HomeMy WebLinkAbout1995-03-28; City Council; Minutes0 0 b MINUTES MEETING OF: CITY COUNCIL (Regular Meeting) DATE OF MEETING: March 28, 1995 TIME OF MEETING: 6:OO p.m. PLACE OF MEETING: City Council Chambers CALL TO ORDER: Mayor Lewis called the Meeting to order at 6:OO p.m. ROLL CALL was taken by the Assistant City Clerk, as follows: Present: Council Members Hall, Finnila, Mayor Pro Tem Nygaard and Mayor Lewis. Absent: Council Member Kulchin. APPROVAL OF MINUTES: None. CONSENT CALENDAR: Item #3 was withdrawn from the Consent Calendar. ACTION: On motion by Mayor Pro Tem Nygaard, Council affirmed the action of the Consent Calendar, Items 1 through 5, with the exception of Item #3, as follows: AYES: Lewis, Nygaard, Finnila and Hall WAIVER OF ORDINANCE TEXT READING: Council waived the reading of the text of all Ordinances and Resolutions at this Meeting. 77 1. AB #13,071 - SELECTION OF ADMINISTRATIVE SERVICES CONSULTANT FOR COMMUNITY 45 FACILITIES DISTRICT NO. 1. Council adopted RESOLUTION NO. 95-71, approving an agreement with Hale Carter Consulting to perform administrative services for Community Facilities District No. 1. 74 2. AB #13,072 - SETTLEMENT OF WORKERS COMPENSATION CLAIM OF MARC RENO. Council adopted RESOLUTION NO. 95-72, approving the Stipulations with Request for Award authorizing the payment of $9,275, at the rate of $140 per week, to Marc Reno as settlement of his workers compensation claim. 99 3. AB #13,073 - APPROVAL OF PREPAYMENT AGREEMENT FOR THE CONSTRUCTION OF ALGA 45 ROAD AND POINSETTIA LANE. AB #13.079 - MEMORANDUM OF UNDERSTANDING WITH CARLSBAD POLICE OFFICERS ASSOCIATION. Council adopted RESOLUTION NO. 95-76, approving the MOU with the Carlsbad Police Officers Association for the period January 1, 1995, through December 31, 1995. 70 5. AB #13,075 - APPROVAL OF PROGRAM SUPPLEMENT NO. 19 FOR REIMBURSEMENT 45 FINANCING FOR THE WEST CARLSBAD BOULEVARD BRIDGE - PROJECT NO. 3349. Council adopted RESOLUTION NO. 95-74, approving Program Supplement No. 19 to Local Agency-State Agreement No. 11 -5308, for reimbursement financing for the replacement of the West Carlsbad Boulevard Bridge over Batiquitos Lagoon. ANNOUNCEMENT: Mayor Lewis announced that Items #7 and #8 on the Agenda will be continued to April 4, 1995, when a full Council will be present. ORDINANCE FOR ADOPTION: 67 6. AB #13,074 -AMENDMENTS TO CHAPTER 19.04 OF THE CARLSBAD MUNICIPAL CODE - MCA 94-1. ACTION: On motion by Mayor Pro Tem Nygaard, Council adopted ORDINANCE NO. NS- - 305, amending Title 19, Chapter 19.04 of the Carlsbad Municipal Code by the amendment of Sections 19.04.030(a), 19.04.040(b), 19.04.050, 19.04.060(a), (b), (e), (f), 19.04.070, 19.04.08O(a), 19.04.090(a), 19.04.100(a), (b), (e), (f), 19.04.110, 19.04.120, 19.04.130, 19.04.140, 19.04.160, 19.04.170, 19.04.190, 19.04.210, 19.04.220, 19.04.260(a), 19.04.280(a), (b), 19.04.290, 19.04.350, 19.04.360, 19.04.370 to bring the Chapter into conformance with the California Environmental Quality Act and the State CEQA Guidelines. AYES: Lewis, Nygaard, Finnila and Hall PUBLIC COMMENT: B. J. Heinzman, 808 Caminito Del Sol, explained the Community Service Bulletin Board, stating it contains a list of all of the social service agencies in Carlsbad and Oceanside that are online, She stated that the Resource Directory Brochure, which explains the Community Services Bulletin Board, will be available to citizens, the City, and to the service organizations in the area. HOUSING AND REDEVELOPMENT COMMISSION: Council adjourned to the Housing and Redevelopment Commission at 6:lO p.m., and re-convened at 6:26 p.m., with four Members present and Council Member Kulchin absent. 3 Y > 0 0 March 28, 1995 CITY COUNCIL Page 3 DEPARTMENTAL AND CITY MANAGER REPORTS: 48 7. AB #13,076 - GREEN VALLEY INITIATIVE PETITION. This item was continued to the meeting of April 4, 1995. 57 8. AB #13,080 - DENIAL OF APPEAL - GPA 94-2/ZC 94-1/SDP 94-2 - CAMINO VILLAGE. 113 This item was continued to the meeting of April 4, 1995. 97 9. AB #13,077 - APPROVAL OF PLANS AND SPECIFICATIONS FOR IMPROVEMENTS TO ALGA ROAD BETWEEN MIMOSA DRIVE AND EL CAMINO REAL - PROJECT NO. 3428. Fred Greve, Mestre Greve Associates, 280 Newport Center Drive, Suite 230, Newport Beach, reported on the Noise Analysis for the Alga Road lane additions, stating that the conclusion was that the additional lanes will not increase the overall noise levels; which are projected to remain the same or in some instances to be slightly reduced. He said there was no mitigation recommended. Madeline Brown, 1786 Cottonwood Avenue, a resident of Seaport Villas, stated there was no noise level study done in her home and she was not advised when she purchased her home that this road would be widened in the future. She stated petitions had been presented to the City Engineer asking for a retaining wall for the area where she lives to provide safety, and to compensate for the noise and for the dirt and grime that will result from the road widening. ACTION: On motion by Mayor Pro Tem Nygaard, Council adopted RESOLUTION NO. 95- 75, approving plans and specifications and authorizing the City Clerk to advertise g bids for the construction of improvements to the south side of Alga Road between Mimosa Drive and El Camino Real - Project No. 3428. AYES: Lewis, Nygaard, Finnila and Hall 102 10. AB #13.078 - ESTABLISHMENT OF PRIMA FACIE SPEED LIMIT ON A PORTION OF AVENIDA ENCINAS. ACTION: On motion by Mayor Pro Tem Nygaard, Council introduced ORDINANCE NO. NS-306, amending Title 10, Chapter 10.44, of the Carlsbad Municipal Code by the amendment of Section 10.44.280 to establish a prima facie 35 mile per hour speed limit and prima facie 30 mile per hour speed limit upon designated segments of Avenida Encinas from Poinsettia Lane to its intersection with Palomar Airport Road. AYES: Lewis, Nygaard, Finnila and Hall ANNOUNCEMENTS: Mayor Lewis announced that Council Members have been invited to attend and participate in the following events: Council Workshop and Luncheon, at the Water District Offices Conference Room, on Wednesday, March 29, 1995, at 9:30 a.m. 3 3 f. 0 m March 28, 1995 CITY COUNCIL Page 4 ANNOUNCEMENTS: (Continued) Economic Development Roundtable, at the Olympic Resort Hotel, on Thursday, March 30, 1995, at 7:30 a.m. The Carlsbad 5000 Race, pre-race events and race day events on Saturday and Sunday, April 1 and 2, 1995. COUNCIL REPORTS: Council Members reported on the activities and meetings of the various Committees and Subcommittees of which they are Members. ADJOURNMENT: By proper motion, the Regular Meeting of March 28, 1995, was adjourned at 7:12 p.m., in honor of Thomas Brierley, former District Superintendent of the Carlsbad Unified School District, who died Saturday, March 25, 1995.
