PLEDGE OF ALLEGIANCE: Council Member Schumacher led the Pledge of Allegiance. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: No report. PRESENTATIONS: Council Member Schumacher presented a proclamation to Public Works Director Pat Thomas in recognition of Public Works Week. Mayor Hall presented a proclamation to Bob Benson in recognition of his service on the Library Board of Trustees. Council Member Keith Blackburn presented a proclamation to Senior Engineer Craig Williams in recognition of Bike Month & Bike to Work Day. CONSENT CALENDAR: ACTION: Motion by Council Member Blackburn, seconded by Council Member Schumacher, to approve Consent Calendar Item Nos. 1 through 7. Motion carried 3/0/2 (Wood and Packard absent). 1. AB #22,289 -Approval of Resolution No. 2016-089 authorizing a right of entry permit with the State of California Department of Parks & Recreation to maintain the upper picnic facilities at Tamarack State Beach and the Coastal Bluff at Tamarack/Frazee State Beach. 2. AB #22,290 -Approval of Resolution No. 2016-090 approving the Police Department's participation in U.S. Department of Homeland Security FY2015 Operation Stonegarden, and appropriating $40,000 for anti-smuggling operations. AB #22,291-Approval of Resolution No. 2016-091 accepting the Annual Housing Element Progress Report for January 2015 through December 2015. 4. AB #22,292-Approval of Resolution No. 2016-092 appointing the following members to the City of Carlsbad's Community Activity Grant Citizens' Advisory Committee: Julie Hahn representing the Northeast Quadrant; Wendy Hinman representing the Library Board of Trustees; and, Jason Hansen representing the Parks & Recreation Commission. 5. AB #22,293 -Approval of Resolution No. 2016-093 authorizing the Carlsbad City Library to apply for a grant from the California Library Literacy Service, to accept any award, and authorize the Administrative Services Director to appropriate any funds received. 6. AB #22,294 -Approval of Resolution No. 2016-094 authorizing out of state travel for the Senior Assistant City Attorney to attend a conference June 13-14, 2016 in Las Vegas, Nevada. 7. AB #22,295 -Approval of Resolution No. 2016-095 accepting the construction of the 2015 Concrete Replacement, Project No. 6013-15, as complete and directing the City Clerk to record the Notice of Completion and release bonds in accordance with state law and city ordinances. ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: None. PUBLIC COMMENT: Kristine Wright expressed concerns relating to the revised General Plan land use designations as presented to the California Coastal Commission. Vicky Syage spoke in opposition to the Local Coastal Plan amendment as presented to the California Coastal Commission. Sue Reynolds, head of Community Housing Works, expressed appreciation for the City's investment in the La Costa Paloma affordable housing project. Kimani Camienn, a resident living at La Costa Paloma, expressed her appreciation for the City's investment in La Costa Paloma. Judith Gonzalez also expressed her appreciation for the City's investment in La Costa Paloma. She explained that living there has allowed her the opportunity to send her kids to college. Penny Johnson expressed concerns relating to the revised General Plan as it was presented to the California Coastal Commission. Lisa McKethan requested that staff and Council provide adequate answers to resident questions relating to proposed land use changes in the General Plan. AB #22,296 -Introduction of an ordinance approving an amendment to the Robertson Ranch Master Plan, MP 02-03(H) for property generally located southeast of the intersection of Cannon Road and Wind Trail Way, within the Robertson Ranch Master Plan, Planning Areas 22 and 23G, in Local Facilities Management Zone 14. Case Name: Cannon Road Senior Housing, Case No.: MP 02-03(H); and Approval of a resolution adopting a mitigated negative declaration and mitigation monitoring and reporting program and approving Site Development Plan No. SDP 15-13, Minor Site Development Plan No. SDP 15-19, Conditional Use Permit No. CUP 15-05 and Tentative Parcel Map No. MS 15-12 to allow for the subdivision of a 7.52 acre parcel into three lots, relocation of an existing RV Storage Lot and development of a 98-unit senior apartment project on property generally located southeast of the intersection of Cannon Road and Wind Trail Way, within the Robertson Ranch Master Plan, Planning Areas 22 and 23G, in Local Facilities Management Zone 14. Case Name: Cannon Road Senior Housing, Case No.: SDP 15-13/SDP 15-19/CUP 15-05/MS 15-12. Associate Planner Jason Goff presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Schumacher, Planner Goff confirmed that the land use designation and density for this project was analyzed as part of the Envision Carlsbad process. Council Member Blackburn confirmed with staffthat the units being proposed are considered dwelling units as defined in the General Plan. Planner Goff responded to a letter the City received dated May 16, 2016 from Preserve Calavera (on file in the Office of the City Clerk). Mr. Goff addressed the environmental issues that were raised in the letter. Adrian Peters, representing Brookfield Residential gave a presentation providing an overview of the project (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 7:02p.m. Spoke in support of the proposed project: Bill Arnold. Speakers in opposition of the proposed project: Diane Nygaard; Cori Schumacher. Seeing no one else wishing to speak, Mayor Hall closed the Public Hearing at 7:12p.m. Paul Klukas, Planning Systems, came forward to address the Council on behalf of the applicant. He stated that Planning Area 22 does not have a frontage on the wildlife corridor. City Planner Don Neu commented that according to information provided by SANDAG, the City of Carlsbad has a job to housing ratio of three to one which is higher than most other cities. May 17, 2016 Carlsbad City Council Regular Meeting Page 4 Council discussion ensued regarding their support for the project as presented. City Attorney Brewer titled the Ordinance. ACTION: Motion by Council Member Blackburn, seconded by Council Member Schumacher, to take public input, close the public hearing, introduce Ordinance No. CS-297 and adopt Resolution No. 2016-096. Motion carried 3/0/2 {Wood and Packard absent). 9. AB #22,297 -Approval of a resolution declaring the results of the assessment ballot tabulation, annexing the Robertson Ranch West Village Development to Street Lighting and Landscaping District No. 2, ordering maintenance work and confirming the diagram and assessment. Senior Accountant Roxanne Muhlmeister presented the report and reviewed a PowerPoint presentation {on file in the Office ofthe City Clerk). Mayor Hall opened the duly noticed Public Hearing at 7:30 p.m. Seeing no one wishing to speak the Mayor closed the Public Hearing at 7:30p.m. City Clerk Barbara Engleson reported that the number of assessment ballots received in support ofthe assessment district exceeded the number received in opposition to the district. Therefore, a majority protest did not exist and the Council could move forward with approval of the resolution as presented by staff. ACTION: Motion by Council Member Blackburn, seconded by Council Member Schumacher, to take public input, close the public hearing, and adopt Resolution No. 2016-097. Motion carried 3/0/2 {Wood and Packard absent). Mayor Hall declared a recess at 7:31 p.m. Mayor Hall reconvened the meeting 7:37p.m. 10. AB #22,298 -Approval of an ordinance adopting an amendment to the Occidentai-Jewitt Specific Plan {SP 186 to: 1) add an Automotive Retail District; 2) expand the Architectural Guidelines to allow for contemporary architecture within the Automotive Retail District; and 3) add a review process and development standards within the Automotive Retail District. The properties affected by the Specific Plan Amendment are located west of Interstate 5, on the east side of Avenida Encinas, in between Palomar Airport Road to the north and Poinsettia Lane to the south, addressed as 6800 and 6830 Avenida Encinas, within Local Facilities Management Zone 22. Case Name: Hoehn Motors Auto Retail District. Case No.: SP 186{E). Associate Planner Shannon Werneke presented the report and reviewed a PowerPoint presentation {on file in the Office of the City Clerk). In response to Mayor Hall, Planner Werneke confirmed that the height of the buildings and required setbacks will remain the same. Mayor Hall opened the duly noticed Public Hearing at 7:45 p.m. Seeing no one wishing to speak the Mayor closed the Public Hearing at 7:45p.m. Council discussion ensued regarding their support for the project. City Attorney Brewer titled the Ordinance. ACTION: Motion by Council Member Blackburn, seconded by Council Member Schumacher, to take public input, close the public hearing, and introduce Ordinance No. CS-298. Motion carried 3/0/2 (Wood and Packard absent}. 11. AB #22,299 -Approval of an ordinance adopting an amendment to the Carlsbad Research Center Specific Plan (SP 180 (I}} to include a new land use category that would permit a commercial hotel and related business traveler uses on Lot 75 with the approval of a Conditional Use Permit on property generally located on the southwest corner of Faraday Avenue and Van Allen Way in local Facilities Management Zone 5. Case Name: Carlsbad Research Center Specific Plan Amendment for Lot 75. Case No.: SP 180(1}. City Planner Don Neu presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk}. The Applicant Colleen Blackmore came forward to address. Ms. Blackmore requested that the Council support the project. Mayor Hall opened the duly noticed Public Hearing at 7:59p.m. Speaker in opposition of the proposed project: Cori Schumacher. Seeing no one else wishing to speak, Mayor Hall closed the Public Hearing at 8:02p.m. Council discussion ensued regarding their support for the proposed project. City Attorney Brewer titled the Ordinance. ACTION: Motion by Council Member Blackburn, seconded by Council Member Schumacher, to take public input, close the public hearing, and introduce Ordinance No. CS-299. Motion carried 3/0/2 (Wood and Packard absent}. DEPARTMENTAL AND CITY MANAGER REPORTS: 12. AB #22,300 -Approval of a resolution authorizing the City Manager to enter into a Memorandum of Understanding among the cities of Carlsbad, Escondido, Oceanside, San Marcos and Vista for the purposes of implementing the Innovate 78 Economic Development Initiative. May 17, 2016 Carlsbad City Council Regular Meeting Page 6 Management Analyst Kevin Pointer and Matt Sanford, Director of the San Diego Regional Economic Development Corporation, presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk}. Council expressed their support for approval of Memorandum of Understanding. ACTION: Motion by Council Member Blackburn, seconded by Council Member Schumacher, to adopt Resolution No. 2016-098. Motion carried 3/0/2 (Wood and Packard absent}. 13. AB #22,301-Approval of a resolution appointing one member to the Housing Commission- Rental Assistance (Senior} category. ACTION: Motion by Council Mayor Hall, seconded by Council Member Blackburn, to adopt Resolution No. 2016-099 appointing Joy Evans to the Housing Commission. Motion carried 3/0/2 (Wood and Packard absent}. COUNCIL REPORTS AND COMMENTS: Mayor Hall and council members reported on activities and meetings of some committees and sub-committees of which they are members. CITY MANAGER COMMENTS: None.
