SPORDINANCE NO. 9409 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING A SPECIFIC PLAN (SP-116) FOR 179 SINGLE- FAMILY LOTS, 3 CONDOMINIUM LOTS WITH A MAXIMUM DENSITY OF 20 DWELLING UNITS PER ACRE AND 8 OPEN SPACE LOTS 011 57.3 ACRES LOCATED SOUTHWESTERLY OF THE INTERSECTION OF LA COSTA AVENUE AND RANCHO SANTA FE ROAD. APPLICANT: LA COSTA LAND COMPANY The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: A Specific Plan (SP-116) is hereby adopted for development of 179 single-family lots, 3 condominium lots with a maximum density of 20 dwelling units per acre and 8 open space lots on 57.3 acres located southwesterly of the intersection of La Costa Avenue and Rancho Santa Fe Road, more particularly described as: Portions of Lot 1, of Fractional Section 6, Town- ship 13 South, Range 3 West; portions of Lots 1 and 2 of Fractional Section 1, Township 13 South, Range 4 West, S.B.M.; and portions of Lots 3, 4, 9 and 10 of Rancho Las Encinitas, Map No. 848, recorded in the office of the County Recorder, County of San Diego, State of California, said plan to consist of a plot plan marked Exhibit A to SP-116, dated October 10, 1974, and an application with attachments on file in the office of the City Planning Department and incor- porated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan (SP-116) is justified by the following findings: A. Conformance of the revised Specific Plan to the approved Master Plan and to the General Plan. B. Conformance of the revised Specific Plan to all re- quirements of the Municipal Code requirements applicable to prop- erty located in the Planned Community Zone. C. The Specific Plan (SP-116) is approved subject to the following conditions and restrictions and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. This approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated October 10, 1974. 2. All setbacks and other development standards for the single-family lots shall conform to those established in the R-1 Zone District. Coverage of said lots shall not exceed 33-1/3%. 3. The applicant shall install all required fire hydrants and drystand pipes prior to framing construction, and said fire appurtenances shall be functional prior to commencing such work. 8. A program for the maintenance of open space ease- ments (Lots 183 through 190, inclusive) shall be submitted to the Planning Director for approval prior to issuance of building permits. SECTION 4: Administration and Enforcement. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adop- tion.
