Carlsbad offices regarding the Ocean Estates Project (Bernard Goldstein)

Dear Gentlemen,
Thank you for your time, patience and input in helping my client develop a
phasing schedule for the build out of his project for all of the onsite and offsite
improvements The following summarizes our joint understanding and approval
from the meeting
Since our office will be coordinating the revisions to the approved building plans,
construction changes to the grading plans and will also orchestrate the physical
build out of all the improvements, it is important to confirm our understanding of
all critical time deadlines and expectations
Regarding the Grading Permit We understand that permit #GR060038 is ready
for issuance This will be a phased grading process whereby Lot 4 and 5 will be
graded first and then Lots 1, 2, and 3 will be graded accordingly throughout the
course of 2008 at a time appropriate to obtain pad certifications for each and
satisfy the necessary deadline of the Residential Permit
Our office will "pull" permit within the next 7 days We understand the Grading
permit is valid for one year from issuance We will have a Pre-Con meeting with
the Grading Inspector (Rob Slempa) and all necessary subcontractors at the site
(within next 1 -2 weeks) Grading contractor will rough grade Lots 4 & 5 only at
this time Because of site wall/retaining wall changes necessary at the southerly
property line, a construction change to the approved grading plans will be
necessary and must be processed/approved by the City before pad is to be
certified Because the change in these walls will now be affected by the building
structure (this wall will now act as a support wall for the building structure and a
retaining wall for the soil) a separate permit will need to be issued to address this
condition and allow the retaining wall (building wall) to be built so that the
necessary requirements for 'pad certification' will be met (Time to complete
Since the entire building structure h'as to be recalculated by the structural
engineer and documents prepared, allow 8-10 weeks until submittal for retaining
wall permit, 2+ weeks for City to review/correct/issue permit, and 3 weeks to
construct necessary wall, and 1 week for final pad certification)
Regarding the Residential Permit for all four lots We understand that permit
#CB060974 must be issued in its entirety (all 4 houses) by December 31, 2008
We understand that no additional time extensions will be allowed and that any
other approvals necessary from other city departments would need to be
completed prior to this so that this deadline would be met The timing would be
such that our office would prepare the necessary revisions to the approved
building plans for Lots 2, 3 and 4 (time to complete 8 weeks from date above),
"slip sheet" the revisions and process the changes with the Building department
Once the pad is certified, our office would begin construction of the residence for
Lot 4 and continue through Certificate of Occupancy The next phase of
construction would be the build out of Lot 1 Our office would prepare the
necessary revisions to the approved plans, "slip sheet", obtain approvals, certify
the pad for Lot 1 and then begin building the structure for Lot 1 and continue
through Certificate of Occupancy This process would continue on sequentially
for Lots 2 & 3 within the timeframes outlined above
Regarding the Public Improvements within the R O W for all 3 streets Our office
will coordinate and manage the improvements as indicated on the approved
plans A permit will be "pulled" by the respective subcontractor for said work A
Pre-Con meeting would be held with Inspector and all necessary subcontractors
We also understand that all Public Improvements must be installed and
approved to the satisfaction of the City Engineer prior to the release of any
Certificates of Occupancy for any of Lots 1-4 (Timeline this work would start
tentatively August 15, 2008, or earlier, and last approximately 2 months)
If you have any revisions or corrections to the understanding listed above please
notify our office within the next 2 business days If there is no response, our
office will deem the memo to be acceptable to all

As the contractor and representative for Bernard Goldstein and per our meeting on
Tuesday, February 19th it is our intention to move forward in phases with the current
approved plans stating with the Mam House Single Family Dwelling as Phase 1 following
with lot 2, 3 & 4 of PUD We are currently separating the existing grading plan for
phasing and intend to pull a grading permit for Phase 1 as soon as possible followed by
a building permit As per verbal agreement with Michael Peterson we will pull building
permits for all phases by calendar end 2008 and is our understanding that there will be
no building permit extensions beyond December 31, 2008

Dear Bernard and Eduardo,
I received your letter requesting an extension of time for the Ocean Estates plan check
(PC060007) When we were discussing your plan check at the front counter, I checked
with my supervisor, Mike Peterson Rather than simply extending the existing plan
check, he wanted us to create a new 2007 plan check number This would allow you a
full year to complete the plan check, obtain all of the department's approvals and obtain
your building permits In order to do this, he wanted us to collect the money that ESGIL
is charging us to check your plans The amount we need to collect from you when you
come in to obtain the new 2007 number is $3,154 36 The plans will be marked with this
new number but ESGIL, Planning, Engineering and Fire Departments will simply
continue and pick up where they left off in their plan checking process
