MEETING OF: CARLSBAD CITY COUNCIL (Special Meeting)
DATE OF MEETING: September 11, 2012
TIME OF MEETING: 4:00 p.m.
PLACE OF MEETING: City Hall Conference Room 3,1200 Carlsbad Village Drive,
Carlsbad
CALL TO ORDER: Mayor Hall called the Meeting to order at 4:05 p.m.
ROLL CALL was taken by the Senior Deputy Clerk, as follows:
Present: Hall, Kulchin, Blackburn, Douglas, Packard .
Absent: None.
CLOSED SESSION:
Council adjourned into Closed Session at 4:05 p.m. pursuant to the following:
1. GOVERNMENT CODE SECTION 54957. To hold a closed session to discuss and consider
the evaluation of the City Attorney.
2. GOVERNMENT CODE SECTION 54957.6. To hold a closed session to discuss employer-
employee relations, salaries, salary schedules and compensation in the fonn of fringe
benefits of its unrepresented employees with designated staff as labor negotiators, (Cynthia
Haas, Deputy City Manager, Julie Clark, Human Resources Director, Debbie Porter, Senior
Management Analyst, Cheryl Gerhardt, Human Resources Professional and Steve Berliner,
Liebert Cassidy & Whitmore).
If circumstances necessitate the absence of a specified designated representative, an agent
or designee may participate in place oftlie absent representative so long as the name of the
agent or designee is announced at an open session held prior to the closed session.
3. GOVERNMENT CODE SECTION 54956.8. To hold a closed session to instruct its
negotiators (Cynthia Haas, Deputy City Manager, and Joe Garuba, Municipal Property
Manager) regarding purchase, sale, exchange or lease of real property located and
generally identified as:
Property Owner: City of Carlsbad
Location: Plaza Camino Real parking lot at 2525 El Camino Real
Negotiating Party: Jerry Engen For Plaza Camino Real c/o Westfield, LLC
If circumstances necessitate the absence of a specified designated representative, an agent
or designee may participate in place of the absent representative so long as the name of the
agent or designee is announced at an open session held prior to the closed session.
4. GOVERNMENT CODE SECTION 54956.9(a). To hold a closed session to discuss pending
litigation as follows:
Holbrook v. Citv of Carlsbad, et al. Case No. 37-2011-0008906-CU-PA-CTL
5. GOVERNMENT CODE SECTION 54956.9(c). To hold a closed session to consider
initation of litigation against Scheherezad Massoudi regarding a loan for property located at:
577 Laguna Drive, Carlsbad CA 92008
Citv of Carlsbad as Successor Agency to the Former Redevelopment Agency:
6. GOVERNMENT CODE SECTION 54956,9(c). To hold a closed session to consider
initiation of litigation against the County of San Diego and the State of California and other
taxing entities regarding Assembly Bill 1484, Demand for Payment and other requirements.
ADJOURNMENT.
The Council reconvened at 5:50 p.m. with five members present. Mayor Hall announced the City
Council met in closed session at 4:00 p.m. to discuss six items:
The first was the evaluation of the City Attomey; the second was employer-employee relations
regarding management employees, real property discussions on the Plaza Camino Real shopping
center parking lot, pending litigation in the case Holbrook v. Citv and potential litigation regarding
Scheherezad Massoudi and AB 1484.
The City Council also authorized the City Attomey to join in litigation against the State of California,
the County of San Diego and other taxing agencies, if necessary, in order to protect and preserve
its obligated redevelopment funds. The Council also authorized the City Attorney to file unlawful
detainer proceedings in order to obtain possession of the real property it owns at 577 Laguna
Drive.
The City Council directed the City Attorney on the other matters in ways it felt were in the best
interests of the citizens of Carlsbad, but no final action was taken on those matters and they will be
reported at a future meeting when final action occurs.
As to the evaluation of the City Attorney, although the Council members gave the City Attomey
high marks in his evaluation after 26 years of service, it is apparently his last evaluation since he
has announced his retirement at the end of this year.
ADJOURNMENT:
By proper motion, the Special Meeting of September 11, 2012 was adjourned at 5:54 p.m.
