RECOMMENDED ACTION:
Authorize the Financial Management Director to accept $20,00C in settlement of the debt owed by Rapp & Luxenberg Development
for delinquent transient occupancy taxes, interest and
penalties for deposit into the general fund and authorize the Mayor to sign the attached release upon receipt of the funds.
I ITEM EXPLANATION
Rapp & Luxenberg Development, a general partnership, owe5
delinquent occupancy taxes, penalties and interest ir
connection with the partnership's operation of a resorl
facility named Seashore on the Sand. One of the general
partners, Darryl C. Rapp, has offered to settle this debt wit1 a lump sum payment of $20,000. The City Attorney and thc
Financial Management Director have evaluated the ability 03
the City to recover the total amount due and have determine(
that it is in the best interest of the City to accept $20,00(
as a settlement of this debt.

RELEASE AND SETTLEMENT OF CLAIM
The City of Carlsbad hereby accepts the payment of
$20,000 in settlement of all delinquent transient occupancy taxes,
interest and penalties owed to the City by Rapp & Luxenberg
Development which arose from the operation of a business named
Seashore on the Sand, located at 2805 Ocean Street, Carlsbad,
California, between February 1, 1987 and September 30, 1990 anc
all interest accruing thereon.
