RECOMMENDED ACTION:
Together with the Planning Commission, staff recommends that the City Council receive a staff report
and public testimony regarding:
a. Certification of a Program Environmental Impact Report (including Findings of Fact, a Statement of
Overriding Considerations, and a Mitigation Monitoring and Reporting Program) for the proposed
draft General Plan, Climate Action Plan and associated amendments to the Zoning Ordinance, Zoning
Map, Local Coastal Program land use and zoning maps, and Citywide Facilities and Improvement Plan;
b. A proposed General Plan Amendment to comprehensively update the General Plan, including the
Housing Element;
c. A proposed Zoning Ordinance Amendment to amend the Zoning Ordinance for consistency with the
draft General Plan;
d. A proposed Zoning Map amendment for consistency with the draft General Plan;
e. A proposed Local Coastal Program (LCP) Amendment to amend the LCP Land Use and Zoning maps
and LCP implementation plan consistent with the draft General Plan Land Use Map and Zoning Map
and Zoning Ordinance;
f. A proposed amendment to the Citywide Facilities and Improvements Plan to amend the Growth
Management circulation performance standard;
g. A proposed Climate Action Plan; and
h. A request for an allocation from the Excess Dwelling Unit Bank.

ITEM EXPLANATION:
The purpose of this joint City Council and Planning Commission public hearing is for both bodies to hear a staff
presentation and pubiic testimony regarding a proposal to comprehensively update the city's General Plan,
including the Housing Element, a proposal to establish a new Climate Action Plan, and a request to certify the
associated environmental impact report.
No action to approve the proposals is requested at this hearing. After receiving staff's report and public
testimony, it is recommended that the City Council adjourn and continue its hearing to a future date to be
determined and noticed after the Planning Commission has made a recommendation to the City Council. After
receiving staff's report and public testimony, it is recommended that the Planning Commission continue its
hearing to a date certain (likely July 22, 2015), at which time the commission will continue its deliberations
and consideration ofthe proposal. The Planning Commission may require additional meetings before making
a recommendation to the City Council. After receiving the Planning Commission's recommendation, staff will
schedule the proposal for City Council consideration.
Exhibit 1 to this agenda bill is a Report to the Planning Commission, dated July 18, 2015, which provides a
detailed description and analysis ofthe proposal.
FISCAL IMPACT:
Public hearings to consider the approval ofthe proposed EIR, General Plan, Climate Action Plan and associated
amendments are within the scope of work of the Envision Carlsbad Phase 2 consulting services contract; no
fiscal impact will result from the council's consideration of the proposal. In addition, certification of the EIR
and approval of the General Plan, Climate Action Plan and associated amendments will not result in a fiscal
impact, as the actions consist of establishing city policies and regulations. The city's implementation of the
policies may require future funding; however, such funding will be evaluated and determined in relation to
future projects.
ENVIRONMENTAL IMPACT:
Receiving a staff report and public testimony is exempt from environmental review per California
Environmental Quality Act (CEQA) Section 15306, which exempts data collection and resource evaluation
activities that do not result in serious disturbance to an environmental resource; such activities include
information gathering or a study leading to an action that a public agency has not yet approved, adopted or
funded.
The environmental analysis conducted for the proposed General Plan and Climate Action Plan is summarized
in Section V of the Report to the Planning Commission, dated July 18, 2015, and described in detail in the
associated EIR (EIR 13-02). After the Planning Commission provides a recommendation to the City Council,
the council will be asked to consider certifying the EIR for the General Plan and Climate Action Plan.

DESCRIPTION: This project consists of a comprehensive update to the Carlsbad General
Plan, which provides goals and policies to guide city actions relative to the city's develop-
ment through year 2035; the General Plan update also includes an update to the Housing
Element for the 2013-2021 housing planning period. For consistency with the General
Flan's updated land use and mobility polides, amendments are proposed to the General
Plan Land Use Map, Zoning Ordinance, Zoning Map, Local Coastal Program land use and
zoning maps, and the city's Growth Management circulation performance standard. In ad-
dition, a Climate Action Plan is proposed, which supplements the draft General Plan's sus-
tainabiiity policies by establishing a plan to reduce greenhouse gas (GHG) emissions within
the city. A program Environmental Impact Report (EIR) has been prepared for the project
and includes an analysis of potential environmental impacts associated with the project.
Those persons wishing to speak on this proposal are cordially invited to attend the public
hearing and provide the decision makers with any oral or written comments they may have
regarding the project. It is not necessary to re-submit comments which were submitted to
the city regarding the Draft EIR and/or Recirculated Draft EIR. Those comments, and the
city's responses to them, will be included in the Final EIR.
The joint public hearing is intended to provide an opportunity for public comment to both
the Planning Commission and the City Coimcil on the project and its environmental review.
At the conclusion of the joint public hearing, the Planning Commission wUl annoimce a
date at which time it will continue its meeting to deliberate and make its recommendations
regarding certification of the Final EIR and approval of the project. Thereafter, the City
Council will hold a separately noticed public hearing at a future date to consider the rec-
ommendations of the Planning Commission and to decide whether to certify the Final EIR
and to approve the project. Following the July 18th joint public hearing, public testimony
at the separate City Council meeting will be limited to changes, if any, in the Final EIR
or the project which occur after the joint meeting. The staff report. Final EIR, Draft EIR,
Draft General Plan, Draft Climate Action Plan, proposed changes to the land use and zoning

In 1946, six years before the city was incorporated, our family moved to the area known as North Carlsbad,
and then acquired Marja Acres in 1951. Over the years, the property has seen agricultural and commerciai
operations, and, of course, if s been a home to our family.
Since the outset of the Envision Carlsbad process, we have worked with staff on how Marja Acres would best
meet the goals of the General Plan Update. We feel ttiat the City of Carisbad has done an outstanding iob of
Involving citizens and land owners throughout the Envision Carisbad process and subsequent Planning
Commission and Citv CouncH nieetings. Citv Staff has in every instance been responsive and informathfe.
As such, we would like to express our complete support of staffs efforts on the General Plan Update and the
recommendations contained in the July 18,2015 Report to the Planning Commission and City Council.
We are writing to endorse the staff support for changing the land use designation for the Marja Acres
property, subject to the RECOMMENDED REQUIREMENTS as identified by staff in Attachment 8 under Table 8-
12 for the "Marja" property. We request that the Pianning Commission add a policy to the General Plan
requiring a minimum density of 12 units per acre and changing the land use designation on the General Plan
map to R-15 as supported bv staff. At 12 du/ac Marja Acres helps fill a gap in the medium density range. This
will assist the City in satisfying the stated goal of providing a variety of housing types and density ranges to
meet diverse demographic, economic and social needs. With these changes, Maria Acres would assist the Qtv
in nteeting its Housing Element Obiectives without adversely impacting the excess dwelling unit bank.
Without the staff supported changes, the residential site does not assist the City in meeting its Housing
Element Objectives. Further details are outlined in Attachment-A enclosed with this letter.
Because of its unique configuration consisting of adjacent commercial and residential parcels located on a
transportation corridor and an envisioned connection to adjacent park and school, Marja Acres provides an
opportunity to assist the City in achieving a number of goals, policies and environmental mitigations contained
in the General Plan Update. These benefits will occur if vou approve what staff has already vetted
thoroughh/ and thereby supported in the Julv 18.2015 Report to the Planning Commission and City Council.
We respectfulhr request vour concurrence with the staff supported changes to the land use designation and
the land use map: and, that a motion be passed to add a poiicv to the General Plan consistent with Table 8-
12 for the "Maria* property.

Clarification Regarding Table 8-12 (Pg 280, July 18,2015 - Report to the
Planning Commission and City Council)
• "Marja" Property will in fact, assist in meeting the Housing Element Obiectives
o For clarification, it is important to note that Table 8-12 (Pg 280 of the Staff Report) lays
out the precise action needed by Planning Commission as supported bv staff so that the
property will assist in meeting the Housing Element Objectives.
o Bv proceeding as staff recommends, under the "RECOMMENDED REQUIREMENTS
TO SUPPORT LAND USE CHANGE" under Table 8-12, the property will assist in
meeting Housing Element Objectives.
o In effect, the first bullet point of Table 8-12 (Pg 280 of the Staff Report) which currently
states, "Proposed density does not meet HE objectives," will be rendered not-applicable
by carrying out the staffs recommendation and eliminate anv drawback.
Property helps satisfy the GP stated goal of'^providing a variety of housing types and density
ranges to meet diverse demographic, economic and social needs (Goal 2-G.4)".
o "Mid-density" housing (12 du/ac as recommended by staff) fills a gap in available
housing density types in the City and provides diversity
The property supports core values of the General Plan Update including walking, biking,
public transportation, connectivity and access to recreation.
o A pedestrian/bicycle trail connection is envisioned that will connect the new coinmunity
to Loma Laguna Park and Kelly School to the property
o The proposed "Mid-density" as recommended by staff would provide limited but useful
on-site neighborhood scale commercial services to assist with traffic impacts and air
quality.
