HomeMy WebLinkAboutNorth Regional Zone Fire Agencies; 2002-11-18;NORTH REGIONAL ZONE MASTER AUTOMATIC AID AGREEMENT FOR FIRE, MEDICAL AND RESCUE RESPONSES WHEREAS, certain cities, districts and others located in San Diego County maintain as part of their service, organized and equipped Fire Department charged with the duty of fire protection, emergency medical, and rescue services within the limits of said jurisdictions, referred to below as the “parties”; and WHEREAS, it would be to the benefit of the parties that the fire suppression, emergency medical, and rescue services of each of their Fire Departments he, in some circumstances, extended outside of the limits of each party to this Agreement; and into the limits of the other parties; and WHEREAS, the parties desire that in some circumstances the Fire Departments of the other parties will respond to fire suppression, emergency medical, and rescue incidents within the limits of their jurisdictions; NOW, THEREFORE BE IT RESOLVED: 1. The parties to this Agreement, as set forth in Exhibit “A” have agreed to respond to emergency alarms outside of their normal service area, and within the normal service area of the other parties in accordance with the terms and conditions hereinafter set forth. 2. Any parties may, upon determining mutual benefit, agree to provide resources without regard to political andor jurisdictional boundaries, and adhere to the procedures established in the Operational Plan for determining response patterns as part of this Agreement. 3. The details as to the method of operations, procedures, and other planning as may be necessary to effectuate this Automatic Aid Agreement and type of units and responses shall be covered by the Operational Plan between the Chiefs of the respective Fire Departments of the parties. 4. There shall he an operational committee, which shall consist of the Chiefs or their designee of the respective Fire Departments of the parties, for the purpose of implementing the provisions of this Agreement relating to 3 operational procedure. Each party shall furnish the others in writing the name and rank of all participating officers. 5. The duties of Incident Commander shall be assumed by the first arriving fire officer from a participating agency who is at the scene of the incident, regardless of which jurisdiction the incident occurs in. There shall be an orderly transfer of command when an Officer from the jurisdiction in which the incident occurs arrives at the scene, if said Officer chooses to assume Incident Command. 6. All parties agree to indemnify the other parties for any liability imposed upon the other parties under Government Code 4895.2, based upon a negligent or wrongful act of omission of the indemnifying party’s officers, agents, or employees occurring in the performance of this Agreement. This indemnification agreement is entered into pursuant to Government Code 5895.4 and is intended to eliminate the prorate right of contribution described in Government Code 5895.6 and distribute the joint and several liability described in Government Code 5895.2 between the parties so that each party bears the liability and cost of its own negligence. 7. Each party to this Agreement shall maintain proper Worker’s Compensation Insurance covering its own employees without cost to the other parties, and each party shall be responsible for all salary and benefits for its own personnel without cost to the other parties. & Each of the parties shall be fully responsible for all repairs, maintenance and upkeep, including gas, oil, lubrication, parts replacement and repair of casualty damage, of all its own equipment used pursuant to this Agreement while said equipment is used outside of its service area. However, during prolonged suppression activities, the requesting party shall replenish fuel as needed, chemical agents, provide minor maintenance of fire suppression equipment, and provide for the well being of personnel involved in the suppression activity. 4 9. The assurance of automatic aid set forth in this Agreement shall constitute the sole consideration for the performance. It is, therefore, understood and agreed that no money payments shall be made between the parties, that no charges shall be assessed by any party against any other party, and that each party shall be fully responsible for all of its cost in connection with the performance of this contract except as provided for in Section 8. This provision shall not be construed to prevent billing patients for ambulance transport and other emergency medical services, provided that billing rates shall be consistent with the adopted fee schedule of the agency providing the services. 10. Nothing in this Agreement shall limit either party from participating in separate agreements with other fire jurisdictions and shall have no effect upon the existing San Diego County Mutual Aid Agreement. 11. This Agreement shall become effective upon the execution by each of the parties hereto and shall continue until terminated by mutual agreement of each of the individual parties or until any party gives sixty (60) days written notice of intention to terminate to each of the other parties. No cause shall be required for any termination. Termination of this Agreement by any party shall not terminate the Agreement with respect to the remaining parties to the Agreement, each of which may determine their continued participation independently. IN WITNESS WHEREOF, this Agreement has been executed by the parties by their duly authorized officers.
