellings per acre for residential
mixed use in commercial zones

regarding three components of the city's proposed LCP amendment. After considering Coastal

On May 11, 2016, the Coastal Commission approved the city's LCP amendment (excluding the deferred
items listed above) with nine suggested modifications, which are described in Exhibit 3. As indicated in
Exhibit 3, staff recommends that the City Council accept and approve all nine suggested modifications,
which amend the L.CP land use map and the zoning map; staff also recommends a related General Plan
land use designation change on two parcels (see Exhibit 3, suggested modification 2).
Two of the suggested modifications were made by the Coastal Commission in response to Carlsbad
residents' objections to proposed land use designation changes on the power plant site and the property
that was the subject of local initiative Measure A in February 2016 (a parcel adjacent to the east side of

Interstate 5, north of Cannon Road and south of Agua Hediorida Lagoon). See Exhibit 3 for more
information.
FISCAL IMPACT:
The project consists of the adoption of city policies and regulations; no fiscal impact will result from the
council's adoption of such policies and regulations.
ENVIRONMENTAL IMPACT:
Acceptance and approval of the Coastal Commission's suggested modifications are exempt from the
California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines Section 15265(a)(l), which
states:
(a) CEQA does not apply to activities and approvals pursuant to the California Coastal Act (commencing
with Section 30000 of the Public Resources Code) by:
(1) Any local government, as defined in Section 30109 of the Public Resources Code, necessary for
the preparation and adoption of a local coastal program.
The Coastal Commission's suggested modifications are required to be accepted by the city prior to Coastal
Commission certification of the city's amended local coastal program.

Information regarding public notifications of this item such as mailings, public hearing notices posted in
the newspaper and on the City website are available in the Office of the City Clerk.

the city's Local Coastal Program amendment (LCPA 07-02), subject to nine suggested
modifications; and
WHEREAS, acceptance of the California Coastal Commission's suggested
modifications, as set forth in Attachment lA attached hereto, is necessary to comply with the
California Coastal Act and California Administrative Code; and
WHEREAS, the City Council did on the12th day of July, hold a duly noticed public
hearing as prescribed by law to consider said request.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of
Carlsbad, as follows:

2. The City of Carlsbad acknowledges receipt of the California Coastal
Commission's resolution of certification including suggested modifications for the city's Local

EFFECTIVE DATE: The approval of LCPA 07-02 shall not be effective until the

approval of GPA 07-02, as shown on Attachment lC, shall be effective after a period for referendum
has elapsed, which is thirty days after the adoption of this resolution.

Dear Ms. Jesser:
On May 11, 2016, the California Coastal Commission approved the above referenced
amendment to the City of Carlsbad's Local Coastal Program (LCP). The amendment
involves revisions to both the Land Use Plan and Implementation Plan components of the
certified LCP, including numerous land use and zoning map revisions ai1d text revisions
to several Zoning Code sections to eliminate references to the RHNA base density
requirement, reduce the minimum density of mixed-use developments in the C-1, C-2,
and C-L zones, and allow professional care facilities in the Ozone.
The Co1mnission approved the LCP amendment with nine suggested modifications that
add map notes on the LCP Land Use and Zoning Maps related to the Open Space land
use and zoning boundary in the Terramar neighborhood, apply the Visitor Commercial
land use designation and the Commercial Tourist zone to two hotel pai·cels, retain the
Travel Services C01mnercial land use designation on the Strawberry Fields parcel, retain
the Public Utilities land use designation on the power plai1t parcel, retain the One-Fainily
Residential zone on fourteen parcels along Willow Place, retain the Open Space zone on
the north shore of Batiquitos Lagoon, and add a map note to the LCP Zoning Map
clarifying that the Commission retains permitting authority in areas of deferred
certification. The attached modifications contain the specific changes adopted by the
Commission.
Before the amendment request can become effectively certified, the Executive Director
must determine that implementation of the approved amendment will be consistent with
the Commission's certification order. This is necessary because the amendment was
certified with suggested modifications.
In order for the Executive Director to make this determination, the local government must
formally acknowledge receipt of the Commission's resolution of certification, including
any terms or suggested modifications; and take any formal action which is required to
satisfy them, such as rezonings or other ordinance revisions. This ce1iification must also
include production of new LCP Land Use and Zoning Maps and new Implementation
Plan Chapters 2L26, 21.27, 21.28, 21.31, and 21.53 demonstrating that the amendment,
as approved by the Commission m1d accepted by the City, 'Nill be incorporated into the

Land Use Plan:
1. Add the following note to the City of Carlsbad LCP Land Use Map regarding the
Open Space boundary in the Terramar neighborhood: "The location of this Open
Space boundary shall be refined during the process to update the Carlsbad Local
Coastal Program (LCPA 15-07). The boundary may be adjusted to more
accurately reflect beach and bluff areas that are undevelopable pursuant to
California Coastal Act and city policies.'~
2. Revise the City of Carlsbad LCP Land Use Map to apply the Visitor Commercial
(VC) land use designation to APNs 214-450-17 and 214-450-31 (720 and 751
Macadamia Drive).

WHEREAS, on May 11, 2016, the California Coastal Commission approved
the city's Local Coastal Program Amendment (LCPA 07-02); and on May 16, 2016, the city
received a letter dated May 13, 2016 from the California Coastal Commission (Attachment
lA of City Council Resolution No. __ ) that certifies (resolution of certification) the Coastal
Commission's approval of the city's Local Coastal Program amendment (LCPA 07-02),
subject to nine suggested modifications; and
WHEREAS, acceptance of the California Coastal Commission's suggested
modifications are necessary to comply with the California Coastal Act and California
Administrative Code; and
WHEREAS, the City Council did on the __ day of _____ ~ hold a
duly noticed public hearing as prescribed by law to consider said request.
NOW, THEREFORE, the City Council of the City of Carlsbad ordains as follows:
SECTION I: That Section 21.05.030 oft.he Carlsbad Municipal Code, being

LOCAL COASTAL PROGRAM AMENDMENT (LCPA} 07-02 -GENERAL PLAN UPDATE
At its meeting on May 11, 2016, the California Coastal Commission considered the city's proposal
to amend its Local Coastal Program (LCPA 07-02) as part of the General Plan update that was
approved by the City Council in September 2015. The Coastal Commission voted to approve the
city's LCP amendment, subject to the following suggested modifications.
I. SUGGESTED MODIFICATIONS TO THE LCP LAND USE MAP
Suggested modifications 1 to 4, below, consist of changes to the city's LCP land use map. The city
currently has two land use maps -a General Plan land use map that applies citywide, and a LCP
land use map that shows the LCP land use designations for properties within the Coastal Zone.
The modifications described below only affect the LCP land use map. In regard to suggested
modification 2, staff also recommends that the General Plan land use map be amended
consistent with the suggested modification.

At the May 11, Coastal Commission hearing, Carlsbad residents spoke in opposition to the city's
proposal to change the land use designation on the power plant site, as shown below, from Public
Utilities (U) to Visitor Commercial and Open Space (VC/OS).
The residents who spoke at the Coastal Commission meeting on May 11th indicated a desire for
the site to be designated entirely as OS. Attachment 3C is a letter from the city to the Coastal
Commission that provides more information regarding the city's proposed land use designation
change on this site.
In response to Carlsbad resident comments, the Coastal Commission voted to leave the power
plant as currently designated on the LCP land use map (Public Utilities (U)). The Coastal
Commission also indicated that the city's proposed land use change should be evaluated more
thoroughly during the city's comprehensive LCP update.
City staff will work with Coastal Commission staff on this proposal during the LCP update process.
Until the LCP update is approved by the City Council and Coastal Commission, the LCP land use
map will be inconsistent with city's General Plan l and use map, which shows the site designated
VC/OS, as approved by City Council as part of the General Plan update. The General Plan is not
part of the LCP and is not subject to the Coastal Commission's actions. The Coastal Commission's

(TS} to Visitor Commercial (VC} on the site, shown below, between Agua Hedionda Lagoon and
Cannon Road, east of 1-5 (the property that was the subject of a local initiative, which was
defeated by voters in a February 2016 referendum (Measure A}}.
Residents who spoke at the May 11th meeting opposed changing the designation from TS to VC .
because the city proposed to allow residential uses within the VC designation. The residents also
expressed that they believe the change from TS to VC conflicts with the citizens' vote against
Measure A . Attachment 3C is a letter from the city to the Coastal Commission that provides more
information in response to these concerns.
In response to Carlsbad resident comments, the Coastal Commission voted to leave the site as

Suggested modifications 5 to 9 consist of changes to the city's LCP zoning map. The city currently
has two zoning maps -a citywide zoning map that shows zoning for all properties in the city, and
a LCP zoning map that shows the LCP zoning for properties within the Coastal Zone. With the
zoning map changes described below, as well as other zone changes approved by the Coastal
Commission on May 11th, the citywide and LCP zoning maps will be consistent. Staff recommends
that the citywide and LCP zoning maps be combined into one single zoning map as shown on
Attachment 2A, attached to Exhibit 2 (draft City Council Ordinance); this single zoning map will
be more user-friendly and will ensure that citywide and LCP zoning remain consistent on all
properties.

parcel as open space. Because the parcel i s part of a master plan, the citywide zoning map zones

1-5, and the northwest, northeast and southwest corners of Tamarack Ave. and 1-5.

their concerns about: A) the proposed zoning change on the power plant site from Public Utility {PU) to
Commercial Tourist/Open Space (CT/OS); and B) the proposed revisions to the city's Tourist Recreation
Commercial (TR) land use designation and Commercial Tourist (CT) zone.
A. Zone change on power plant site
This LCP amendment includes a proposal to change the land use designation on the power plant site
(east of Carlsbad Boulevard and north of Cannon Road) from Utility (U) to Visitor Commercial/Open
Space (VC/OS), and to change the zoning from Public Utility (PU) to Commercial Tourist/Open Space
(CT /05). Carlsbad residents submitted letters to the Coastal Commission expressing the preference
to zone the power plant site as Open Space (OS) rather than the proposed Commercial Tourist (CT)
zone.
In January 2014, the City of Carlsbad and Carlsbad Municipal Water District, Cabrillo Power I LLC and
Carlsbad Energy Center LLC, and San Diego Gas and Electric Company entered into an agreement that
requires the existing power plant (excluding the desalination plant) to be decommissioned and
demolished .... Through the .. city's. Genera!Plan. update process,.wl:licbiovolved extensive .. comm1.J11itv.
outreach and input, the community identified that the preferred future use of the site is visitor
commercial and open space. The proposed LCP amendment will designate the site with land use and
zoning designations (VC/05 land use and CT/OS zoning) that are consistent with the community's
envisioned future use of the site. The proposed land use and zoning designations are also consistent
with priority land uses identified by the Coastal Act.
In addition to the proposed land use and zoning designations, the city's new General Plan includes

• Require the power plant to be decommissioned and demolished pursuant to the agreement
mentioned above.
• Require that the desalination plant remain on the site (this area of the site is proposed to be
designated for "Public (P)" l~nd use).
· " Require the site to be redeveloped with a mix of visitor-serving commercial uses and community-
accessible open spaces along Agua Hedionda Lagoon ·and Carlsbad Boulevard (encouraging
community gathering spaces, outdoor dining, and otherfeatures to maximize potential views of
the ocean and the lagoon). ·
• Require a comprehensive planning process (e.g. spedfic plan or master plan) to determine specific
uses, development standards, infrastructure, public improvements, site planning and amenities.
• Require the city to work with SDG&E to identify a mutually acceptable alternative location for
SDG&E's north coast service center and an alternative site for the Encina substation.
The power .:p-Jant site is located within the Agua Hedionda segment of the city's LCP, and there
currently is no certified implementation plan for this segment. Therefore, as recommended by the
commission's staff, the proposed zone change on the power plant site has been removed from this
LCP amendment and will be deferred and incorporated with the city's comprehensive LCP update
(currently in process). For this LCP amendment, commission staff recommends that the commission
approve the proposed land use designation (VC/OS). Unti.1 the Coastal Commission certifies an
implementation plan for this segment of the city's LCP, any future coastal development permit
proposal on this site will be reviewed by the Coastal Commission and will be subject to the approved
land use designation; the city's zoning (CT/OS) will be referred to as a guide in the commission's
consideration of the coastal development permit.
B. Revis.ions to Toudst Recreation Commercial (TR) land use designation and Commercial Tourist (CT)
zone
• Land use designation title change
The title "Tra.vel Recreation Commercial (TR)" is proposed to be replaced with "Visitor Commercial
(VC)1'. The title change does not change the primary intent of the land use designation. In fact,
the new "Visitor..Commercial (VC)" title.is intended to be more intuitive.and user-friendly by more
directly describing the intended land use of the designation. The title change also more directly
reflects the -expressed Coastal Act lartd use priority, .and more clearly represents how the
designati0n is differe:nt than the city's other c:ommercial.larid' ose designations (Local Shopping
Center (L), General Commercial {GC), and Regional Commercial (R)). Whether the designation is
titied TR or VC, the'primary difference when compared to the other commercial designations is
the focus on visitor-serving commercial and recreation uses.
• Proposal to allow residential as mixed use in the CT zone
As part'of the city's.General Plan update (approved in September 2015), changes were made to
the General Plan description of typical land uses allowed in the VC land use designation. The
thangt?.s added the ability to include residential uses in combination With a visitor commercial
development, provided the primary use of the property is visitor-serving. To implement this
provisio·n of the General Plan, the city proposes to add residential mixed use as a permitted use
in the CT zone. Whi.le the General Plan is not part of the city's LCP, and not the subject of this
propose.d LCP amendment, the CT zone is part of the city's LCP implementation plan and the

proposed revision to the CT zone is part of this proposed LCP amendment. However, .as
recommended by your staff, the city requests that the commission defer their action on the
proposed CT zone amendment. The city will continue to coordinate with your staff on this
propoScll as part oUhe city's comprehensive LCP,update. '
As described in :the_ letters submiUed to,. yo.ur staff in: regard to this LCP amendme_nt, some
Carlsbad residents qelieve that the proposed visitor commercial revi~i.ons, described above, were
related to a privately sponsored initiaU~e (Agua Hedi_qnda So~th'· Shore Specific Pla.n -AHSP
initiative) to develop a site designated TR; the site is located on the east side of Interstate 5 and
squth of Agua' Hedionda Lagoon, north of Cannon Road. In February 2016, Carlsbad residen.ts
voted to reject the AHSP initiative (Measure A).
The proposed visitor commercial land use/zone changes described above are not related to the
AHSP .initiative; the proposed changes were drafted as part of the city's General Plan update and
the proposed LCP amendment. The AHSP initiative was a completely separate process from the
General Plan update/LCP amendment. The AHSP initiative proposed a stand-alone proposal to
create a new "Visitor-Serving Commercial (VSC)" land use designation for the AHSP initiative site.
The AHSP proposed VSC designation was a stand-alone designation for that particular property
and was entirely different from and not dependent upon the General Plan update and proposed
LCP amendment.
The General Plan update and proposed LCP amendment were initiated by the city, completely
independent and unrelated to the AHSP initiative, and began nearly seven years prior to the AHSP
initiative. The General Plan update and proposed LCP amendment involved extensive community
involvement, including a 19 member citizens committee, numerous workshops and stakeholder
meetings, two citywide surveys, and public hearings, which culminated in the City ·Council's
approval of the comprehensive update/ameridment in September 2015.
As stated above, it is recommended that the commission defer th·eir consideration and action on
the proposed CT zone change that would allow residential mixed use. The CT zone is the zone
utilized to implement the VC (or TR) land use designation, therefore, at this time, it will not be
possible for the city or Coastal Commission to allow residential mixed use on any site designated
VC or zoned CT within the coastal zone. As stated above, the city and your staff will address this
issue with the city's comprehensive LCP update. ·

Mr N eu attempted to distinguish the vote on Measure A and the 48 acres
on the South Shore of the Agua Hedionda Lagoon and the property
currently occupied by the Encina power plant as separate issues. They
are not. He also stated that "the community identified that the preferred
future use of the site is Visitor Commercial and Open Space" and'\hat is
consistent with the community's envisioned future use of the site." This
outrageous statement indicates to me that the senior staff and city are
continuing to insult the voters who voted for OPEN SPACE in the Agua
Hedionda segment. Obviously, the city is still moving forward with
plans to develop that land.

and have continued to ask regarding the relationship of our City

Measure A, we have to say TRANSPARANCY is still lacking in
